What it does

• Allows owners of real property within a district to file a petition with the county commissioners to exclude their land from the district.
• Requires the petitioner to provide a legal description of the property and a deposit of money sufficient to pay for the exclusion proceedings.
• Requires the county commissioners to publish notice of the petition and hold a hearing where interested parties can object in writing.
• Allows exclusion only if the property owner does not take or use the services provided by the district at that property at the time of the application.
• Allows the boundaries of a district to be enlarged by including additional real property through an enlargement petition filed with the county commissioners.
• States that newly included property is subject to all taxes and charges imposed by the district and is liable for its proportionate share of the district's existing debt.
• Prevents newly included property from being liable for taxes or charges levied before it was included in the district.
• Allows the district board to require owners of newly included property to pay for the cost of extending water or sewer lines to their area.
• Permits the district board to issue bonds for extending lines, but only if a majority of qualified electors in the included territory vote in favor, with taxes levied only on that included property for those costs.
