FOR AN ACT ENTITLED
"An Act creating and relating to the address confidentiality program; and providing for 1
an effective date." 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 3
* Section 1. AS 44.21.020 is amended to read: 4
Sec. 44.21.020. Duties of department. The Department of Administration 5
shall 6
(1) make surveys and studies to improve administrative procedu res, 7
methods, and organization; 8
(2) keep general accounts; 9
(3) approve vouchers and disburse funds for all purposes; 10
(4) operate centralized purchasing and supply services, and ne cessary 11
storerooms and warehouses; 12
(5) [REPEALED 13
(6)] supervise telephone, mailing, messenger, duplicating, and similar 14

services adaptable to centralized management; 1
(6) [(7)] administer the public employees' retirement system and 2
teachers' retirement system; 3
(7) [(8)] administer a statewide personnel program, including cent ral 4
personnel services such as recr uitment, assessment, position cl assification, and pay 5
administration; 6
(8) [(9)] administer and supervise a statewide automatic data 7
processing program; 8
(9) [(10)] study, design, imp lement, and manage the 9
telecommunications systems and services of the state under AS 44.21.305 - 44.21.330; 10
(10) establish and administer the address confidentiality prog ram 11
under AS 44.21.022 [(11) REPEALED]. 12
* Sec. 2. AS 44.21 is amended by adding a new section to read: 13
Sec. 44.21.022. Address confidentiality program. ( a ) T h e a d d r e s s 14
confidentiality program is established in the department to pro tect the confidentiality 15
of the address of an individual enrolled in the program. 16
(b) The department shall 17
(1) establish and administer the program; 18
(2) designate a post office box as a substitute mailing addres s for an 19
individual enrolled in the program; 20
(3) forward the mail of an individual enrolled in the program from the 21
post office box designated under (2) of this subsection to the individual's residential 22
street address, post office box, school address, or work addres s as specified on the 23
individual's application for enrollment in the program; 24
(4) maintain the confidentiality of the address of an individual enrolled 25
in the program; and 26
(5) adopt regulations establishing a procedure for a qualified individual 27
under (c) of this section to enroll in or withdraw from the program. 28
(c) The following individuals may enroll in the program: 29
(1) a victim of a crime involving domestic violence, stalking, human 30
trafficking, sex trafficking, or sexual assault if 31

( A ) a c o u r t h a s i s s u e d a p r o tective order on behalf of the 1
victim; or 2
(B) the victim meets other standards set by the department; 3
(2) a guardian of a minor, if a court has issued a protective order on 4
behalf of the minor; 5
(3) a peace officer; 6
(4) a correctional officer; and 7
(5) a household member of an individual specified under (1) - (4) of 8
this subsection who is enrolled in the program. 9
(d) Notwithstanding (c) of this section, a person with a duty to register under 10
AS 12.63.010 may not enroll in the program. 11
(e) A state or municipal agency shall allow an individual enro lled in the 12
program to use the post office box designated by the department under (b)(2) of this 13
section as the individual's mailing address. 14
(f) The length of initial enrollment in the program is five ye ars. If an 15
individual enrolled in the program does not renew the individua l's enrollment in the 16
program every five years, the d epartment shall remove the indiv idual from the 17
program. The department shall remove an individual enrolled in the program if, during 18
the time of the individual's enrollment in the program, the ind ividual is required to 19
register under AS 12.63.010. 20
( g ) T h e d e p a r t m e n t m a y n o t c o l l e c t a r e g i s t r a t i o n f e e f r o m a n individual 21
qualified under (c) of this section to enroll in the program. 22
(h) The department shall disclose an individual's address to a peace officer in 23
response to a search warrant issued by a state or federal court. 24
(i) A person who discloses info rmation that is confidential un der this section 25
about an individual enrolled in the program under (c) of this s ection is guilty of a class 26
B misdemeanor if the person 27
(1) is authorized to access the address confidentiality program database 28
and recklessly discloses the information to the respondent of a protective order; 29
(2) is not authorized to access the address confidentiality pr ogram 30
database and knowingly discloses the information to the respond ent of a protective 31

order; or 1
(3) accesses the address confidentiality program database with out 2
authorization to access the database and recklessly discloses the information. 3
(j) In this section, 4
(1) "correctional officer" means a person 5
(A) appointed by the commissioner of corrections whose 6
primary duty under AS 33.30 is to provide custody, care, securi ty, control, and 7
discipline of persons charged or convicted of offenses against the state or held 8
under authority of state law; 9
(B) employed in a correctional facility in this state whose 10
primary duty is to provide custody, care, security, control, an d discipline of 11
persons charged or convicted of offenses or held under authority of law; or 12
(C) employed full time in a municipal correctional facility 13
whose primary duty is to provide custody, care, security, contr ol, and 14
discipline of persons charged or convicted of offenses or held under authority 15
of law, and the correctional facility is located in a municipal ity that has 16
adopted AS 18.65.130 - 18.65.290 by ordinance under AS 18.65.285; 17
(2) "crime involving domestic vio lence" has the meaning given in 18
AS 18.66.990; 19
(3) "department" means the Department of Administration; 20
(4) "household member" means an adult or minor who lives in th e 21
same residence as an individual enrolled in the program; 22
(5) "peace officer" has the meaning given in AS 01.10.060; 23
(6) "program" means the address confidentiality program. 24
* Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 25
read: 26
TRANSITION: REGULATIONS. The Department of Administration may a dopt 27
regulations necessary to implement AS 44.21.022, enacted by sec . 2 of this Act. The 28
regulations take effect under AS 44.62 (Administrative Procedur e Act) but not before the 29
effective date of the law being implemented by the regulation. 30
* Sec. 4. Section 3 of this Act takes effect immediately under AS 01.10.070(c). 31

* Sec. 5. Except as provided in sec. 4 of this Act, this Act takes effect January 1, 2026. 1
