"An Act relating to the sale of a lcohol; and relating to the po sting of warning signs for 1
alcoholic beverages." 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 3
* Section 1. AS 04.09.210(c) is amended to read: 4
(c) The board may issue or renew a license under this section only if the 5
(1) board determines that 6
(A) the licensed premises is a bona fide restaurant as defined in 7
AS 04.21.080(b); 8
(B) there is supervision on th e premises adequate to reasonably 9
ensure that a person under 21 years of age will not obtain alco holic beverages, 10
unless the person is employed as permitted in AS 04.16.049(d); and 11
(C) it is unlikely that persons under 21 years of age not 12
employed on the premises will enter and remain on the licensed premises for 13
purposes other than dining; and 14

(2) sale and service of food and alcoholic beverages and any o ther 1
business conducted on the licensed premises of the restaurant o r eating place is under 2
the sole control of the licensee. 3
* Sec. 2. AS 04.09.210(d) is amended to read: 4
(d) The board may authorize the holder of a restaurant or eating place license 5
(1) to allow a person who is at least 16 years of age but unde r 21 years 6
of age to enter and remain on the licensed premises for dining only; 7
(2) to allow a person who is under 16 years of age to enter an d remain 8
on the licensed premises for dining only if 9
(A) the person is accompanied by a person who is 21 years of 10
age or older; and 11
(B) the parent or guardian of the person consents to the perso n 12
being on the licensed premises; and 13
(3) subject to AS 04.16.049, to employ or permit the employmen t of a 14
person who is at least 16 years of age but under 21 years of ag e on the licensed 15
premises if the employer provide s adequate supervision to ensur e that an employee 16
who is 16 or 17 years of age [THE PERSON] does not obtain alcoholic beverages. 17
* Sec. 3. AS 04.09.250(c) is amended to read: 18
(c) The holder of a theater li cense may sell or serve alcoholi c beverages only 19
in designated areas on the licensed premises and only for a period beginning two 20
hours [ONE HOUR] before the event until one hour after the event [AND DURING 21
INTERMISSIONS]. 22
* Sec. 4. AS 04.09.360(c) is amended to read: 23
(c) The board may issue or renew a license under this section only if 24
(1) the board determines that 25
(A) the licensed premises is a bona fide restaurant as defined in 26
AS 04.21.080(b); 27
(B) there is supervision on th e premises adequate to reasonably 28
ensure that a person under 21 years of age will not obtain alco holic beverages, 29
except as provided under AS 04.16.049(d); and 30
(C) it is unlikely that persons under 21 years of age not 31

employed on the premises will enter and remain on the licensed premises for 1
purposes other than dining; and 2
(2) the sale and service of f ood and alcoholic beverages and a ny other 3
business conducted on the licensed premises of the restaurant o r eating place is under 4
the sole control of the licensee. 5

(f) The board may authorize the holder of a seasonal restauran t or eating place 7
tourism license 8
(1) to allow a person who is at least 16 years of age but unde r 21 years 9
of age to enter and remain on the licensed premises for dining only; 10
(2) to allow a person who is under 16 years of age to enter an d remain 11
on the licensed premises for dining only if 12
(A) the person is accompanied by a person who is 21 years of 13
age or older; and 14
(B) the parent or guardian of the person consents to the perso n 15
being on the licensed premises; and 16
(3) subject to AS 04.16.049, to employ or permit the employmen t of a 17
person who is at least 16 years of age but under 21 years of ag e on the licensed 18
premises if the employer provide s adequate supervision to ensur e that an employee 19
who is 16 or 17 years of age [THE PERSON] does not obtain alcoholic beverages. 20
* Sec. 6. AS 04.09.450(d) is amended to read: 21
(d) The board may issue an endorsement under this section only if the board 22
finds 23
(1) that the establishment or portion of the establishment for which the 24
endorsement is requested is a bona fide restaurant; 25
(2) there is supervision on th e premises adequate to reasonabl y ensure 26
that a person under 21 years of age will not obtain alcoholic b everages, except as 27
provided under AS 04.16.049(d); and 28
(3) that it is unlikely that persons under 21 years of age not employed 29
on the premises will enter and remain on the premises of the bo na fide restaurant for 30
purposes other than dining. 31

* Sec. 7. AS 04.09.450(e) is amended to read: 1
(e) The board may authorize the holder of a license with a res taurant 2
endorsement 3
(1) to allow a person who is at least 16 years of age but unde r 21 years 4
of age to enter and remain on the licensed premises for dining only; 5
(2) to allow a person who is under 16 years of age to enter an d remain 6
on the licensed premises for dining only if 7
(A) the person is accompanied by a person who is 21 years of 8
age or older; and 9
(B) the parent or guardian of the person consents to the perso n 10
being on the licensed premises; and 11
(3) subject to AS 04.16.049, to employ or permit the employmen t of a 12
person who is at least 16 years of age but under 21 years of ag e on the premises of the 13
bona fide restaurant if the employer provides adequate supervis ion to ensure that an 14
employee who is 16 or 17 years of age [THE PERSON] does not obtain alcoholic 15
beverages. 16
* Sec. 8. AS 04.16.049(d) is amended to read: 17
(d) Notwithstanding any other provision in this section and AS 04.16.050(a), 18
a person 18, 19, or 20 years of age may be employed within the licensed premises of a 19
brewery manufacturer, winery ma nufacturer, distillery manufactu rer, hotel or 20
motel, large resort, golf course, general wholesaler, limited b rewed beverage and wine 21
wholesaler, common carrier dispe nsary, outdoor recreation lodge , brewery retailer, 22
winery retailer, distillery retailer, or restaurant, may enter and remain within those 23
premises for the purpose of employment, and, other than for a business that offers 24
adult entertainment, [BUT] may [NOT], in the course of employment, sell, serve, 25
deliver, or dispense alcoholic beverages. 26
* Sec. 9. AS 04.16.049(h) is amended to read: 27
(h) Notwithstanding any other p rovision in this section, a per son under 21 28
years of age may be present 29
(1) on the licensed premises of a 30
(A) common carrier dispensary, destination resort, or outdoor 31

recreation lodge for the purpose of travel, travel lodging, or outdoor recreation 1
activities provided by the licensee if the person is 2
(i) [(1)] at least 16 years of age; or 3
(ii) [(2)] under 16 years of age and a parent or legal 4
guardian of the underaged person consents; 5
(B) theater if the person is 6
(i) at least 16 years of age; or 7
(ii) under 16 years of age , is accompanied by a 8
person who is at least 21 years of age, and a parent or legal 9
guardian of the underaged person consents; 10
(2) in the areas of a licensed premises covered by a large res ort 11
endorsement, but excluding the areas of the premises originally covered by the 12
licensee's beverage dispensary or beverage dispensary tourism l icense where 13
alcohol is being served, for the purpose of travel, travel lodg ing, or outdoor 14
recreation activities provided by the large resort if the person is 15
(A) at least 16 years of age; or 16
(B) under 16 years of age and a parent or legal guardian of 17
the underaged person consents. 18
* Sec. 10. AS 04.16.049 is amended by adding a new subsection to read: 19
(k) In this section, "business that offers adult entertainment " has the meaning 20
given in AS 23.10.350(f). 21
* Sec. 11. AS 04.16.052(a) is amended to read: 22
(a) A licensee or an agent or employee of the licensee may not with criminal 23
negligence 24
(1) allow another person to se ll, barter, or give an alcoholic beverage 25
to a person under the age of 21 years within licensed premises , except as provided in 26
AS 04.16.049(d); 27
(2) allow a person under the age of 21 years to enter and rema in within 28
licensed premises except as provided in AS 04.16.049; 29
(3) allow a person under the age of 21 years to consume an alc oholic 30
beverage within licensed premises; 31

(4) allow a person under the age of 21 years to sell or serve alcoholic 1
beverages, except as provided in AS 04.16.049(d); 2
(5) while working on licensed pr emises, furnish or deliver alc oholic 3
beverages to a person under the age of 21 years , except as provided in 4
AS 04.16.049(d). 5
* Sec. 12. AS 04.21.065(b) is amended to read: 6
(b) The warning signs required by (a) of this section must be at least 11 inches 7
by 14 inches, and the lettering must be at least one-half inch high and in contrasting 8
colors. The first sign must read, "WARNING: Alcohol use [DRINKING 9
ALCOHOLIC BEVERAGES SUCH AS BEER, WINE, WINE COOLERS, AND 10
DISTILLED SPIRITS OR SMOKING CIGARETTES] during pregnancy can c ause 11
birth defects. Alcohol use can cause cancer, including breast and colon cancer s." 12
The second sign must read, "WARNING: A person who provides alco holic beverages 13
to a person under 21 years of age, if convicted under AS 04.16. 051, could be 14
imprisoned for up to five years and fined up to $50,000." The t hird sign must read, 15
"WARNING: An unaccompanied person under 21 years of age who ent ers these 16
premises in violation of law may, under AS 04.16.049(e), be civilly liable for damages 17
of $1,500." The license or permit holder shall display the firs t and second signs in a 18
manner that would make them cons picuous to a person who will be purchasing or 19
consuming alcoholic beverages or smoking cigarettes on the lice nsed or designated 20
premises and shall conspicuously display the third sign at each door through which 21
customers enter the licensed premises. 22
