BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21

SECTION 1. REGULAR SALARIES. There is hereby established for the 23
Arkansas Public Employees Retirement System for the 2026-2027 fiscal year, 24

SECTION 2. EXTRA HELP. There is hereby authorized, for the Arkansas 27
Public Employees Retirement System for the 2026-2027 fiscal year, the 28
following maximum number of part-time or temporary employees, to be known as 29
"Extra Help", payable from funds appropriated herein for such purposes: six 30
(6) temporary or part-time employees, when needed, at rates of pay not to 31
exceed those provided in the Uniform Classification and Compensation Act, or 32
its successor, or this act for the appropriate classification. 33

SECTION 9. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 25
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. JUDICIAL 26
RETIREMENT FUND TRANSFERS. A sum not to exceed $150,000 in the 2025-2026 27
2026-2027 fiscal year may be transferred from the Judges Retirement Fund to 28
the Arkansas Public Employees' Retirement System Fund for costs incurred by 29
the Arkansas Public Employees Retirement System in administering the Judicial 30
Retirement System. Such transfer request shall be made to the Chief Fiscal 31
Officer of the State, and upon his approval, said transfer shall be made on 32
his books and those of the Treasurer of the State and the Auditor of the 33
State. 34
The provisions of this section shall be in effect only from July 1, 2025 35
2026 through June 30, 2026 2027. 36

SECTION 10. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 2
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. STATE 3
POLICE RETIREMENT FUND TRANSFERS. A sum not to exceed $250,000 in the 2025-4
2026 2026-2027 fiscal year may be transferred from the State Police 5
Retirement Fund to the Arkansas Public Employees' Retirement System Fund for 6
costs incurred by the Arkansas Public Employees Retirement System in 7
administering the State Police Retirement System. Such transfer request 8
shall be made to the Chief Fiscal Officer of the State, and upon his 9
approval, said transfer shall be made on his books and those of the Treasurer 10
of the State and the Auditor of the State. 11
The provisions of this section shall be in effect only from July 1, 2025 12
2026 through June 30, 2026 2027. 13

SECTION 11. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 15
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. EXEMPTION 16
FROM PRIOR REVIEW. The Arkansas Public Employees Retirement System is hereby 17
exempted from seeking prior review by the Arkansas Legislative Council or 18
Joint Budget Committee with regard to transfers between the Benefits and 19
Refund line items in the Public Employees Retirement Cash appropriation 20
section and the Benefits-Non Employee line item in the Public Employees 21
Retirement Operations appropriation section which are specifically related to 22
transfers necessitated by the changes in retirees' selection of the method of 23
payment of retirement benefits. All other provisions of Arkansas Code §19-4-24
513 shall be applicable. 25
The provisions of this section shall be in effect only from July 1, 2025 26
2026 through June 30, 2026 2027. 27

SECTION 12. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 29
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. SPECIAL 30
STATE POLICE RETIREMENT FUND TRANSFERS. A sum not to exceed $50,000 may be 31
transferred from the State Police Retirement Fund to the Arkansas Public 32
Employees' Retirement System Fund to share in the costs incurred by the 33
Arkansas Public Employees Retirement System in the purchase and 34
implementation of a new, and for the ongoing maintenance and operation of the 35
pension administration system, which is utilized to administer State Police 36

pension transactions for members and retirees. Said transfer shall sunset at 1
the end of fiscal year 2026 2027. Such transfer request shall be made to the 2
Chief Fiscal Officer of the State, and upon his approval, said transfer shall 3
be made on his books and those of the Treasurer of the State and the Auditor 4
of the State. 5
The provisions of this section shall be in effect only from July 1, 2025 6
2026 through June 30, 2026 2027. 7

SECTION 13. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 9
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. SPECIAL 10
JUDICIAL RETIREMENT FUND TRANSFERS. A sum not to exceed $50,000 may be 11
transferred from the Judicial Retirement Fund to the Arkansas Public 12
Employees' Retirement System Fund to share in the costs incurred by the 13
Arkansas Public Employees Retirement System in the purchase and 14
implementation of a new, and for the ongoing maintenance and operation of the 15
pension administration system, which is utilized to administer Judicial 16
pension transactions for members and retirees. Said transfer shall sunset at 17
the end of fiscal year 2026 2027. Such transfer request shall be made to the 18
Chief Fiscal Officer of the State, and upon his approval, said transfer shall 19
be made on his books and those of the Treasurer of State and the Auditor of 20
the State. 21

SECTION 14. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 25
authorized by this act shall be limited to the appropriation for such agency 26
and funds made available by law for the support of such appropriations; and 27
the restrictions of the State Procurement Law, the General Accounting and 28
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 29
Procedures and Restrictions Act, or their successors, and other fiscal 30
control laws of this State, where applicable, and regulations promulgated by 31
the Department of Finance and Administration, as authorized by law, shall be 32
strictly complied with in disbursement of said funds. 33

SECTION 15. LEGISLATIVE INTENT. It is the intent of the General 35
Assembly that any funds disbursed under the authority of the appropriations 36

contained in this act shall be in compliance with the stated reasons for 1
which this act was adopted, as evidenced by the Agency Requests, Executive 2
Recommendations and Legislative Recommendations contained in the budget 3
manuals prepared by the Department of Finance and Administration, letters, or 4
summarized oral testimony in the official minutes of the Arkansas Legislative 5
Council or Joint Budget Committee which relate to its passage and adoption. 6

SECTION 16. EMERGENCY CLAUSE. It is found and determined by the 8
General Assembly, that the Constitution of the State of Arkansas prohibits 9
the appropriation of funds for more than a one (1) year period; that the 10
effectiveness of this Act on July 1, 2026 is essential to the operation of 11
the agency for which the appropriations in this Act are provided, and that in 12
the event of an extension of the legislative session, the delay in the 13
effective date of this Act beyond July 1, 2026 could work irreparable harm 14
upon the proper administration and provision of essential governmental 15
programs. Therefore, an emergency is hereby declared to exist and this Act 16
being necessary for the immediate preservation of the public peace, health 17
and safety shall be in full force and effect from and after July 1, 2026. 18
