SECTION 16. APPROPRIATION - HVAC UPGRADE. There is hereby 5
appropriated, to the Secretary of State, to be payable from the cash funds 6
deposited in the State Treasury as determined by the Chief Fiscal Officer of 7
the State, for HVAC upgrade to North End of State Capitol building for the 8
fiscal year ending June 30, 2027, the sum of......................$9,100,000. 9

SECTION 17. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 11
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 12
TRANSFER PROVISION. After receiving approval from the Chief Fiscal Officer 13
of the State, and prior review by the Arkansas Legislative Council or Joint 14
Budget Committee, the Agency is authorized to transfer appropriation from any 15
line item authorized in Operations appropriation to any other line item 16
authorized in Operations appropriation. 17
The provisions of this section shall be in effect only from July 1, 2025 18
2026 through June 30, 2026 2027. 19

SECTION 18. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 21
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 22
PERMANENT GIFT SHOP. The Arkansas Secretary of State shall operate a gift 23
shop to be permanently located in a space on the first floor of the State 24
Capitol Building. It shall be the duty of the Secretary of State to maintain 25
a space on the first floor of the State Capitol Building for the use of a 26
gift shop. The Arkansas Secretary of State is prohibited from removing a 27
gift shop from the first floor of the State Capitol Building or to nullify or 28
void the provisions of this section. A space on the first floor of the State 29
Capitol Building shall be the only location for the Arkansas Secretary of 30
State gift shop operations and shall be the only location items of the 31
Arkansas Secretary of State gift shop are sold to the public. 32

SECTION 19. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 34
authorized by this act shall be limited to the appropriation for such agency 35
and funds made available by law for the support of such appropriations; and 36

the restrictions of the State Procurement Law, the General Accounting and 1
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 2
Procedures and Restrictions Act, or their successors, and other fiscal 3
control laws of this State, where applicable, and regulations promulgated by 4
the Department of Finance and Administration, as authorized by law, shall be 5
strictly complied with in disbursement of said funds. 6

SECTION 20. LEGISLATIVE INTENT. It is the intent of the General 8
Assembly that any funds disbursed under the authority of the appropriations 9
contained in this act shall be in compliance with the stated reasons for 10
which this act was adopted, as evidenced by the Agency Requests, Executive 11
Recommendations and Legislative Recommendations contained in the budget 12
manuals prepared by the Department of Finance and Administration, letters, or 13
summarized oral testimony in the official minutes of the Arkansas Legislative 14
Council or Joint Budget Committee which relate to its passage and adoption. 15

SECTION 21. EMERGENCY CLAUSE. It is found and determined by the 17
General Assembly, that the Constitution of the State of Arkansas prohibits 18
the appropriation of funds for more than a one (1) year period; that the 19
effectiveness of this Act on July 1, 2026 is essential to the operation of 20
the agency for which the appropriations in this Act are provided, and that in 21
the event of an extension of the legislative session, the delay in the 22
effective date of this Act beyond July 1, 2026 could work irreparable harm 23
upon the proper administration and provision of essential governmental 24
programs. Therefore, an emergency is hereby declared to exist and this Act 25
being necessary for the immediate preservation of the public peace, health 26
and safety shall be in full force and effect from and after July 1, 2026. 27
