HB0040 Bill No.: HB0040 Drafter: MQ LSO No.: 12LSO-0202 Effective Date: July 1, 2012 Enrolled Act No.: HEA0019 Chapter No.: CH0033 Prime Sponsor: Representative Byrd Catch Title: Optional sales/use tax-uses. Subject: Provides for the specific purpose excise tax to include maintenance of public roadways. Summary/Major Elements: Authorizes the specific sales/use tax, which must be used for a specified purpose and a specified amount, to be used for one (1) time major maintenance, renovation or reconstruction of a specifically defined section of a public roadway. Amends the use tax provision to "mirror" the sales tax statute. Specific purpose excise tax is prohibited from being used for "ordinary operations of local government, except those operations related to a specific project". Bill provides an exception to this prohibition by allowing one (1) time major work to be done upon a public roadway.

Why they voted this way
The speaker supports concurrence because removing language about fraud investigations does not harm the bill since law enforcement is already included, and limiting investigations to criminal offenses under Title VI also causes no harm.
