FOR AN ACT ENTITLED

"An Act relating to contributions and donations from permanent fund dividends; and 1
relating to disclosures included with an individual permanent fund dividend." 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 3
* Section 1. AS 43.23.028(a) is amended to read: 4
(a) By October 1 of each year, the commissioner shall give pub lic notice of 5
the value of each permanent fund dividend for that year and not ice of the information 6
required to be disclosed under (3) of this subsection. In addit ion, the stub attached to 7
each individual dividend disbursement advice must 8
(1) disclose the amount of each d ividend attributable to income earned 9
by the permanent fund from deposits to that fund required under art. IX, sec. 15, 10
Constitution of the State of Alaska; 11
(2) disclose the amount of each d ividend attributable to income earned 12
by the permanent fund from appr opriations to that fund and from amounts added to 13
that fund to offset the effects of inflation; 14

(3) disclose the amount by which each dividend has been reduce d due 1
to each appropriation from the dividend fund, including amounts to pay the costs of 2
administering the dividend prog ram and the hold harmless provis ions of 3
AS 43.23.240; 4
(4) include a statement that an individual is not eligible for a dividend 5
when 6
(A) during the qualifying year, the individual was convicted o f 7
a felony; 8
(B) during all or part of the qualifying year, the individual was 9
incarcerated as a result of the conviction of a 10
(i) felony; or 11
(ii) misdemeanor if the individual has been convicted of 12
a prior felony or two or more prior misdemeanors; 13
(5) include a statement that the legislative purpose for makin g 14
individuals listed under (4) of this subsection ineligible is to 15
(A) provide funds for services for and payments to crime 16
victims and operating costs of the Violent Crimes Compensation Board; 17
(B) provide funds to pay restitution owed to crime victims; 18
(C) provide funds for grants to nonprofit organizations for 19
services for crime victims and for mental health services and s ubstance abuse 20
treatment for offenders; 21
(D) provide funds for the office of victims' rights; 22
(E) provide funds to the Counc il on Domestic Violence and 23
S e x u a l A s s a u l t f o r g r a n t s f o r the operation of domestic violenc e and sexual 24
assault programs; and 25
(F) obtain reimbursement for som e of the costs imposed on the 26
Department of Corrections related to incarceration or probation of those 27
individuals; 28
(6) disclose the total amount that would have been paid during the 29
previous fiscal year to individuals who were ineligible to rece ive dividends under 30
AS 43.23.005(d) if they had been eligible; 31

(7) disclose the total amount transferred or appropriated for the current 1
fiscal year under AS 43.23.048 for each of the accounts, funds, and agencies listed in 2
AS 43.23.048; 3
(8) include a statement that the total amount of the dividend may 4
be subject to federal individual income tax, regardless of dona tions or 5
contributions made under AS 43.23.130, 43.23.135, or 43.23.230. 6
* Sec. 2. AS 43.23.055 is amended to read: 7
Sec. 43.23.055. Duties of the department. The department shall 8
(1) annually pay permanent fund dividends from the dividend fund; 9
(2) subject to AS 43.23.011 and (8 ) of this section, adopt reg ulations 10
under AS 44.62 (Administrative Pro cedure Act) that establish pr ocedures and time 11
limits for claiming a permanent f und dividend; the department s hall determine the 12
number of eligible applicants by October 1 of the year for whic h the dividend is 13
declared and pay the dividends by December 31 of that year; 14
(3) adopt regulations under AS 44.62 (Administrative Procedure Act) 15
that establish procedures and time limits for an individual upo n emancipation or upon 16
reaching majority to apply for permanent fund dividends not rec eived during minority 17
because the parent, guardian, or other authorized representativ e did not apply on 18
behalf of the individual; 19
(4) assist residents of the state, particularly in rural areas, who, because 20
of language, disability, or inaccessibility to public transport ation, need assistance to 21
establish eligibility and to apply for permanent fund dividends; 22
(5) use a list of individuals i neligible for a dividend under 23
AS 43.23.005(d) provided annually by the Department of Correcti ons and the 24
Department of Public Safety to determine the number and identit y of those 25
individuals; 26
(6) adopt regulations that ar e necessary to implement AS 43.23 .005(d) 27
and 43.23.048; 28
(7) adopt regulations that establish procedures for the parent, guardian, 29
or other authorized representativ e of a disabled individual to apply for prior year 30
permanent fund dividends not rec eived by the disabled individua l because no 31

application was submitted on behalf of the individual; 1
(8) adopt regulations that establish procedures for an individ ual to 2
apply to have a dividend d isbursement under AS 37.25.050(a)(2) reissued if it is not 3
collected within two years after the date of its issuance; howe ver, the department may 4
not establish a time limit within which an application to have a disbursement reissued 5
must be filed; 6
(9) provide any information, upon request, contained in perman ent 7
fund dividend records to the child support services agency crea ted in AS 25.27.010, or 8
the child support enforcement agen cy of another state, for chil d support purposes 9
authorized under law; if the info rmation is contained in an ele ctronic data base, the 10
department shall provide the requesting agency with either 11
(A) access to the data base; or 12
(B) a copy of the information in the data base and a statement 13
certifying its contents; 14
(10) establish a fraud investigation unit for the purpose of assisting the 15
(A) Department of Law in the p rosecution of individuals who 16
apply for or obtain a permanent fund dividend in violation of a provision in 17
AS 11, by detecting and investigating those crimes; and 18
(B) commissioner to detect and investigate the claiming or 19
paying of permanent fund dividends that should not have been cl aimed by or 20
paid to an individual and to impose the penalties and enforceme nt provisions 21
under AS 43.23.270; 22
(11) adopt regulations under AS 44.62 (Administrative Procedure Act) 23
so that , [CONTRIBUTIONS UNDER AS 43.23.130 ARE GIVEN A PRIORITY 24
OVER DONATIONS UNDER AS 43.23.230] if the total amount of contr ibutions and 25
donations elected by an applican t exceeds the amount of the per manent fund dividend 26
that the applicant is entitled to receive , contributions and donations are given the 27
following priority order: 28
(A) contributions under AS 43.23.130; 29
(B) donations under AS 43.23.230; 30
(C) contributions under AS 43.23.135. 31

* Sec. 3. AS 43.23 is amended by adding a new section to read: 1
Sec. 43.23.135. Contributions to the general and permanent fund s. (a) 2
Notwithstanding AS 43.23.200, the el ectronic Alaska permanent f und dividend 3
application must allow an applicant to direct that money be sub tracted from the 4
dividend payment and contributed to the state general fund or t he principal of the 5
permanent fund. A contribution to the state general fund or the p r i n c i p a l o f t h e 6
permanent fund may be $25 dollars or more, in increments of $25 dollars, up to the 7
total amount of the permanent fund dividend that the applicant is entitled to receive. If 8
the applicant's total amount of contributions under this subsec tion, when added to the 9
total amount of contributions under AS 43.23.130 and donations under AS 43.23.230, 10
exceeds the amount of the permanent fund dividend that the appl icant is entitled to 11
receive, contributions under AS 43.23.130 and donations under A S 43.23.230 shall 12
have priority over contributions under this subsection. Money f rom a contribution 13
under this subsection or from the dividend fund may not be used for administrative 14
costs incurred in implementing this subsection. 15
(b) A public agency that claims a permanent fund dividend on b ehalf of an 16
individual under AS 43.23.015(e) may not elect to make contribu tions from the 17
dividend under this section. 18
(c) In preparing the electroni c Alaska permanent fund dividend application, 19
the department shall ensure that the option to make a contribut ion under this section is 20
in a separate section of the application than the option to mak e a contribution under 21
AS 43.23.130. 22
