BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21

SECTION 1. APPROPRIATION - NATIONAL HOUSING TRUST FUND GRANT. There is 23
hereby appropriated, to the Arkansas Development Finance Authority, to be 24
payable from the federal funds as designated by the Chief Fiscal Officer of 25
the State, for operating expenses for implementation of the Federal Housing 26
Program for the fiscal year ending June 30, 2027, the following: 27

SECTION 2. APPROPRIATION - EMERGENCY SOLUTIONS GRANT. There is hereby 33
appropriated, to the Arkansas Development Finance Authority, to be payable 34
from the federal funds as designated by the Chief Fiscal Officer of the 35
State, to provide funding to engage homeless individuals and families, 36

improve the number and quality of emergency shelters for homeless individuals 1
and families, provide essential services to shelter residents and rapidly re-2
house homeless individuals and families for the fiscal year ending June 30, 3

SECTION 3. SPECIAL LANGUAGE – CODE AMENDMENT. Arkansas Code Title 15, 10
Chapter 5, Subchapter 1, is amended to add additional sections to read as 11
follows: 12
15-5-108. Regular salaries. 13
There are established for the Arkansas Development Finance Authority 14
the following titles and grades for each position. The salary for the 15
positions assigned to each grade shall be determined in accordance with the 16
pay level for the grade assigned in this section, as established in § 21-5-17
209. 18

15-5-109. Arkansas Development Finance Authority — Salaries. 2
(a) An adjustment in the annual salary rate for an employee shall be 3
made at the discretion of the Director of the Arkansas Development Finance 4
Authority. 5
(b) In addition to other salary payments under this section, the 6
director may implement a merit program to reward employees for exceptional 7
service. 8
(c) In order to recruit and retain exceptionally well-qualified 9
personnel, the Arkansas Development Finance Authority may exceed the maximum 10
salary levels by no more than twenty percent (20%) for no more than one-third 11
(⅓) of the positions authorized. 12

15-5-110. Expansion pool. 14
(a) The Arkansas Development Finance Authority is authorized a pool of 15
twenty (20) positions to be used to establish additional positions with the 16
proper title and pay grade if the Arkansas Development Finance Authority does 17
not have sufficient positions available to address growth needs. 18
(b) The Arkansas Development Finance Authority is authorized to access 19
the pool positions under subsection (a) of this section at any time when the 20
Director of the Arkansas Development Finance Authority determines that the 21
need exists. 22
(c) The director shall provide an annual report justifying the need 23
determination under subsection (b) of this section to the: 24
(1) Board of Directors of the Arkansas Development Finance 25
Authority; 26
(2) Chief Fiscal Officer of the State; and 27
(3) Secretary of the Department of Shared Administrative 28
Services. 29

SECTION 4. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 31
authorized by this act shall be limited to the appropriation for such agency 32
and funds made available by law for the support of such appropriations; and 33
the restrictions of the State Procurement Law, the General Accounting and 34
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 35
Procedures and Restrictions Act, or their successors, and other fiscal 36

control laws of this State, where applicable, and regulations promulgated by 1
the Department of Finance and Administration, as authorized by law, shall be 2
strictly complied with in disbursement of said funds. 3

SECTION 5. LEGISLATIVE INTENT. It is the intent of the General 5
Assembly that any funds disbursed under the authority of the appropriations 6
contained in this act shall be in compliance with the stated reasons for 7
which this act was adopted, as evidenced by the Agency Requests, Executive 8
Recommendations and Legislative Recommendations contained in the budget 9
manuals prepared by the Department of Finance and Administration, letters, or 10
summarized oral testimony in the official minutes of the Arkansas Legislative 11
Council or Joint Budget Committee which relate to its passage and adoption. 12

SECTION 6. EMERGENCY CLAUSE. It is found and determined by the General 14
Assembly, that the Constitution of the State of Arkansas prohibits the 15
appropriation of funds for more than a one (1) year period; that the 16
effectiveness of this Act on July 1, 2026 is essential to the operation of 17
the agency for which the appropriations in this Act are provided, and that in 18
the event of an extension of the legislative session, the delay in the 19
effective date of this Act beyond July 1, 2026 could work irreparable harm 20
upon the proper administration and provision of essential governmental 21
programs. Therefore, an emergency is hereby declared to exist and this Act 22
being necessary for the immediate preservation of the public peace, health 23
and safety shall be in full force and effect from and after July 1, 2026. 24
