Plain English Breakdown

The bill summary does not provide details on the specific types of homeowners' associations affected, leaving this as an open question.

Homeowners' Associations; Records Requests

This bill amends existing laws to require homeowners' associations to make certain financial and other records available upon request from members, with specific conditions.

What This Bill Does

  • Requires homeowners' associations to provide financial and other important records to members if the requests are made in good faith and describe what information is needed clearly.
  • Limits the time an association has to respond to a record request to ten business days.
  • Allows associations to charge up to fifteen cents per page for making copies of requested records, whether physical or digital.
  • Specifies that certain types of records can be kept private, such as attorney-client communications and personal health information.

Who It Names or Affects

  • Homeowners' association members who want access to the association's financial and other important records.
  • Homeowners' associations that must comply with these new rules about record requests.

Terms To Know

Good faith
When a request for information is made honestly and without trying to cause trouble or harm the association.

Limits and Unknowns

  • The bill does not specify what happens if an association fails to comply with these new rules.
  • It is unclear how this will affect associations that already have their own policies for handling record requests.
