Restrictions on Adult Sex Offenders Near Schools

What it does

  • Prohibits registered adult sex offenders from being on school buildings, grounds, or other properties owned or leased by a school if they have reason to believe children under 18 are present for school activities or within 30 minutes before or after scheduled activities.
  • Bans registered offenders from knowingly loitering on a public way within 1,000 feet of the property line of school grounds or other school-owned properties when children under 18 are present for school activities or within 30 minutes before or after scheduled activities.
  • Prevents registered offenders from being in any vehicle owned or leased by a school to transport students if children under 18 are present in the vehicle.
  • Restricts registered offenders from residing within 1,000 feet of the property on which a school is located, unless their residence was established before July 1, 2010.
  • Sets a penalty of up to 6 months in prison, a fine of up to $750, or both for violating these restrictions.
  • Allows school districts to adopt more stringent safety and security requirements for employees and nonemployees on district facilities or properties.
