FOR AN ACT ENTITLED
"An Act relating to education; relating to education reports; relating to the duties of the 1
Department of Education and Early Development; relating to teac her exit interviews 2
conducted by school districts; relating to the teachers' retire ment system; relating to the 3
public employee retirement system; and providing for an effective date." 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 5
* Section 1. AS 14.03.078(a) is amended to read: 6
(a) The department shall provide to the legislature and school districts by 7
February 15 of each year by electronic means an annual report r egarding the progress 8
of each school and school district toward high academic perform ance by all students. 9
The report required under this section must include 10
(1) information described under AS 14.03.120; 11
(2) progress of the department 12
(A) toward implementing the school accountability provisions 13
of AS 14.03.123; and 14

(B) in assisting high schools to become accredited; 1
(3) a description of the resour ces provided to each school and school 2
district for coordinated school improvement activities and staff training in each school 3
and school district; 4
(4) each school district's and each school's progress in align ing 5
curriculum with state education performance standards; 6
( 5 ) a d e s c r i p t i o n o f t h e e f f o r t s b y t h e d e p a r t m e n t t o a s s i s t a public 7
school or district that receives a low performance designation under AS 14.03.123; 8
(6) a description of intervention efforts by each school distr ict and 9
school for students who are not meeting state performance standards; 10
(7) the number and percentage of turnover in certificated personnel and 11
superintendents, information regarding working conditions for teachers and 12
paraprofessionals, the availab ility of local housing, aggregate d information 13
compiled through teacher exit interviews conducted under AS 14. 20.183, and 14
data-based recommendations to shape teacher retention strategies; 15
(8) a summary of the categories of certificated administrative 16
employees employed by each school district that includes the ratio of 17
(A) the number of certificated administrative employees in 18
each category employed by each s chool district compared to the number of 19
students enrolled in the school district on October 1 of the previous year; 20
(B) the total number of certificated administrative employees 21
employed by each school district compared to the total number o f teachers 22
employed by the school district on October 1 of the previous year; and 23
(C) the total number of teach ers employed by each school 24
district compared to the total number of students enrolled in t he school district 25
on October 1 of the previous year; 26
(9) the progress made to imple ment the reading intervention pr ograms 27
established under AS 14.30.760 - 14.30.780, including data on how school districts are 28
using in-service days for culturally responsive professional de velopment in reading 29
instruction; and 30
(10) the effectiveness and partic ipation rates of the parents as teachers 31

program established under AS 14.03.420, including measures of e fficiency and 1
effectiveness that demonstrate the effects of the program on school readiness. 2
* Sec. 2. AS 14.03.120(a) is amended to read: 3
(a) A district shall annually file with the department, and make available to the 4

* Sec. 3. AS 14.07.020(a) is amended to read: 13
(a) The department shall 14
(1) exercise general supervis ion over the public schools of th e state 15
except the University of Alaska; 16
(2) study the conditions and needs of the public schools of th e state, 17
adopt or recommend plans, adminis ter and evaluate grants to imp rove school 18
performance awarded under AS 14.03.125, and adopt regulations for the improvement 19
of the public schools; the depar tment may consult with the Univ e r s i t y o f A l a s k a t o 20
develop secondary education requi rements to improve student ach ievement in college 21
preparatory courses; 22
(3) provide advisory and consu ltative services to all public s chool 23
governing bodies and personnel; 24
(4) prescribe by regulation a minimum course of study for the public 25
schools; the regulations must pr ovide that, if a course in Amer ican Sign Language is 26
given, the course shall be given credit as a course in a foreign language; 27
(5) establish, in coordination w ith the Department of Family a nd 28
Community Services, a program for the continuing education of children who are held 29
in juvenile detention facilities or juvenile treatment faciliti es, as those terms are 30
defined in AS 47.12.990, in the state during the period of detention or treatment; 31

(6) accredit those public sc hools that meet accreditation stan dards 1
prescribed by regulation by the department; these regulations s hall be adopted by the 2
department and presented to the legislature during the first 10 days of any regular 3
session, and become effective 45 days after presentation or at the end of the session, 4
whichever is earlier, unless di sapproved by a resolution concur red in by a majority of 5
the members of each house; 6
(7) prescribe by regulation, af ter consultation with the state f i r e 7
marshal and the state sanitarian, standards that will ensure he althful and safe 8
conditions in the public and priv ate schools of the state, incl uding a requirement of 9
physical examinations and immunizations in pre-elementary schoo ls; the standards for 10
private schools may not be more stringent than those for public schools; 11
(8) exercise general supervision over early education programs t h a t 12
receive direct state or federal funding, including early education programs provided by 13
a school district for students four and five years of age, appr ove an early education 14
program provided by a school distr ict that complies with the st andards adopted by the 15
board under AS 14.07.165(a)(5), and revoke approval of an early education program if 16
the program does not comply with the standards adopted by the b oard under 17
AS 14.07.165(a)(5); 18
(9) exercise general supervision over elementary and secondary 19
correspondence study programs offered by municipal school distr icts or regional 20
educational attendance areas; the department may also offer and make available to any 21
Alaskan through a centralized office a correspondence study program; 22
(10) accredit private schools th at request accreditation and t hat meet 23
accreditation standards prescribed by regulation by the departm ent; nothing in this 24
paragraph authorizes the department to require religious or oth er private schools to be 25
licensed; 26
(11) review plans for construc tion of new public elementary an d 27
secondary schools and for additi ons to and major rehabilitation of existing public 28
elementary and secondary schools and, in accordance with regula tions adopted by the 29
department, determine and approve the extent of eligibility for state aid of a school 30
construction or major maintenance project; for the purposes of this paragraph, "plans" 31

include educational specifications , schematic designs, projecte d energy consumption 1
and costs, and final contract documents; 2
(12) provide educational opport unities in the areas of vocatio nal 3
education and training, and basi c education to individuals over 16 years of age who 4
are no longer attending school; th e department may consult with businesses and labor 5
unions to develop a program to prepare students for apprenticeships or internships that 6
will lead to employment opportunities; 7
(13) administer the grants awarded under AS 14.11; 8
(14) establish, in coordination w ith the Department of Public Safety, a 9
school bus driver training course; 10
(15) require the reporting of information relating to school disciplinary 11
and safety programs under AS 14.33.120 and of incidents of disr uptive or violent 12
behavior; 13
(16) establish by regulation criteria, based on low student performance, 14
under which the department may intervene in a school district to improve instructional 15
practices, as described in AS 14.07.030(a)(14) or (15); the regulations must include 16
(A) a notice provision that alert s the district to the deficie ncies 17
and the instructional practice changes proposed by the department; 18
(B) an end date for departmental intervention, as described in 19
AS 14.07.030(a)(14)(A) and (B) and ( 15), after the district dem onstrates three 20
consecutive years of improvement consisting of not less than tw o percent 21
increases in student proficiency on standards-based assessments in language 22
arts and mathematics, as provided in AS 14.03.123(f)(1)(A); and 23
(C) a process for districts to petition the department for 24
continuing or discontinuing the department's intervention; 25
(17) notify the legislative committees having jurisdiction ove r 26
education before intervening in a school district under AS 14.0 7.030(a)(14) or 27
redirecting public school funding under AS 14.07.030(a)(15); 28
(18) establish a reading program to provide direct support for and 29
intervention in the reading intervention programs of participating schools as described 30
in AS 14.30.765 and 14.30.770; 31

(19) annually convene, either in person or electronically, a p anel to 1
review and comment on the effectiv eness of the programs created by the department 2
and the regulations adopted by the board to implement AS 14.03. 410, 14.03.420, 3
AS 14.30.760 - 14.30.770, and 14.30.800; the panel 4
(A) shall provide recommendati ons and guidance to the board, 5
the department, and the legislature on how to integrate early e ducation and 6
reading programs created under this title with tribal compactin g or programs 7
focused on cultural education within the department; 8
(B) shall discuss support for reading in Alaska Native 9
languages and other non-English languages; 10
(C) must collectively represent the regions of the state and 11
include teachers of grades kindergarten through three, school a dministrators, 12
parents of students in grades ki ndergarten through three, stake holders from 13
Indigenous language immersion programs, representatives from ea rly 14
education stakeholder groups, a nd researchers of best practices for improving 15
literacy performance, including best practices for instruction of Indigenous 16
students and students whose first language is not English; 17
(20) provide financial planning and retirement training to teachers 18
and paraprofessionals; 19
(21) support mentoring programs for school principals and district 20
superintendents. 21

(b) A person is not eligible for a teacher certificate unless that person has 8
received at least a baccalaur eate degree from an institution of higher education 9
accredited by a recognized regional or international accrediting association or 10
approved by the commissioner and, if applicable, has passed the examination or 11
examinations required by (i) of this section. However, this subsection is not applicable 12
to 13
(1) persons employed in the s tate public school system on 14
September 1, 1962; 15
(2) persons issued an emergency certificate during a situation that, in 16
the judgment of the commissioner, requires the temporary issuance of a certificate to a 17
person not otherwise qualified. 18
* Sec. 6. AS 14.20 is amended by adding a new section to read: 19
Sec. 14.20.183. Exit interviews. A school district sh all contract with an 20
independent third party to conduc t an exit interview with a tea cher when the teacher 21
terminates employment with the school district. 22
* Sec. 7. AS 14.25.009 is amended to read: 23
Sec. 14.25.009. Applicability of AS 14.25.009 - 14.25.220. The provisions of 24
AS 14.25.009 - 14.25.220 apply only to members first hired befo re July 1, 2006 , and 25
teachers who are also members of the public employees' defined benefit 26
retirement plan under AS 39.35.095 - 39.35.680 who do not elect under 27
AS 14.25.540 to participate in the defined contribution retirem ent plan under 28
AS 14.25.310 - 14.25.590. 29

in the defined benefit retirement plan established under AS 14. 25.009 - 14.25.220, to 3
teachers who are also members of the defined benefit retirement plan under 4
AS 39.35.095 - 39.35.680 and elect to participate in this plan [ T O F O R M E R 5

(ix) contractual employees of the legislative branch of 28
state government under AS 24.10.060(f); 29

(i) the State of Alaska formally agrees to their inclusion 1
through the process of collective bargaining; and 2
(ii) no collective bargaining agreement has the effect of 3
obligating contributions made by the state under AS 39.30.150 i n the 4
event the state resumes participation in the federal social sec urity 5
system; 6
* Sec. 13. The uncodified law of the State of Alaska is amended by adding a new section to 7
read: 8
LUMP SUM PAYMENT FOR CERTAIN TEACHERS AND 9
PARAPROFESSIONALS. (a) Subject to appropria tion for the fiscal years ending June 30, 10
2026, June 30, 2027, and June 30, 2028, a certificated full-tim e teacher occupying a position 11
requiring teaching on a regular basis during the normal work pe riod for each day or week at a 12
classroom teaching assignment i n a public elementary or seconda ry school, excluding a 13
person teaching as an assistant or graduate assistant or teachi ng on a substitute, temporary, or 14
per diem basis, or a full-time paraprofessional working in a public school is entitled to receive 15
a lump sum payment as a retention and recruitment incentive on or within a reasonable period 16
after July 1, 2026, July 1, 2027, and July 1, 2028, if the teac her was employed in a full-time 17
classroom teaching position or the paraprofessional was employe d in a full-time 18
paraprofessional position for the entirety of the school term f or the school year immediately 19
preceding the date of payment. The Department of Education and Early Development shall 20
reduce the retention and recruitment incentive by the amount ne cessary to pay mandatory 21
employee and employer deductions, including a deduction required under AS 14.25. 22
(b) Subject to the application and certification requirements in (c) of this section, the 23
Department of Education and Earl y Development shall pay the ret ention and recruitment 24
incentive identified in (a) of this section as grants to school districts as follows: 25
(1) $5,000 for each eligible certificated full-time teacher te aching or full-time 26
paraprofessional working in the following districts: 27
(A) Anchorage School District; 28
(B) Fairbanks North Star Borough School District; 29
(C) Juneau Borough School District; 30
(D) Kenai Peninsula Borough School District; 31

(E) Matanuska-Susitna Borough School District; 1
(2) $10,000 for each eligible certificated full-time teacher teaching or full-time 2
paraprofessional working in the following districts: 3
(A) Alaska Gateway School District; 4
(B) Aleutian Region School District; 5
(C) Aleutians East Borough School District; 6
(D) Annette Island School District; 7
(E) Chugach School District; 8
(F) Copper River School District; 9
(G) Cordova City School District; 10
(H) Delta/Greely School District; 11

(c) To be eligible for the retention and recruitment incentive identified in (a) of this 24
section, a certificated full-time teacher or a full-time parapr ofessional must apply during each 25
eligible calendar year to the De partment of Education and Early Development on a date not 26
later than the final day the teacher's school is in session for the school term established by the 27
governing body of that teacher's school district or regional ed ucational attendance area. The 28
teacher or paraprofessional sha ll apply for the payment under t his section on a form 29
designated by the commissioner of education and early developme nt. For each teacher or 30
paraprofessional who applies, the school district or regional e ducational attendance area shall 31

certify the teacher's or paraprofessional's eligibility for payment under (a) of this section to the 1
Department of Education and Early Development. 2
(d) A payment made under this section is considered compensati on for the purposes 3
of AS 14.25. 4
(e) The Department of Education and Early Development may adop t regulations 5
necessary to carry out the purposes of this section. 6
* Sec. 14. The uncodified law of the State of Alaska is amended by adding a new section to 7
read: 8
TRANSITION: RETIREMENT PLAN ELECTION. A teacher who became a member 9
of the defined contribution retirement plan under AS 14.25.310 - 14.25.590 after June 30, 10
2006, and before the effective da te of secs. 7 - 9, 11, and 12 of this Act, and who, on the 11
effective date of secs. 7 - 9, 11, and 12 of this Act, is a mem ber employed by an employer in 12
that defined contribution retirement plan and is also a member o f t h e d e f i n e d b e n e f i t 13
retirement plan under AS 39.35.095 - 39.35.680 may, within 180 days after the effective date 14
of secs. 7 - 9, 11, and 12 of this Act, make a one-time electio n to participate in the defined 15
benefit retirement plan under AS 14.25.009 - 14.25.220 and to t ransfer all contributions that 16
have been made or should be made to the defined contribution re tirement plan for service the 17
member completes before the effective date of the member's part icipation in the defined 18
benefit retirement plan. The tr ansferred contributions shall be used to purchase credited 19
service in the defined benefit retirement plan under AS 14.25.0 09 - 14.25.220 on an actuarial 20
equivalent basis determined by the Alaska Retirement Management Board established under 21
AS 37.10.210. The provisions of AS 14.25.044 apply to an election made under this section. 22
* Sec. 15. Section 4 of this Act takes effect on the effective date of sec . 16, ch. 40, SLA 23
2022. 24
* Sec. 16. Section 13 of this Act takes effect July 1, 2025. 25
* Sec. 17. Sections 7 - 12 and 14 of this Act take effect immediately under AS 01.10.070(c). 26
