FOR AN ACT ENTITLED
"An Act relating to health and personal safety education." 1
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 2
* Section 1. AS 14.03.120(d) is amended to read: 3
(d) Annually, before the date set by the district under (e) of this section, each 4
public school shall deliver to th e department for posting on th e department's Internet 5
website and provide, in a public m eeting of parents, students, and community 6
members, a report on the school's performance and the performan ce of the school's 7
students. The report shall be pre pared on a form prescribed by the department and 8
must include 9
(1) information on accreditation; 10
(2) results of norm-referenced achievement tests; 11
(3) results of state standards- based assessments in language a rts and 12
mathematics; 13
(4) a description, including quantitative and qualitative meas ures, of 14
student, parent, community, and business involvement in student learning; 15

(5) a description of the school 's attendance, retention, dropo ut, and 1
graduation rates as specified by the state board; 2
(6) the annual percent of enro llment change, regardless of rea son, and 3
the annual percent of enrollment change due to student transfer s into and out of the 4
school district; 5
(7) if Native language education is provided, a summary and 6
evaluation of the curriculum described in AS 14.30.420; 7
(8) the performance designation assigned the school under 8
AS 14.03.123 and the methodology used to assign the performance designation, 9
including the measures used and their relative weights; 10
(9) other information concerni ng school performance and the 11
performance of the school's stude nts as required by the state b oard in regulation; 12
[AND] 13
(10) information on the number, attendance, and performance of 14
students enrolled in the school whose parents or guardians are on active duty in the 15
armed forces of the United States, the United States Coast Guar d, the Alaska National 16
Guard, the Alaska Naval Militia, or the Alaska State Defense Force; and 17
(11) a summary and evaluation of the curriculum used by the 18
school for the health and person al safety education program req uired under 19
AS 14.30.360(a), including 20
(A) the number of students in the school participating in 21
the program; 22
(B) the frequency with which the school teaches the 23
program; and 24
(C) the grades in which the program is taught. 25
* Sec. 2. AS 14.16.050(a) is amended to read: 26
(a) The following provisions apply with respect to the operati on and 27
management of a state boarding school as if it were a school district: 28
(1) requirements relating to school district operations: 29
(A) AS 14.03.030 - 14.03.050 (defining the school term, day in 30
session, and school holidays); 31

(B) AS 14.03.083 - 14.03.140 (miscellaneous provisions 1
applicable to school district operations); 2
(C) regulations adopted by the board under authority of 3
AS 14.07.020(a) that are applicable to school districts and the ir schools, unless 4
the board specifically exempts state boarding schools from comp liance with a 5
regulation; 6
(D) AS 14.12.150 (authorizing school districts to establish an d 7
participate in the services of a regional resource center); 8
(E) AS 14.14.050 (imposing the requirement of an annual 9
audit); 10
(F) AS 14.14.110 (authorizing cooperation with other school 11
districts); 12
(G) AS 14.14.140(b) (establishing a prohibition on 13
employment of a relative of the chief school administrator); 14
(H) AS 14.18 (prohibiting disc rimination based on sex in 15
public education); 16
(2) requirements relating to t he public school funding program and the 17
receipt and expenditure of that funding: 18
(A) AS 14.17.500 (relating to student count estimates); 19
(B) AS 14.17.505 (relating to school operating fund balances); 20
(C) AS 14.17.500 - 14.17.910 (setting out the procedure for 21
payment of public school funding and imposing general requireme nts and 22
limits on money paid); 23
(3) requirements relating to teacher employment and retirement: 24
(A) AS 14.14.105 and 14.14.107 (relating to sick leave); 25
(B) AS 14.20.095 - 14.20.215 (relating to the employment and 26
tenure of teachers); 27
(C) AS 14.20.280 - 14.20.350 (relating to sabbatical leave 28
provisions for teachers); 29
(D) AS 23.40.070 - 23.40.260 (authorizing collective 30
bargaining by certificated employees), except with regard to te achers who are 31

administrators and except that the board may delegate some or a ll of its 1
responsibilities under those statutes; 2
(E) AS 14.25 (provisions regardi ng the teachers' retirement 3
system); 4
(4) requirements relating to students and educational programs: 5
(A) AS 14.30.180 - 14.30.350 (relating to educational services 6
for children with disabilities); 7
(B) AS 14.30.360 - 14.30.370 (establishing health and 8
personal safety education program standards); 9
(C) AS 14.30.400 - 14.30.410 (relating to bilingual and 10
bicultural education). 11
* Sec. 3. AS 14.30.360(a) is amended to read: 12
(a) Each district in the sta te public school system shall provide [ B E 13
ENCOURAGED TO INITIATE AND CONDUCT] a program in health and personal 14
safety education for kindergarten through grade 12. The program must [SHOULD] 15
include instruction in physical health and personal safety , including alcohol and drug 16
abuse education, cardiopulmonary resuscitation (CPR), early can cer prevention and 17
detection, dental health, family health including infant care, environmental health, the 18
identification and prevention of child abuse, child abduction, neglect, sexual abuse, 19
and domestic violence, [AND] appropriate use of health services, and sexual health. 20
* Sec. 4. AS 14.30.360(b) is amended to read: 21
(b) The state board shall establish guidelines for the [A] health and personal 22
safety education program. Pers onal safety guidelines shall be d eveloped in 23
consultation with the Council on Do mestic Violence and Sexual A ssault. Upon 24
request, the Department of Educa tion and Early Development, the Department of 25
Health, and the Council on Domes tic Violence and Sexual Assault shall provide 26
technical assistance to school districts in the development of personal safety curricula. 27
A school health education specialist position shall be establis hed and funded in the 28
department to coordinate the program statewide. Adequate funds to enable curriculum 29
and resource development, adequate consultation to school distr icts, and a program of 30
teacher training in health and personal safety education shall be provided. 31

* Sec. 5. AS 14.30.360(c) is amended to read: 1
(c) In addition to the health and personal safety education program 2
[ENCOURAGED UNDER (a) OF THIS SEC TION], a school district shall establish 3
guidelines for schools in the d istrict to provi de opportunities during each full school 4
day for students in grades kindergarten through eight for a min imum of 90 percent of 5
the daily amount of physical activity recommended for children and adolescents in the 6
physical activity guidelines by the Centers for Disease Control and Prevention, United 7
States Department of Health and Human Services. The time provid e d f o r p h y s i c a l 8
activity under this subsection may include physical education c lasses and 9
opportunities for unstructured physical activity, such as reces s. A school district shall 10
adopt guidelines under this subsection that 11
(1) allow a student to be excused from the physical activity 12
opportunities if the student is unable to participate for a medical reason; and 13
(2) provide an exemption from the physical activity opportunit ies 14
under this subsection for health and safety reasons, such as inclement weather. 15
* Sec. 6. AS 14.30.360 is amended by adding a new subsection to read: 16
(e) The health and personal safety education program must incl ude 17
comprehensive sexual health education based on a curriculum that 18
(1) instructs students on human development, sexuality, and 19
reproduction, including instruction on abstinence, anatomy and physiology, consent, 20
contraception, healthy relationships, and the prevention of pre gnancy and sexually 21
transmitted diseases; 22
(2) is appropriate to a student's age and development; 23
(3) teaches medically and scientifically accurate information that is 24
verified or supported by the weig ht of research in compliance w ith accepted scientific 25
methods, that is published in p eer-reviewed journals, as approp riate, and that is 26
recognized as accurate and objective by professional organizati ons and agencies with 27
expertise in the field of sexual health; 28
(4) is consistent with the Future of Sex Education Initiative 2020 29
National Sex Education Standards: Core Content and Skills, K-12; 30
(5) teaches students abstinence as the most effective means of avoiding 31

sexually transmitted diseases and unintended pregnancy, but tha t also includes 1
materials and instruction on other forms of contraceptives and disease prevention; 2
(6) is inclusive of all students, regardless of gender, gender identity, 3
race, disability status, religion, or sexual orientation; and 4
(7) emphasizes that voluntary c onsent is required before sexua l 5
activity; in this paragraph, "voluntary consent" means consciou s and freely given 6
affirmative agreement to engage in sexual activity. 7
* Sec. 7. AS 14.30.370 is amended to read: 8
Sec. 14.30.370. Evaluation. Health and personal safety education programs 9
conducted under AS 14.30.360 shall be evaluated by the departme nt in the same 10
manner as other curriculum programs are evaluated, except that the evaluation shall 11
also include changes in the hea lth status of the pupils as dete rmined by physical and 12
dental examinations conducted under AS 14.30.070. 13
