BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 20

SECTION 1. REGULAR SALARIES. There is hereby established for the 22
Arkansas Department of Transportation for the 2026-2027 fiscal year, the 23
following maximum number of regular employees and the maximum annual salary 24
for such employees; and no greater salary than that established herein shall 25
be paid to any employee from appropriations hereinafter made for said 26
department. The annual salaries to be paid to each employee authorized herein 27
shall be determined by the Arkansas State Highway Commission within the 28
limitations as set out in this Section and the funds and the appropriations 29
made available for such purposes. All positions established herein shall be 30
exempt from the provisions of the Uniform Classification and Compensation Act 31
(Arkansas Code § 21-5-201, et seq.), or its successor, but shall not be 32
exempt from the provisions of the Regular Salaries Procedures and 33
Restrictions Act. Provided further that the salaries for the pay period 34
beginning June 2026 and ending July 2026 can be paid from the salaries and 35
overtime authorized for the fiscal year ending June 30, 2027. 36

AUTHORIZED. Any savings in the amount appropriated in the Operations 31
appropriation section for the Regular Salaries line item, Overtime line item, 32
Personal Services Matching line item, or any sub-item of the Maintenance and 33
General Operation line item, may be transferred by the Director of the 34
Arkansas Department of Transportation to any sub-item of the Maintenance and 35
General Operation line item, upon review by the Arkansas Legislative Council 36

or Joint Budget Committee and by notifying the Secretary of the Department of 1
Finance and Administration and the Auditor of State to transfer said savings 2
to a specific sub-item of the Maintenance and General Operation line item and 3

The provisions of this section shall be in effect only from July 1, 2025 5
2026 through June 30, 2026 2027. 6

SECTION 15. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 8
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. PERSONAL 9
SERVICES MATCHING TRANSFER. Provided that in the event amounts appropriated 10
in the Personal Services Matching line item of the Operations appropriation 11
section are insufficient in the fiscal year to pay the amounts at the rates 12
stipulated by law to be paid for each of these items, an additional amount as 13
determined and requested by the Director of the Arkansas Department of 14
Transportation, and upon review by the Arkansas Legislative Council or Joint 15
Budget Committee, will be transferred by the Secretary of the Department of 16
Finance and Administration and the Auditor of State from the Maintenance and 17
General Operation line items to the Personal Services Matching line item of 18
the Operations appropriation section to enable the Arkansas Department of 19
Transportation to pay the required matching funds. 20
The provisions of this section shall be in effect only from July 1, 2025 21
2026 through June 30, 2026 2027. 22

SECTION 16. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 24
authorized by this act shall be limited to the appropriation for such agency 25
and funds made available by law for the support of such appropriations; and 26
the restrictions of the State Procurement Law, the General Accounting and 27
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 28
Procedures and Restrictions Act, or their successors, and other fiscal 29
control laws of this State, where applicable, and regulations promulgated by 30
the Department of Finance and Administration, as authorized by law, shall be 31
strictly complied with in disbursement of said funds. 32

SECTION 17. LEGISLATIVE INTENT. It is the intent of the General 34
Assembly that any funds disbursed under the authority of the appropriations 35
contained in this act shall be in compliance with the stated reasons for 36

which this act was adopted, as evidenced by the Agency Requests, Executive 1
Recommendations and Legislative Recommendations contained in the budget 2
manuals prepared by the Department of Finance and Administration, letters, or 3
summarized oral testimony in the official minutes of the Arkansas Legislative 4
Council or Joint Budget Committee which relate to its passage and adoption. 5

SECTION 18. EMERGENCY CLAUSE. It is found and determined by the 7
General Assembly, that the Constitution of the State of Arkansas prohibits 8
the appropriation of funds for more than a one (1) year period; that the 9
effectiveness of this Act on July 1, 2026 is essential to the operation of 10
the agency for which the appropriations in this Act are provided, and that in 11
the event of an extension of the legislative session, the delay in the 12
effective date of this Act beyond July 1, 2026 could work irreparable harm 13
upon the proper administration and provision of essential governmental 14
programs. Therefore, an emergency is hereby declared to exist and this Act 15
being necessary for the immediate preservation of the public peace, health 16
and safety shall be in full force and effect from and after July 1, 2026. 17
