In one sentence
This bill creates a system to track sexual assault examination kits, sets deadlines for sending them to labs and testing them, and requires victims be notified about the status of their kit.
What it does
- Gives crime victims the right to know where their sexual assault exam kit is located and when it will be tested.
- Requires health care providers to tell law enforcement within 14 days after collecting an exam kit that it is ready to send.
- Mandates that law enforcement agencies send kits to a lab within 20 days of receiving them or using them for evidence collection.
- Sets a deadline for labs to finish DNA or serological testing on the kits no later than 120 days after they receive them.
- Requires labs to make a reasonable effort to tell victims when their kit has been tested, within two weeks of finishing the test.
- Creates a new tracking system run by the Department of Public Safety to follow each kit from collection until testing is done.
Who it affects
- Victims of sexual assault who have had an examination kit collected.
- Health care providers who gather evidence using these kits.
- Law enforcement agencies that receive and manage the kits.
- Laboratories accredited to perform DNA or serological testing on the kits.
Limits and unknowns
- If a criminal case is resolved before the kit is tested, health care providers, law enforcement, or labs do not have to meet the testing deadlines.
- A court cannot dismiss a crime charge just because an exam kit was not tested within the time limits set by this bill.
