CARRY FORWARD. Notwithstanding any law pertaining to the transfer of year-end 5
fund balances or any law to the contrary, any funds which remain in the 6
Division of Elementary and Secondary Education Fund Account at the end of a 7
fiscal year shall remain in the Division of Elementary and Secondary 8
Education Fund Account and be made available to fund appropriation(s) 9
authorized by law and made payable from the Division of Elementary and 10

Any carry forward of unexpended balance of funding as authorized 12

report to the Arkansas Legislative Council or Joint Budget Committee all 18
amounts carried forward by the September Arkansas Legislative Council or 19
Joint Budget Committee meeting which report shall include the name of the 20
Agency, Board, Commission or Institution and the amount of the funding 21
carried forward, the program name or line item, the funding source of that 22
appropriation and a copy of the written request set forth in (1) above; 23
(3) Each Agency, Board, Commission or Institution shall provide a 24
written report to the Arkansas Legislative Council or Joint Budget Committee 25
containing all information set forth in item (2) above, along with a written 26
statement as to the current status of the project, contract, purpose etc. for 27
which the carry forward was originally requested no later than thirty (30) 28
days prior to the time the Agency, Board, Commission or Institution presents 29
its budget request to the Arkansas Legislative Council/Joint Budget 30
Committee; and 31
(4) Thereupon, the Department of Finance and Administration shall 32
include all information obtained in item (3) above in the budget manuals 33
and/or a statement of non-compliance by the Agency, Board, Commission or 34
Institution. 35
The provisions of this section shall be in effect only from July 1, 2025 36

SECTION 27. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 3
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL, AND TEMPORARY LAW. SCHOOL 4
SAFETY SET-ASIDE. 5
(a)(1) The Department of Education shall not begin the process of 6
promulgating rules for the distribution of funds in the School Safety Set-7
Aside or Contingency Vote 3/5 Set-Aside until authorized by Legislative 8
Council. 9
(2) The department shall not disburse any funds in the School Safety 10
Set-Aside or Contingency Vote 3/5 Set-Aside until the rules have been 11
approved by Legislative Council. 12
(b) Notwithstanding other provisions of law, the Chief Fiscal Officer of 13
the State may from time to time transfer on his or her books and those of the 14
Treasurer of State and the Auditor of State funds from the Restricted Reserve 15
Fund School Safety Set-Aside or Contingency Vote 3/5 Set-Aside after 16
receiving prior approval of the greater of three-fifths (3/5) of the quorum 17
present or a majority of the membership of the Legislative Council or, if the 18
General Assembly is in session, the Joint Budget Committee, for the 19
Department of Education to distribute funds for the School Safety Grant 20
program, as approved in this section as set out in subsection (a) herein, or 21
for the distribution of funds from this set-aside for unanticipated state 22
needs. 23
(c)(1) The General Assembly finds: 24
(A) Determining the maximum amount of appropriation and funding for a 25
state agency or institution each fiscal year is the prerogative of the 26
General Assembly; 27
(B) Determining the maximum amount of appropriation and funding for a 28
state agency or institution is usually accomplished by delineating the 29
maximum amounts in the appropriation acts for the state agency or institution 30
and in the general revenue allocations authorized for each relevant fund and 31
fund account by amendment to the Revenue Stabilization Law, § 19-20-101 et 32
seq.; and 33
(C) The Restricted Reserve Fund has established procedures for the 34
transfer of funds to various funds and fund accounts for the efficient and 35
effective operation of state government. 36

(2)(A) It is necessary and appropriate that the General Assembly 1
maintain oversight by requiring prior approval of the Legislative Council or, 2
if the General Assembly is in session, the Joint Budget Committee, as 3
provided in § 19-27-317(c). 4
(B) The requirement of approval by the Legislative Council or, if the 5
General Assembly is in session, the Joint Budget Committee, is not a 6
severable part of § 19-27-317. 7
(C) If the requirement of approval by the Legislative Council or, if 8
the General Assembly is in session, the Joint Budget Committee, is ruled 9
unconstitutional by a court of competent jurisdiction, § 19-27-317(c)-(e) are 10
void in their entirety. 11
(d) The provisions of this section shall be in effect only from July 1, 12
2025 2026 through June 30, 2026 2027. 13

SECTION 28. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 15
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 16
ESTABLISHMENT OF A "POSITION POOL". (a) To address needs emerging from 17
statewide education issues and the necessity of recruiting and retaining 18
qualified personnel, the Arkansas Department of Education or its successor 19
agency is authorized for the 2025-2026 2026-2027 fiscal year a pool of no 20
more than five (5) Information Systems and Technology positions at a salary 21
not to exceed the maximum salary for a grade IST12. These positions are to be 22
used by the Department of Education in the event that the personal services 23
needs of the Department during the 2025-2026 2026-2027 fiscal year require 24
additional positions, either by title or in number, that are not authorized 25
by the General Assembly in the Regular Salaries section of this Act. These 26
positions may also be used to properly classify positions when the Department 27
does not have a vacant position available with the appropriate title and 28
salary level. 29
(b) To address needs emerging from statewide education issues and the 30
necessity of recruiting and retaining qualified personnel, the Arkansas 31
Department of Education or its successor agency is authorized for the 2025-32
2026 2026-2027 fiscal year a pool of ten (10) State Government Services 33
positions at up to a grade SGS12. These positions are to be used by the 34
Department of Education in the event that the personal services needs of the 35
Department during the 2025-2026 2026-2027 fiscal year require additional 36

positions, either by classification or in number, that are not authorized by 1
the General Assembly in the Regular Salaries section of this Act. These 2
positions may also be used to properly classify positions when the Department 3
does not have a vacant position available with the appropriate title and 4
grade level. 5
(c) Any salary determinations or adjustments administered under the 6
provisions of Subsections (a) and (b) of this Section shall be made by 7
comparing the qualifications and salary levels of similar employees in school 8
districts or in other state education agencies. 9
(d) The Department of Education is authorized to access the pool 10
positions authorized in this Section at any time when it is determined by the 11
Secretary that the need exists. The Secretary shall provide a monthly report 12
of the justification for the need to allocate titles from this growth pool to 13
the Chief Fiscal Officer of the State and to the Arkansas Legislative Council 14
or Joint Budget Committee for review. The report shall also include an 15
accounting of the names, titles, and salaries of personnel whose salaries 16
have been adjusted under provisions of Subsections (a) and (b) of this 17
Section. 18
(e) If the Department of Education requests continuation of any 19
"Position Pool" position(s) as established herein during the next fiscal 20
year, the position(s) must be requested as a new position(s) in the agency’s 21
budget request. 22
(f) Determining the number of personnel to be employed by a state agency 23
is the prerogative of the General Assembly and is usually accomplished by 24
delineating the maximum number of personnel by identifying job titles and the 25
maximum grade or salary attached to those titles. The General Assembly has 26
determined that the Arkansas Department of Education could be operated more 27
efficiently if some flexibility is given to that agency. That flexibility is 28
being accomplished by providing a position pool in Subsections (a) and (b) of 29
this Section and since the General Assembly has granted the agency broad 30
powers under the growth pool concept, it is both necessary and appropriate 31
that the General Assembly maintain oversight of the utilization of the 32
position pool by requiring review of the Legislative Council or Joint Budget 33
Committee in the utilization of the position pool. Therefore, the requirement 34
of review by the Legislative Council or Joint Budget Committee is not a 35
severable part of this section. If the requirement of review by the 36

Legislative Council or Joint Budget Committee is ruled unconstitutional by a 1
court of competent jurisdiction, this entire section is void. 2
The provisions of this section shall be in effect only from July 1, 2025 3

SECTION 29. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 6
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 7
SHARED SERVICES. (a)(1) The Chief Fiscal Officer of the State may create a 8
Shared Services paying accounts on his or her books and on the books of the 9
Treasurer of State and the Auditor of State for the payment of personal 10
services and operating expenses in the Shared Services Paying Account 11
Appropriation by the Department of Education. 12
(2) The Chief Fiscal Officer of the State shall direct the transfer 13
of funds and appropriations to the Shared Services Paying Account 14
appropriation section of this act on the books of the Treasurer of State, the 15
Auditor of State, and the Chief Fiscal Officer of the State. 16
(3) The transfer authority provided to the department in 17
subdivision (a)(2) of this section may be used to make transfers only within 18
the department's appropriation act or between other appropriation acts 19
authorized for the department. 20
(4) The provisions of this section shall be in effect from the 21
date of passage through June 30, 2026 2027. 22
23
SECTION 30. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 24
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. OUT-OF-25
SCHOOL TIME PROGRAM GRANTS REQUIREMENTS. (a) Of the amount appropriated to 26
the Department of Education - Division of Elementary and Secondary Education 27
for Out-Of-School Time Program Grants in this act, funding shall only be made 28
available to eligible entities for comprehensive out-of-school time programs 29
for school aged children. 30
(b) Eligible programs shall be limited to applicants meeting the following 31
criteria: 32
(1) Provide out-of-school time programs during the school year to school 33
aged children; 34
(2) Provide regular activities designed for evidence-based academic 35
enhancement that aligns and supports state curriculum standards and will 36

include a minimum of two of the following five activity areas: 1
(A) STEM (Science, Technology, Engineering and Math); 2
(B) Academic support; 3
(C) Goal setting/leadership; 4
(D) Career exposure/Workforce Readiness; and 5
(E) Community service. 6
(3) Provide activities above as a part of a comprehensive out-of-school 7
program; 8
(4) Operate for a minimum of 12 hours weekly during the school year; 9
minimum of four days per week during the calendar school year; not including 10
school breaks such as holiday or seasonal; 11
(5) Collect data on participants’ demographics, attendance and program 12
participation and compile statewide aggregated data; 13
(6) Implement rigorous safety standards including employee background 14
checks, compliance with mandated reporting laws; and 15
(7) Must be a qualified 501(c)(3) or 501(c)(4) organization that has been 16
in operation for more than 5 years and has a record of fiscal accountability. 17
Organizations must also provide a sustainability model with a minimum of 50% 18
of funding derived from non-state resources. 19
(c) The Department of Education - Division of Elementary and Secondary 20
Education shall promulgate rules for the determination of eligibility and 21
administration of the Out-Of-School Time Program Grants. 22
(d) The provisions of this section shall be in effect only from July 1, 2025 23
2026 through June 30, 2026 2027. 24

SECTION 31. SPECIAL LANGUAGE - CODE AMENDMENT. Arkansas Code § 6-18-26
722 is amended to read as follows: 27
6-18-722. Free and reduced-price meals — Definitions. 28
(a) Federal funds appropriated to the Department of Education 29
Agriculture for a child nutrition program shall be used to provide school 30
breakfasts and lunches at no cost to each qualifying student. 31
(b)(1) A public school that serves a school breakfast or a school 32
lunch as part of a child nutrition program shall not charge a qualifying 33
student a reduced-price copayment for a school breakfast or a school lunch. 34
(2)(A) If necessary to comply with the requirements of this 35
section, the department Department of Agriculture shall provide funds that 36

have been disbursed to the department Department of Agriculture from the 1
United States Government for purposes of funding child nutrition programs to 2
each public school that serves a school breakfast or a school lunch as part 3
of a child nutrition program to cover the cost of eliminating reduced-price 4
copayments as required by subdivision (b)(1) of this section. 5
(B) If federal funds appropriated to the department 6
Department of Agriculture for a child nutrition program are insufficient to 7
provide a school breakfast or a school lunch at no cost under subdivision 8
(b)(2)(A) of this section, the department Department of Agriculture shall use 9
funds as authorized by law to provide a school breakfast or a school lunch 10
not initially covered by federal funds under subsection (a) of this section 11
or other funds as authorized by law. 12
(c)(1) Annually by November 15, the Department of Education 13
Agriculture shall report on and provide to the House Committee on Education 14
and the Senate Committee on Education an overview of each child nutrition 15
program offered in public schools. 16
(2) The report required under subdivision (c)(1) of this section 17
shall include without limitation: 18
(A) The procedure for applying for free or reduced-price 19
meals in public schools; and 20
(B) The number of students who: 21
(i) Apply for free or reduced-price meals; 22
(ii) Are accepted to receive free or reduced-price 23
meals; 24
(iii) Are denied from receiving free or reduced-25
price meals; and 26
(iv) Automatically qualify for free or reduced-price 27
meals based on federal eligibility requirements. 28
(d)(1) Arkansas Legislative Audit shall audit the Department of 29
Education Child Nutrition Unit by December 15, 2023, and report the audit 30
findings to the House Committee on Education and the Senate Committee on 31
Education. 32
(2) The audit required under subdivision (d)(1) of this section 33
shall determine whether each public school's participation in a child 34
nutrition program effectively: 35
(A) Serves the intent of the General Assembly to expand 36

students' access to free meals in public schools; and 1
(B) Complies with federal and state law and rules. 2
(e) As used in this section: 3
(1) “Child nutrition program” includes the following as 4
established under the Richard B. Russell National School Lunch Act, 42 U.S.C. 5
§ 1751 et seq., as it existed on January 1, 2023: 6
(A) The National School Lunch Program; or 7
(B) The School Breakfast Program; and 8
(2) “Qualifying student” means a kindergarten through grade 9
twelve (K-12) student enrolled in a public school who is eligible for receipt 10
of a reduced-price meal in a child nutrition program. 11
(f)(1) Beginning with the 2025-2026 school year and each school year 12
thereafter, a public school student who is not a qualifying student under 13
this section and does not receive a free breakfast through any local, state, 14
or federal program shall be provided one (1) breakfast at no cost during each 15
school day upon his or her request without consideration of his or her 16
eligibility for a federally funded free or reduced-price meal. 17
(2)(A) If necessary to comply with the requirements of 18
subdivision (f)(1) of this section, the department Department of Agriculture 19
shall provide funds that have been disbursed to the department Department of 20
Agriculture from the United States Government for purposes of funding child 21
nutrition programs to each public school to cover the cost of providing one 22
(1) breakfast at no cost during each school day to each public school student 23
who is not a qualifying student under this section. 24
(B) If federal funds appropriated to the department 25
Department of Agriculture for a child nutrition program are insufficient to 26
cover the cost of providing one (1) breakfast at no cost during each school 27
day to each public school student who is not a qualifying student, the 28
department Department of Agriculture shall use funds as authorized by law to 29
cover the cost of providing one (1) breakfast at no cost during each school 30
day to each public school student who is not a qualifying student. 31
(C) The cost of providing one (1) breakfast shall not 32
exceed the rate of reimbursement to public schools established by the Richard 33
B. Russell National School Lunch Act, 42 U.S.C. § 1751 et seq., and the Child 34
Nutrition Act of 1966, 42 U.S.C. § 1771 et seq., for a free school breakfast. 35
(g) The department Department of Agriculture may promulgate rules to 36

implement this section. 1

SECTION 32. SPECIAL LANGUAGE - CODE AMENDMENT. Arkansas Code § 19-27-3
341(c)-(f), concerning the Food Insecurity Fund, are amended to read as 4
follows: 5
(c)(1) By July 31 each fiscal year: 6
(A) The Department of Education Agriculture shall submit a 7
certification to the Chief Fiscal Officer of the State of the amount expensed 8
by the Department of Education Agriculture the prior fiscal year to comply 9
with § 6-18-722(b) to eliminate a charge to students for a reduced-price 10
copayment for a school breakfast or a school lunch, which shall be reviewed 11
by the Chief Fiscal Officer of the State; and 12
(B) The Department of Human Services shall submit a 13
certification to the Chief Fiscal Officer of the State of the estimated 14
amount required to fund the state matching funds requirement for the federal 15
Summer Electronic Benefit Transfer Program for Children, commonly known as 16
“Summer EBT”, for the current fiscal year, which shall be reviewed by the 17
Chief Fiscal Officer of the State. 18
(2) After reviewing the certifications submitted under 19
subdivision (c)(1) of this section, the Chief Fiscal Officer of the State may 20
deny, modify, or approve the certifications based on the: 21
(A) Estimated amount of funding needed and available; 22
(B) Purpose; and 23
(C) Preferred spending priority. 24
(3) Based on the certifications from the Department of Education 25
Agriculture and the Department of Human Services in subdivision (c)(1) of 26
this section, the Chief Fiscal Officer of the State shall instruct the 27
Treasurer of State to transfer those amounts on a pro rata basis to the fund 28
or fund accounts designated by the Secretary of the Department of Education 29
Agriculture and the Secretary of the Department of Human Services. 30
(d) Any unexpended balance of moneys in the fund accounts designated 31
by the Department of Education Agriculture and the Department of Human 32
Services to be allocated for the purposes under subsection (c) of this 33
section that are remaining at the end of each fiscal year shall be designated 34
and retained for the purposes under subsection (c) of this section for the 35
following fiscal year, and certifications required under subdivision (c)(1) 36

of this section shall be adjusted to reflect the remaining balances. 1
(e) After making the transfers under subdivision (c)(3) of this 2
section, the Treasurer of State shall then transfer the remainder of the 3
balance of the Food Insecurity Fund to the fund account designated by the 4
Department of Education Agriculture to be used by the Department of Education 5
Agriculture to comply with § 6-18-722(f). 6
(f) Any unexpended balance of moneys in the fund account designated by 7
the Department of Education Agriculture allocated for the purposes under 8
subsection (e) of this section that are remaining at the end of each fiscal 9
year shall be designated and retained for the purposes outlined under 10
subsection (e) of this section for the following fiscal year. 11

SECTION 33. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 13
authorized by this act shall be limited to the appropriation for such agency 14
and funds made available by law for the support of such appropriations; and 15
the restrictions of the State Procurement Law, the General Accounting and 16
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 17
Procedures and Restrictions Act, or their successors, and other fiscal 18
control laws of this State, where applicable, and regulations promulgated by 19
the Department of Finance and Administration, as authorized by law, shall be 20
strictly complied with in disbursement of said funds. 21

SECTION 34. LEGISLATIVE INTENT. It is the intent of the General 23
Assembly that any funds disbursed under the authority of the appropriations 24
contained in this act shall be in compliance with the stated reasons for 25
which this act was adopted, as evidenced by the Agency Requests, Executive 26
Recommendations and Legislative Recommendations contained in the budget 27
manuals prepared by the Department of Finance and Administration, letters, or 28
summarized oral testimony in the official minutes of the Arkansas Legislative 29
Council or Joint Budget Committee which relate to its passage and adoption. 30

SECTION 35. EMERGENCY CLAUSE. It is found and determined by the 32
General Assembly, that the Constitution of the State of Arkansas prohibits 33
the appropriation of funds for more than a one (1) year period; that the 34
effectiveness of this Act on July 1, 2026 is essential to the operation of 35
the agency for which the appropriations in this Act are provided, and that in 36

the event of an extension of the legislative session, the delay in the 1
effective date of this Act beyond July 1, 2026 could work irreparable harm 2
upon the proper administration and provision of essential governmental 3
programs. Therefore, an emergency is hereby declared to exist and this Act 4
being necessary for the immediate preservation of the public peace, health 5
and safety shall be in full force and effect from and after July 1, 2026. 6
