SB90

What it does

• Allows a minor who is 16 years of age or older to give consent for up to five outpatient behavioral or mental health appointments lasting no more than 90 minutes each.
• Requires the provider and supervisor to decide by the fifth appointment if asking for parental consent would harm the minor's well-being due to abuse, neglect, or risk of stopping treatment.
• Permits providers to continue services without parental consent only if they determine seeking it is harmful or after making at least two unsuccessful attempts to contact parents.
• Mandates that mental health providers evaluate their decision about parental involvement every 60 days until the minor turns 18 years old.
• States that a provider cannot prescribe medication to these minors without obtaining consent from a parent or legal guardian.
