Purpose

Requires the Arizona Department of Education (ADE) to review statutory
reporting requirements on public schools and ADE to identify requirements that
are duplicative, expired or otherwise obsolete. Requires ADE, by December 1,
2026, to submit a report as outlined that includes a summary of the review and
recommendations for legislative action to repeal or modify duplicative, expired
or obsolete requirements. Repeals the outlined requirements on ADE on July 1,
2029.

Background

The State Board of Education (SBE) exercises general supervision over and
regulates the conduct of the public school system. Statute outlines the SBE's
powers and duties, including requirements to: 1) supervise and control the
certification of persons engaged in instructional work; 2) prepare, publish and
distribute reports concerning the educational welfare of Arizona;

3) recommend to the Legislature changes or additions to the statutes pertaining
to schools; and

4) aid in the enforcement of laws relating to schools (
A.R.S.
� 15-203
).

ADE is administered through: 1) the SBE, which is the policy-determining
body of ADE; and 2) the Superintendent of Public Instruction, in whom all
executive, administrative and ministerial functions of ADE are vested and who
is the executive officer responsible for the execution of policies of the SBE (
A.R.S.
� 15-231
).

There is no anticipated fiscal impact to the state General Fund
associated with this legislation.

Provisions

1.

Requires
ADE to review each statutory requirement that requires public schools to report
information to ADE and identify whether:

a)

the reporting requirement has expired or is otherwise obsolete; and

b)

public schools must submit the same information for two or more
reporting requirements.

2.

Requires
ADE to review each statutory requirement that requires ADE to report to the
Legislature and identify whether:

a)

the reporting requirement has expired or is otherwise obsolete; and

b)

ADE must submit the same information for two or more reporting
requirements.

3.

Requires
ADE, by December 1, 2026, to submit to the Speaker of the House of
Representatives and the Senate President a report that:

a)

summarizes the outlined reviews of public school and ADE statutory
reporting requirements; and

b)

recommends legislative action to consolidate, eliminate or otherwise
modify public school and ADE reporting requirements.

4.

Directs ADE to recommend the repeal or consolidation of any statutory
reporting requirements that are duplicative, expired or otherwise obsolete.

5.

Determines
that a
report to the legislature
includes any report that must be
submitted to:

a)

the Legislature;

b)

the Speaker of the House of Representatives;

c)

the Senate President;

d)

a joint committee;

e)

a committee of the House of Representatives; or

f)

a
committee of the Senate.

6.

Repeals the outlined requirements on ADE relating to a review of
statutory reporting requirements on July 1, 2029.

7.

Becomes effective on the general effective date.

Providing for a review of public school
reporting requirements.

Be it
enacted by the Legislature of the State of Arizona:

Section
1.
1.
Department
of education; review of reporting requirements; recommendations; delayed
repeal; definition

A. The department of
education shall review each requirement prescribed by the Arizona Revised
Statutes for public schools in this state to report information to the
department and identify whether:

1. The reporting
requirement has expired or is otherwise obsolete.

2. Public schools are
required to submit the same information for two or more reporting requirements.

B. The department of
education shall review each requirement prescribed by the Arizona Revised
Statutes for the department to
submit a report
to the legislature and identify whether:

1. The reporting
requirement has expired or is otherwise obsolete.

2. The department is
required to submit the same information for two or more reporting requirements.

C. On or before December 1,
2026, the department of education shall submit to the speaker of the house of
representatives and the president of the senate a report that both:

1. Summarizes the reviews
required pursuant to subsections A and B of this section.

2. Recommends legislative
action to consolidate, eliminate or otherwise modify the reporting requirements
described in subsections A and B of this section. For the purposes of this
paragraph, the department shall recommend the repeal or consolidation of any
reporting requirement that is duplicative, expired or otherwise obsolete.

D. This section is repealed
from and after June 30, 2029.

E. For the purposes of this
section, "report to the legislature" includes any report that must be
submitted to the legislature, to the speaker of the house of representatives,
to the president of the senate, to a joint committee, to a committee of the
house of representatives or to a committee of the senate.
