SYNOPSIS:
Under existing law, deductions may be made from
the salary of state employees for membership dues,
voluntary contributions, and insurance premiums.
Existing law also provides a 10-day window for
education employees to stop payroll deductions for
membership dues.
This bill would prohibit membership dues for
labor organizations from being deducted from the salary
of certain education employees.
This bill would require employee organizations
and professional associations to allow all state
employees to revoke their membership at any time and
without reason, and would prohibit those organizations
and associations from limiting an employee's ability to
revoke his or her membership.
This bill would require state employees who
revoke their membership from an employee organization
or professional association to immediately be released
from obligations relating to membership dues or
voluntary contributions and be removed from the
organization or association's membership list.
This bill would also remove statutory
limitations on when a state employee may opt out of
salary deductions for membership dues or voluntary

salary deductions for membership dues or voluntary
contributions, and would provide that employees must be
allowed to cancel those deductions at any time.
A BILL
TO BE ENTITLED
AN ACT
Relating to public employees; to amend Sections 16-22-6
and 36-1-4.4, Code of Alabama 1975; to prohibit salary
deductions from certain education employees for labor
organizations; to prohibit employee organizations and
professional associations from prohibiting or limiting any
state employee's ability to revoke his or her membership; and
to further provide for the procedures relating to salary
deductions, including termination of deductions, for all state
employees.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. Sections 16-22-6 and 36-1.4.4, Code of
Alabama 1975, are amended to read as follows:
"§16-22-6
(a) Each Except as provided in subsection (c), each
local board of education and certain postsecondary
institutions of higher education shall adopt policies or
regulations rules which will provide for deductions from
salaries of its employees or groups of employees whenever a
request is presented to the board or postsecondary institution
of higher education by the employees or groups. The deductions

of higher education by the employees or groups. The deductions
shall be made from salaries earned in at least nine different
pay periods and shall be remitted to the appropriate company,
association, or organization as specified by the employees
within 10 days following each deduction. The deductions may be
made for, but not limited to, savings plans, tax sheltered
annuities, the Public Employees' Individual Retirement Account
Fund, membership dues, voluntary contributions, and group
insurance premiums.
(b) Deductions for membership dues and voluntary
contributions shall be made based upon membership lists and
forms provided by the employees' organization. Such lists are
toMembership lists shall be corrected, updated, and returned
to the employees' designated organization(s) organizations:
(1) Annually, not later than November 10 of each school
year; and
(2) For employment contracts beginning or renewed on or
after October 1, 2026, upon notification by an employee
organization or professional association that an employee has
revoked his or her membership in the organization or
association . The 1982-83 membership dues and voluntary
contribution authorized, with appropriate yearly adjustments,
shall be deducted for each succeeding year unless the employee
revokes the deductions in writing on or before September 15 of
that year . Voluntary contributions may be revoked by giving a
30-day notice in writing . Upon receiving the written notice,
the employer shall immediately cancel any upcoming deductions
for voluntary contributions .
(c)(1) This subsection shall apply to employment

(c)(1) This subsection shall apply to employment
contracts beginning or renewed on or after October 1, 2026.
(2)a. Notwithstanding subsection (a), no local board of
education or public institution of higher education may make
any deduction or collection from the salary of any employee or
group of employees pursuant to this section for a labor
organization, including, but not limited to, those for dues or
uniform assessments. An employee may pay dues and uniform
assessments directly to a labor organization.
b. For the purposes of this subsection, the term "labor
organization" shall have the same meaning as provided in
Section 36-1-4.3.
(3) Any employee may revoke his or her membership in an
employee organization or professional association at any time.
An employee wishing to revoke his or her membership shall
submit the revocation to the employee organization or
professional association in writing, at which time the
employee organization or professional association shall revoke
the employee's membership and notify the appropriate employer
and the appropriate payroll office of the revocation. Upon an
employee's revocation of membership, the employee organization
or professional association shall immediately release the
employee from any obligations relating to membership dues or
voluntary contributions.
(4)a. No employee organization or professional
association may prohibit or otherwise limit an employee's
ability to revoke his or her membership in the organization or
association. No employee may be required to provide a reason
for revoking his or her membership under this subdivision.

for revoking his or her membership under this subdivision.
b. This subdivision includes an employee who pays dues
or voluntary contributions through salary deductions pursuant
to this section, or who pays dues or voluntary contributions
directly to an employee organization or professional
association.
(d) New authorizations for deduction of dues, voluntary
contributions, or employee savings plans , must be submitted to
the payroll office and deductions shall begin with the pay
period next following the receipt of authorization. Upon
termination of employment, amounts owed under the
authorization of the employee shall be deducted from the
employee's final pay due. With the exception of membership
dues and voluntary contributions, the board or postsecondary
institution of higher education shall not be required to make
more than one remittance of amounts deducted during a pay
period for a separate type of deduction. Health insurance,
life insurance, and tax sheltered annuities shall be
interpreted as separate types of deductions. When amounts have
been correctly deducted and remitted by the board or
postsecondary institution of higher education , the board or
postsecondary institution of higher education shall bear no
further responsibility or liability for subsequent
transactions. No board or postsecondary institution of higher
education shall be liable for any error when acting in good
faith pursuant to this section.
(e)(b) This section shall not apply to any four-year
postsecondary institution of higher education ."

"§36-1-4.4
(a) The policies adopted by the state Comptroller for
deductions from the salaries of state employees or groups of
state employees for employee organizations shall provide that
the deductions for membership dues and voluntary contributions
shall be made based on membership lists and forms provided by
the employees' organization , provided that the policies
reflect each of the following: . Such lists
(1) Membership lists shall are to be corrected and
revised annually :
a. Annually, according to procedures to be established
by the state Comptroller ; and
b. For employment contracts beginning or renewed on or
after October 1, 2026, upon notification by an employee
organization or professional association that an employee has
revoked his or her membership in the organization or
association.
(2) For employment contracts beginning or renewed on or
after October 1, 2026, any state employee may revoke his or
her membership in an employee organization or professional
association at any time. An employee wishing to revoke his or
her membership shall submit the revocation to the employee
organization or professional association in writing, at which
time the employee organization or professional association
shall revoke the employee's membership and notify the
appropriate employer of the revocation and the appropriate
payroll clerk or other appropriate officials, as specified by
the Comptroller. Upon an employee's revocation of membership,
the employee organization or professional association shall

the employee organization or professional association shall
immediately release the employee from any obligations relating
to membership dues or voluntary contributions .
(b) Membership dues and voluntary contributions
currently authorized on or before October 1, 2026, shall may
continue on an annual basis for the current yearly period and
for each succeeding yearly period , except that employees must
have the option to revoke their membership or any voluntary
contributions at any time pursuant to subsection (a) unless
the employee revokes the deduction in writing within 10 days
of the next succeeding yearly period. Voluntary contributions
may be revoked by giving a 30-day notice in writing .
(c)(1) This subsection shall apply to employment
contracts beginning or renewed on or after October 1, 2026.
(2) No employee organization or professional
association may prohibit or otherwise limit an employee's
ability to revoke his or her membership in the organization or
association. If an employee organization or professional
association requires employees to complete a form to revoke
membership in the organization or association, the form may
not require an employee to provide a reason for the
revocation.
(3) This subsection includes employees who pay dues or
voluntary contributions through salary deductions pursuant to
Section 36-1-4.3, or who pay dues or voluntary contributions
directly to an employee organization or professional
association.
(d) New authorizations shall be permitted on a monthly
basis according to procedures to be established by the state

basis according to procedures to be established by the state
Comptroller.
(e) Upon leaving state service whether by death,
retirement, termination, resignation, leave of absence , or
other means, payroll deduction of dues and authorized
voluntary deductions shall cease. When an employee returns to
state service from an approved leave of absence or other
temporary leave, payroll deductions and voluntary
contributions shall resume unless the employee revokes the
deductions in writing. When amounts have been correctly
deducted and remitted by the state Comptroller, the state
Comptroller shall bear no further responsibility or liability
for subsequent transactions."
Section 2. This act shall become effective on October
1, 2026.
