BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 3
* Section 1. AS 23.05 is amended by adding new sections to read: 4
Article 6. Volunteer Labor Compliance Officers. 5
Sec. 23.05.400. Volunteer labor compliance officer program. (a) The 6
volunteer labor compliance office r program is established in th e department. Under 7
the program, a volunteer labor c ompliance officer may inspect a construction site and 8
document compliance with state labor law. 9
(b) The department shall 10
(1) maintain a roster of qualified volunteer labor compliance officers; 11
(2) delegate to a qualified vol unteer labor compliance officer the 12
authority to enter a place of employment and inspect records under AS 23.05.100; 13
(3) provide orientation for volunteer labor compliance officers. 14

(c) The department shall adopt r egulations to implement the vo lunteer labor 1
compliance officer program. The regulations must 2
(1) prescribe a visible badge i dentifying a volunteer labor co mpliance 3
officer; 4
(2) identify safety equipment required for a volunteer labor compliance 5
officer site visit; 6
(3) specify insurance coverage required for a volunteer labor 7
compliance officer. 8
Sec. 23.05.410. Powers and duties of volunteer labor compliance officers. 9
(a) A volunteer labor compliance officer may 10
(1) access the job site of a construction project and conduct a labor 11
compliance investigation on behalf of the department; 12
(2) report a violation of a state labor law to the department. 13
(b) A volunteer labor compliance officer shall 14
(1) wear the visible badge prescribed by the department while 15
conducting a labor compliance investigation on behalf of the department; 16
(2) obtain, at the officer's own expense, and wear all safety equipment 17
required by the department; 18
(3) not later than 48 hours af ter conducting a labor complianc e 19
investigation, transmit a labor c ompliance report to the depart ment through electronic 20
mail; 21
(4) document, to the department 's satisfaction, that the offic er is 22
covered by workers' compensation insurance; 23
(5) maintain confidentiality with respect to privileged or con fidential 24
information revealed during a labor compliance investigation. 25
(c) A volunteer labor compliance officer may not 26
(1) be an employee of the state; 27
(2) issue citations or enforce state labor laws; 28
(3) while conducting an investigation, 29
(A) wear attire of an organiza tion, contractor, or entity othe r 30
than the department; 31

(B) distribute literature produced by an organization, 1
contractor, or entity other than the department; 2
(C) disparage a contractor that employs a person; 3
(D) promote or organize for a union, labor organization, 4
contractor, or other entity; or 5
(E) display union or other organization signs or stickers; 6
(4) perform work for the office r's employer outside the duties o f a 7
volunteer labor compliance officer while performing the duties of a volunteer labor 8
compliance officer. 9
Sec. 23.05.420. Volunteer labor compliance officer qualificatio ns and 10
roster. (a) An individual may apply to t he department to be placed on t he roster of 11
volunteer labor compliance office rs. The department shall add a n individual to the 12
roster if the individual 13
(1) has at least five years of verifiable construction experience; 14
(2) provides documentation of c ompletion of a construction saf ety 15
class that is at least 10 hours and is approved by the Occupati onal Safety and Health 16
Administration of the United States Department of Labor; 17
(3) completes the volunteer la bor compliance officer orientati on 18
provided by the department; 19
(4) provides proof of workers' compensation insurance coverage f o r 20
the individual's activities as a volunteer labor compliance off icer under the policy of 21
the individual's employer. 22
(b) The department may remove from the roster of qualified vol unteer labor 23
compliance officers and permanently revoke the badge of a volun teer labor 24
compliance officer who, while conducting a labor compliance inv estigation on behalf 25
of the department, 26
(1) exhibits a conflict of interest; 27
(2) participates in labor union or organizing business; or 28
(3) otherwise fails to comply with the requirements of AS 23.0 5.400 - 29
23.05.420. 30
* Sec. 2. This Act takes effect immediately under AS 01.10.070(c). 31
