amendment to the Revenue Stabilization law. Further, the General Assembly 24
has determined that the Department of Corrections - Division of Correction 25
may operate more efficiently if some flexibility is provided to the 26
Department of Corrections authorizing broad powers under this Section. 27
Therefore, it is both necessary and appropriate that the General Assembly 28
maintain oversight by requiring prior approval of the Legislative Council or 29
Joint Budget Committee as provided by this section. The requirement of 30
approval by the Legislative Council or Joint Budget Committee is not a 31
severable part of this section. If the requirement of approval by the 32
Legislative Council or Joint Budget Committee is ruled unconstitutional by a 33
court of competent jurisdiction, this entire section is void. 34

SECTION 17. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 2
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 3
REALLOCATION OF RESOURCES. Upon determination by the Board of Corrections, 4
at the request of the Secretary of Corrections, that a reallocation of 5
resources within the Division of Community Correction and Division of 6
Correction is necessary for the efficient and effective operation of the 7
department, the Board, with approval of the Governor and approval by the 8
Arkansas Legislative Council or Joint Budget Committee, shall have the 9
authority to instruct the Department Secretary, to request from the Chief 10
Fiscal Officer of the State, a transfer of positions, programs, funds, 11
appropriations, and line-item appropriations within or between existing and 12
newly created divisions, offices, sections, or units of the department. If 13
it is determined that the requested transfer should be made, the Chief Fiscal 14
Officer of the State shall then initiate the necessary transfer documents to 15
reflect the transfers upon the fiscal records of the State Treasurer, the 16
State Auditor, the Chief Fiscal Officer of the State, and the Department of 17
Corrections Divisions of Correction and Community Correction. Provided, 18
however, that the Department Secretary shall be limited to submitting no more 19
than two requests, encompassing a single purpose listed in this section, 20
during any fiscal year per division. Transfer authority shall further be 21
limited to no more than five percent (5%) of the total General Revenue and 22
Special Revenue appropriation, funding, and positions specific to each 23
division, office, section or unit from which funds are transferred. However, 24
there shall be no fund transfers to or from the County Jail Reimbursement 25
Fund. A Reallocation of Resources Transfer shall be limited to the following 26
specific purposes: 27
a) Costs to open and operate temporary beds; 28
b) Payment of Debt Service; 29
c) Payment of Overtime Expenses; 30
d) Unanticipated increases for medical or private prison contracts; 31
e) Construction/renovation/equipping of new beds; 32
f) Deficits in Farm or Industry Program; 33
g) Losses not covered by insurance proceeds; 34
h) Costs of personnel for critical services necessary to carry out the 35
mission of the agency. 36

SECTION 18. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 21

COMPENSATION. The Department of Corrections is authorized to pay employees 23
for hours of unused holidays in the employee's holiday account. Payments of 24
unused Holiday hours must be processed on or before June 1st in each fiscal 25
year. Employees terminating employment from the Department of Corrections 26
will be eligible for all holiday pay accrued. This request is contingent on 27
approval by the Chief Fiscal Officer of the State after the Secretary of the 28
Department of Corrections has verified that sufficient revenues are available 29
to make such payments to employees who have served in the following 30
classifications, with the exception that those employees wishing to accrue 31
banked hours be allowed the option to bank unused holiday hours in the 32
employee's holiday account, not to exceed one-hundred fifty (150) hours: 33

COMPENSATION REPORT. The Department of Finance and Administration Office of 12
Budget shall prepare and submit to the Arkansas Legislative Council or Joint 13
Budget Committee a report reflecting the amount of appropriation and funding 14
necessary for the Department of Corrections to sufficiently budget for the 15
expenditure of payments to employees for all Holiday Liability, GAP Time 16
Liability, Overtime, and Hazardous Duty Compensation incurred, including the 17
current balances of said liabilities. This report shall be included in the 18
summary budget information manual submitted during the biennial budget 19
process. 20
The provisions of this section shall be in effect only from July 1, 21
2025 2026 through June 30, 2026 2027. 22

SECTION 20. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 24
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. COUNTY 25
JAIL REIMBURSEMENT FUND YEAR-END FUND BALANCE CARRY FORWARD. Notwithstanding 26
any law pertaining to the transfer of year-end fund balances or any law to 27
the contrary, any funds which remain in the County Jail Reimbursement Fund at 28
the end of a fiscal year shall remain in the County Jail Reimbursement Fund 29
and made available to fund appropriations authorized by law payable from the 30
County Jail Reimbursement Fund for the following fiscal year. 31
Any carry forward of unexpended balance of funding as authorized herein, may 32
be carried forward under the following conditions: 33
(1) Prior to June 30, 2025 2026 the Agency shall by written statement set 34
forth its reason(s) for the need to carry forward said funding to the 35
Department of Finance and Administration Office of Budget; 36

(2) The Department of Finance and Administration Office of Budget shall 1
report to the Arkansas Legislative Council all amounts carried forward from 2

include the name of the Agency, Board, Commission or Institution and the 5
amount of the funding carried forward from the first fiscal year to the 6
second fiscal year, the program name or line item, the funding source of that 7
appropriation and a copy of the written request set forth in (1) above; 8
(3) Each Agency, Board, Commission or Institution shall provide a written 9
report to the Arkansas Legislative Council or Joint Budget Committee 10
containing all information set forth in item (2) above, along with a written 11
statement as to the current status of the project, contract, purpose etc. for 12
which the carry forward was originally requested no later than thirty (30) 13
days prior to the time the Agency, Board, Commission or Institution presents 14
its budget request to the Arkansas Legislative Council/Joint Budget 15
Committee; and 16
(4) Thereupon, the Department of Finance and Administration shall include 17
all information obtained in item (3) above in the budget manuals and/or a 18
statement of non-compliance by the Agency, Board, Commission or Institution. 19
The provisions of this section shall be in effect only from July 1, 20
2025 2026 through June 30, 2026 2027. 21

SECTION 21. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 23

"Purchase Cattle/Meat" line item. 29

for prior review and approval by the Arkansas Legislative Council or Joint 5
Budget Committee, and review and approval by the Department of Finance and 6
Administration and the Building Authority Division of the Department of 7
Finance and Administration. 8

Council or Joint Budget Committee, transfer from any line item appropriation 25
contained in the Inmate Care & Custody appropriation of this Act into the 26
Professional Fees and Services line item contained in the Inmate Care & 27
Custody appropriation of this Act to operate new facilities. 28

items authorized herein but only for the purpose of financing construction or 16
equipment for a facility of the department. Any transfers authorized by this 17
section shall require the approval of the Chief Fiscal Officer of the State 18
after prior review and approval by the Legislative Council or Joint Budget 19
Committee. 20
Determining the maximum number of employees and the maximum amount of 21
appropriation and general revenue funding for a state agency each fiscal year 22
is the prerogative of the General Assembly. This is usually accomplished by 23
delineating such maximums in the appropriation act(s) for a state agency and 24

OF APPROPRIATION AND FUNDS TO THE COUNTY JAIL REIMBURSEMENT FUND. If any 6
savings of general revenue appropriation and funds accrue during the 2025-7
2026 2026-2027 fiscal year in the operations of the Department of Corrections 8
- Division of Correction & Community Correction, the Secretary of the 9
Department of Corrections may request a transfer of appropriation and funds 10
from any line item appropriation to the County Jail Reimbursement Fund in 11
order to meet obligations to counties for housing state inmates. Such 12
transfer request shall be made upon the approval of the Chief Fiscal Officer 13
of the State and prior review and approval by the Arkansas Legislative 14
Council or Joint Budget Committee. 15
The provisions of this section shall be in effect only from July 1, 16
2025 2026 through June 30, 2026 2027. 17

SECTION 27. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 19
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 20
OF FUNDS. The Arkansas Department of Corrections shall provide funding each 21
year in an amount not to exceed $100,000 for a Deputy Prosecuting Attorney 22
who will be assigned to handle the prosecution of offenses occurring at the 23
Arkansas Department of Corrections. Upon request by the Auditor of the State, 24
the Chief Fiscal Officer of the State shall transfer an amount not to exceed 25
$100,000 from an account designated by the Secretary of the Department of 26
Corrections to the State Central Services Fund as a direct revenue to fund a 27
Deputy Prosecuting Attorney who will be assigned to handle the prosecution of 28
offenses occurring at the Arkansas Department of Corrections. 29
The provisions of this section shall be in effect only from July 1, 30
2025 2026 through June 30, 2026 2027. 31

SECTION 28. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 33

SERVICES. (a)(1) The Chief Fiscal Officer of the State may create a Shared 35
Services paying account on his or her books and on the books of the Treasurer 36

of funds and appropriations to the Shared Services Paying Account 5
appropriation section of this act on the books of the Treasurer of State, the 6
Auditor of State, and the Chief Fiscal Officer of the State. 7
(3) The transfer authority provided to the department in 8
subdivision (a)(2) of this section may be used to make transfers only within 9
the department's appropriation act or between other appropriation acts 10
authorized for the department. 11
(4) The provisions of this section shall be in effect from the 12
date of passage through June 30, 2026 2027. 13

SECTION 29. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 15
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CARRY 16
FORWARD - GENERAL REVENUE YEAR END FUND BALANCE. (a) The Chief Fiscal 17
Officer of the State shall cause to be transferred on his or her books and 18
those of the State Treasurer and Auditor of State the balance of General 19
Revenue funds remaining in the Division of Correction Inmate Care and Custody 20
Fund Account on June 30, 2026 2027 into a sub-fund created within the 21
Division of Correction Inmate Care and Custody Fund Account to be used for 22
County Jail Reimbursement or maintenance needs within the Department of 23
Corrections - Division of Correction. The balance of General Revenue in the 24
sub-fund of the Division of Correction Inmate Care and Custody Fund Account 25
at the beginning of any fiscal year shall not exceed five million dollars 26
($5,000,000). For this reason, any general revenue which would cause the 27
balance of sub-fund of the Division of Correction Inmate Care and Custody 28
Fund Account to exceed five million dollars ($5,000,000) shall be reclaimed 29
by the Department of Finance and Administration pursuant to the same 30
procedures as other general revenue recapture. 31
(b) Any carry forward of the unexpended balance of funding as authorized 32
herein, may be carried forward under the following conditions: 33
(1) The Office of Budget of the Department of Finance and Administration 34
shall report to the Legislative Council all amounts carried forward by the 35
September meeting of the Legislative Council or the Joint Budget Committee 36

meeting which report shall include the name of the agency, board, commission, 1
or institution and the amount of funding carried forward, the program name or 2
line item and the funding source; and 3
(2) The Department of Corrections - Division of Correction shall provide a 4
written report to the Legislative Council or Joint Budget Committee 5
containing all information set forth in subdivision (b)(1) of this section no 6
later than thirty (30) days prior to the time the Department presents its 7
budget request to the Legislative Council or Joint Budget Committee, or both; 8
and 9
(3) Thereupon, the Department of Finance and Administration shall include 10
all information obtained in subdivision (b)(2) of this section in the budget 11
manuals. 12
The provisions of this section shall be in effect only from July 1, 13
2025 2026 through June 30, 2026 2027. 14

SECTION 30. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 16
authorized by this act shall be limited to the appropriation for such agency 17
and funds made available by law for the support of such appropriations; and 18
the restrictions of the State Procurement Law, the General Accounting and 19
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 20
Procedures and Restrictions Act, or their successors, and other fiscal 21
control laws of this State, where applicable, and regulations promulgated by 22
the Department of Finance and Administration, as authorized by law, shall be 23
strictly complied with in disbursement of said funds. 24

SECTION 31. LEGISLATIVE INTENT. It is the intent of the General 26
Assembly that any funds disbursed under the authority of the appropriations 27
contained in this act shall be in compliance with the stated reasons for 28
which this act was adopted, as evidenced by the Agency Requests, Executive 29
Recommendations and Legislative Recommendations contained in the budget 30
manuals prepared by the Department of Finance and Administration, letters, or 31
summarized oral testimony in the official minutes of the Arkansas Legislative 32
Council or Joint Budget Committee which relate to its passage and adoption. 33

SECTION 32. EMERGENCY CLAUSE. It is found and determined by the 35
General Assembly, that the Constitution of the State of Arkansas prohibits 36

the appropriation of funds for more than a one (1) year period; that the 1
effectiveness of this Act on July 1, 2026 is essential to the operation of 2
the agency for which the appropriations in this Act are provided, and that in 3
the event of an extension of the legislative session, the delay in the 4
effective date of this Act beyond July 1, 2026 could work irreparable harm 5
upon the proper administration and provision of essential governmental 6
programs. Therefore, an emergency is hereby declared to exist and this Act 7
being necessary for the immediate preservation of the public peace, health 8
and safety shall be in full force and effect from and after July 1, 2026. 9
