Plain English Breakdown

The official text does not provide a specific effective date, noting instead that provisions apply based on actions taken or agreements entered into after the act becomes effective.

Protecting Public Employee Personal Information

This law stops public employers in Alaska from sharing specific private details about their workers and creates an exception to the Public Records Act for this information.

What This Bill Does

  • Makes it an unfair labor practice for public employers to share certain employee personal information without permission or legal authority.
  • Lists home addresses, birth dates, phone numbers, email addresses, union membership status, and charity deductions as private data that cannot be disclosed by the employer.
  • Adds these protected records to a list of exceptions in the Public Records Act so they are exempt from standard public inspection requests.
  • Requires employers to send copies of denied information requests or summaries of oral requests to the employee's labor representative.

Who It Names or Affects

  • Public employers and their agents
  • Employees who work for public agencies
  • Exclusive representatives, such as unions representing bargaining unit members

Terms To Know

Unfair labor practice
An action by an employer that breaks the law regarding how they treat employees or their right to organize.
Public Records Act
The state law that gives people the right to look at government documents, unless a specific exception applies.
Exclusive representative
A labor organization or union chosen by employees to negotiate on their behalf with an employer.

Limits and Unknowns

  • The law does not stop employers from sharing information if another law requires them to do so.
  • Employers may still share the protected data if the employee gives written permission or if they are sending it directly to the employee's union representative.
  • Personal phone numbers can be shared only if there is a written agreement and a specific business need for that disclosure.
