Overview

Repeals
the statute relating to a recommendation made by an administrative law judge
that restitution be provided by a licensed contractor.

History

As part of the Registrar of Contractor's (ROC) compliant
process, the ROC can assign an amount of restitution be paid to a person who
was financially harmed by a licensed contractor. The licensed contractor can
contest the amount awarded by requesting a hearing. Contested cases are sent to
the Office of Administrative Hearings (OAH), which is overseen by an administrative
law judge.

The administrative law judge must issue a written
decision within 20 days after the hearing is concluded. Within 30 days after
the date OAH sends a copy of the decision to the agency head, the agency head
may review the decision and accept, reject or modify it. The agency head's
decision is the final administrative decision with outlined exemptions.� The
