Subject: Creates the Energy Impacted County Roads Account to assist counties impacted by energy development. Summary/Major Elements: An energy impacted county roads program is established to assist counties in constructing or reconstructing county roads impacted by energy development. The program will be administered by the State Loan and Investment Board. Provides that counties are eligible to receive energy impacted assistance under the program if: o The county's total proposed energy impacted road projects exceed 15% of the average total annual county expenditures for its road and bridge maintenance and construction expenditures for the preceding 5 years. o The county has demonstrated that it has pursued alternative methods of funding; o That the funds will not supplant existing funding levels from traditional sources. No single county is eligible to receive an amount in excess of 40% of the total funds available at the beginning of the state's fiscal year without unanimous approval of the board. Comments: Appropriates $6,000,000 from the general fund to the Energy Impacted County Roads Account to assist county roads impacted by oil development in the Niobrara or similar formations as determined by the state loan and investment board. Requires an annual report (on or before December 1 of each year) on the grants awarded and progress of the program to the appropriations and transportation, highways and military affairs interim committees.
