Plain English Breakdown

The effective date is April 1, 2027, meaning these rules do not apply to systems installed before that date unless they choose the new program.

Alaska Net Metering Program and Reimbursement Fund

This law creates a program that gives monthly credits to customers who generate their own renewable electricity up to 25 kilowatts, sets an annual cycle for using those credits, and establishes a fund to help utilities recover costs.

What This Bill Does

  • Requires large electric companies called load-serving entities to give monthly credits equal to the value of extra power sent back to the grid by customer-generators.
  • Sets an annual cycle ending March 31 after which any unused credit expires.
  • Allows customers with systems installed before April 1, 2027, to choose this new program or keep their old rates.
  • Creates a reimbursement fund that utilities can use if they lose money because of the net metering credits.
  • Limits how much utility companies can raise rates for regular customers when paying out these credits by allowing rate changes only if losses would otherwise force an increase over two percent annually.

Who It Names or Affects

  • Customers who generate their own electricity using solar, wind, or other renewable sources on their property with systems of 25 kilowatts or less.
  • Electric utilities that sell more than five million kilowatt-hours of power per year and are served by an electric reliability organization.
  • The Alaska Energy Authority, which administers the reimbursement fund.

Terms To Know

Net metering
A system where customers get credit on their bill for extra electricity they send back to the power grid.
Consumer-generator
A customer who buys electricity from a utility but also makes some of their own using renewable energy systems up to 25 kilowatts in size that offsets part or all of their use.
Load-serving entity
An electric company that sells power directly to customers and serves as the main provider for an area, specifically those served by a reliability organization with over 5 million kilowatt-hours in sales.

Limits and Unknowns

  • The program only applies to systems installed before April 1, 2037.
  • Unused credits expire every year on March 31 if not used by that date.
  • Utilities can limit participation in the program only if a hearing proves it is needed for safety or fairness.

FOR AN ACT ENTITLED

"An Act relating to net metering; relating to reduced rates in the form of credits for 1
consumer-generators; establishing a net metering reimbursement fund; and providing 2
for an effective date." 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 4
* Section 1. AS 42.05.391(a) is amended to read: 5
(a) Except as provided in AS 42.05.306 and 42.05.395, a public utility may 6
not, as to rates, grant an unreasonable preference or advantage to any of its customers 7
or subject a customer to an unreasonable prejudice or disadvantage. A public utility 8
may not establish or maintain an unreasonable difference as to rates, either as between 9
localities or between classes of service. A municipally owned utility may offer 10
uniform or identical rates for a public utility service to customers located in different 11
areas within its certificated service area who receive the same class of service. Any 12
uniform or identical rate shall, upon complaint, be subject to review by the 13
commission and may be set aside if shown to be unreasonable. 14

* Sec. 2. AS 42.05.391(a), as amended by sec. 1 of this Act, is amended to read: 1
(a) Except as provided in AS 42.05.306 [AND 42.05.395], a public utility may 2
not, as to rates, grant an unreasonable preference or advantage to any of its customers 3
or subject a customer to an unreasonable prejudice or disadvantage. A public utility 4
may not establish or maintain an unreasonable difference as to rates, either as between 5
localities or between classes of service. A municipally owned utility may offer 6
uniform or identical rates for a public utility service to customers located in different 7
areas within its certificated service area who receive the same class of service. Any 8
uniform or identical rate shall, upon complaint, be subject to review by the 9
commission and may be set aside if shown to be unreasonable. 10
* Sec. 3. AS 42.05 is amended by adding a new section to read: 11
Sec. 42.05.395. Net metering. (a) A load-serving entity shall provide a net 12
metering service that 13
(1) on a monthly basis, credits a consumer-generator's account in an 14
amount equal to the consumer's excess electric energy generation multiplied by the 15
rate per kilowatt-hour that would apply if the consumer were not a consumer-16
generator; in this paragraph, the rate per kilowatt-hour may be a seasonal or time-of-17
use rate; and 18
(2) allows a consumer-generator to accrue and use account credit for 19
the consumer-generator's own consumption on an annual cycle that ends March 31 of 20
each year, after which all accrued and unused credit expires. 21
(b) A consumer-generator may elect to receive net metering service under this 22
section for generating capacity installed before April 1, 2027, or continue to receive 23
service under tariff terms in effect when the generating capacity was installed. 24
(c) A load-serving entity may not limit consumer-generator participation in the 25
net metering service within the load-serving entity's service territory unless the 26
commission, after a hearing, finds that the limitation is necessary to protect system 27
reliability or to prevent rates for customers that are not consumer-generators from 28
being unjust and unreasonable. 29
(d) A load-serving entity that provides a net metering service may apply to the 30
Alaska Energy Authority under AS 42.45.015 to seek to recover revenue losses 31

attributable to the entity's net metering service. 1
(e) If funds are not available in the net metering reimbursement fund 2
established under AS 42.45.015 and revenue losses attributable to a load-serving 3
entity's net metering service would require the entity to request approval from the 4
commission to increase rates for customers who are not consumer-generators by more 5
than two percent annually, the entity may request approval of the commission to 6
modify rates for consumer-generators. A rate modification under this subsection may 7
not increase rates for consumer-generators more than is necessary to avoid increasing 8
rates by more than two percent annually for customers who are not consumer-9
generators. 10
(f) A consumer-generator may not elect to receive net metering service under 11
this section for generating capacity installed on or after April 1, 2037. A consumer-12
generator may only continue to receive net metering service under this section 13
(1) until April 1, 2037, for generating capacity installed before April 1, 14
2030; or 15
(2) for up to seven years after the generating capacity was installed, for 16
generating capacity installed on or after April 1, 2030 and before April 1, 2037. 17
(g) The commission shall adopt regulations to implement this section that, at a 18
minimum, establish standards and procedures for calculating a load-serving entity's 19
revenue losses eligible for recovery under (d) of this section. 20
(h) The commission may not adopt a regulation that limits participation in a 21
load-serving entity's net metering service based on the total capacity of generation 22
systems used by consumer-generators participating in the service. This subsection 23
does not limit the authority of an electric reliability organization or the commission 24
under AS 42.05.760 - 42.05.790. 25
(i) This section applies only to load-serving entities that are served by an 26
electric reliability organization and have total retail sales exceeding 5,000,000 27
kilowatt-hours during a calendar year. 28
(j) In this section, 29
(1) "consumer" means a customer of a load-serving entity who 30
consumes electricity purchased from the load-serving entity; 31

(2) "consumer-generator" means a consumer who generates electric 1
energy 2
(A) on premises owned by, leased by, rented to, or licensed to 3
the consumer at a location where a load-serving entity provides service; 4
(B) through a generation system 5
(i) with a capacity of 25 kilowatts or less; 6
(ii) that produces the electric energy from solar 7
photovoltaic and solar thermal energy, wind energy, biomass energy, 8
hydroelectric energy, geothermal energy, hydrokinetic energy, ocean 9
thermal energy, or other renewable energy source that has a similar 10
environmental impact; and 11
(iii) that is interconnected and operates in parallel with 12
the load-serving entity; and 13
(C) that offsets part or all the consumer's own electrical use; 14
(3) "electric reliability organization" has the meaning given in 15
AS 42.05.790; 16
(4) "load-serving entity" has the meaning given in AS 42.05.790. 17
* Sec. 4. AS 42.45 is amended by adding a new section to read: 18
Sec. 42.45.015. Net metering reimbursement fund. (a) The net metering 19
reimbursement fund is established as a separate fund. The fund consists of 20
(1) money appropriated to the fund by the legislature; 21
(2) gifts, bequests, contributions from other sources, and federal 22
money; and 23
(3) interest earned on the fund balance. 24
(b) The authority shall administer the fund and serve as the fiduciary of the 25
fund under AS 37.10.071. 26
(c) Subject to appropriation, the authority may make payments from the fund 27
to a load-serving entity eligible for recoverable costs under AS 42.05.395 and 28
implement regulations adopted by the Regulatory Commission of Alaska. 29
(d) Nothing in this section creates a dedicated fund. 30
* Sec. 5. AS 42.05.395 and AS 42.45.015 are repealed April 1, 2044. 31
