HELP ORGANIZATION GRANTS. (a)(1) As used in this section, "pregnancy help 20
organization" means a nonprofit corporation or an organization exempt from 21
federal income tax, existing as of January 1, 2024, that: 22
(A) Seeks to provide a range of services to individuals 23
facing an unintended pregnancy with the intention of encouraging 24
pregnant women to give birth to their unborn children; 25
(B) Promotes infant and maternal wellness or reduces infant 26
and maternal mortality, or both, by: 27
(i) Providing nutritional information or nutritional 28
counseling, or both; 29
(ii) Providing prenatal vitamins; 30
(iii) Providing a list of prenatal medical care 31
options; 32
(iv) Providing social, emotional, or material support, 33
or any combination thereof; or 34
(v) Providing referrals for Special Supplemental 35
Nutrition Program for Women, Infants and Children and community-based 36

nutritional services, including without limitation food banks, food 1
pantries, and food distribution centers; and 2
(C) Does not perform, prescribe, provide referrals for, or 3
encourage abortion or affiliate with any organization that performs, 4
prescribes, provides referrals for, or encourages abortion. 5
(2) "Pregnancy help organization" includes without limitation: 6
(A) Organizations traditionally known as "crisis pregnancy 7
organizations"; 8
(B) Maternity homes; 9
(C) Adoption agencies; and 10
(D) Social services agencies that provide material support 11
and other assistance to individuals facing an unintended pregnancy to 12
help those individuals give birth to their unborn children. 13
(b)(1) The Department of Finance and Administration shall create a 14
grant program to provide funding to pregnancy help organizations. 15
(2) Grant funds shall be disbursed directly to the pregnancy help 16
organizations from the department. 17
(c)(1) The department shall promulgate rules to implement the 18
disbursement of the grant moneys from the Pregnancy Help Organization 19
Grant Sub-Fund in the Miscellaneous Agencies Fund Account. 20
(2) The rules promulgated under subdivision (c)(1) of this 21
section shall include: 22
(A) A requirement that the entity requesting the grant 23
moneys submit a plan describing how the entity will spend the grant 24
moneys; and 25
(B) A statement that the funds shall not be disbursed all 26
at once, but in increments in accordance with the plan described in 27
subdivision (c)(2)(A) of this section. 28
(d) Each fiscal year the department shall file with the Legislative 29
Council or, if the General Assembly is in session, the Joint Budget 30
Committee, a report summarizing the amount of all funding given to 31
each pregnancy help organization and the purpose of the funds awarded 32
to each pregnancy help organization. 33
(e) No more than twenty five percent (25%) of the grant award may be 34
used for administrative costs. 35
(e)(f) The provisions of this section shall be in effect only from 36

PROCEDURES - APPROPRIATION – INFRASTRUCTURE INVESTMENT & JOBS ACT OF 2021. 5
(i) All appropriation and expenditures for funding received for the 6
Infrastructure Investment & Jobs Act of 2021 shall be expended using the 7
Infrastructure Investment & Jobs Act of 2021 appropriation sections as 8
authorized in this Act. 9
(ii) Any state agency, constitutional office, or institution shall request 10
a transfer of appropriation, as provided in the Infrastructure Investment & 11
Jobs Act of 2021 appropriation sections of this Act, from the Chief Fiscal 12
Officer of the State, stating clearly the amount requested, purpose and any 13
additional information requested by the Chief Fiscal Officer of the State. 14
(iii) After reviewing a request, the Chief Fiscal Officer of the State may 15
deny, modify or approve the request based on the estimated amount of 16
appropriation needed and currently available, purpose, estimated funding 17
available and preferred spending priority. Upon approval or modification of a 18
request by the Chief Fiscal Officer of the State and after meeting the 19
requirements of subsection (iv) herein, the Department of Finance and 20
Administration shall establish the transfer of appropriation on the books of 21
the Department of Finance and Administration and the State Auditor, in 22
compliance with the applicable classifications of appropriations as 23
enumerated in Arkansas Code 19-4-511 through 19-4-516. 24
(iv) Any request approved as authorized in subsection (iii) herein, 25
including requests that establish a new commitment item or new appropriation 26
shall require prior approval by the Legislative Council or the Joint Budget 27
Committee during a regular session, fiscal session, or extraordinary session 28
of the General Assembly. 29
(v) Any appropriation approved in the Infrastructure Investment & Jobs Act 30
of 2021 by the General Assembly shall only be used for: 31
1) The purpose and amount of planned expenditures as submitted for 32
approval to the General Assembly and, 33
2) In the event that expenditures or obligations do not fully expend 34
approved appropriation authority as authorized in this section, the excess 35
appropriation may not be utilized for any additional expenditures other than 36

the amount and purpose as submitted to and approved by the General Assembly. 1
(vi) The Chief Fiscal Officer of the State shall submit a monthly report 2
to the Legislative Council or the Joint Budget Committee during a regular 3
session, fiscal session, or extraordinary session of the General Assembly or 4
to a designated subcommittee listing all Infrastructure Investment & Jobs Act 5
of 2021 beginning balance of funds received, each appropriation approved as 6
authorized in subsection (v) herein with the date the appropriation is 7
established, state entity, purpose, amount, funding distributed, and 8
remaining balance. 9
(vii) Determining the maximum amount of appropriation each fiscal year is 10
the prerogative of the General Assembly. This is usually accomplished by 11
delineating such maximums in the appropriation act(s). Further, the General 12
Assembly has determined that a state agency, constitutional office, or 13
institution may operate more efficiently if some flexibility is provided to 14
the state agency, constitutional office, or institution authorizing broad 15
powers under this section. Therefore, it is both necessary and appropriate 16
that the General Assembly maintain oversight by requiring prior approval of 17
the Legislative Council or Joint Budget Committee as provided by this 18
section. The requirement of approval by the Legislative Council or Joint 19
Budget Committee is not a severable part of this section. If the requirement 20
for approval by the Legislative Council or Joint Budget Committee is ruled 21
unconstitutional by a court of competent jurisdiction, this entire section is 22
void. 23

SECTION 41. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 25
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 26
PROCEDURES - APPROPRIATION – AMERICAN RESCUE PLAN ACT OF 2021. (i) All 27
appropriation and expenditures for funding received for the American Rescue 28
Plan Act of 2021 shall be expended using the American Rescue Plan Act of 2021 29
Appropriation Sections as authorized in this Act. 30

Administration shall establish the transfer of appropriation on the books of 6
the Department of Finance and Administration and the State Auditor, in 7
compliance with the applicable classifications of appropriations as 8
enumerated in Arkansas Code 19-4-511 through 19-4-516. 9
(iv) Any request approved as authorized in subsection (iii) herein, 10
including requests that establish a new commitment item or new appropriation 11
shall require prior approval by the Legislative Council during the extended 12
recess, beginning on May 1, 2021, of the 2021 Regular Session or during the 13
interim, or the Joint Budget Committee during a regular session, fiscal 14
session, or extraordinary session of the General Assembly. 15
(v) Any appropriation approved in the American Rescue Plan of 2021 by the 16
General Assembly shall only be used for: 17
(1) The purpose and amount of planned expenditures as submitted for 18
approval to the General Assembly and, 19
(2) In the event that expenditures or obligations do not fully expend 20
approved appropriation authority as authorized in this section, the excess 21
appropriation may not be utilized for any additional expenditures other than 22
the amount and purpose as submitted to and approved by the General Assembly. 23
(vi) It is the intent of the General Assembly that funds received from the 24
American Rescue Plan of 2021 that are discretionary or are not required to be 25
spent for a different general or specific purpose may be considered to be 26
utilized to pay off existing debt service. The parameters for the selection 27
of debt service payments may consider the highest interest rate owed and with 28
priority given to the payment of Big River Steel General Obligations bonds 29
and GARVEE Department of Transportation bonds. 30
(vii) The Chief Fiscal Officer of the State shall submit a report 31
biannually, July 15th and January 15th, to the Legislative Council or the 32
Joint Budget Committee during a regular session, fiscal session, or 33
extraordinary session of the General Assembly or to a designated subcommittee 34
listing all American Rescue Plan Act of 2021 beginning balance of funds 35
received, each appropriation approved herein with the date the appropriation 36

is established, state entity, purpose, amount, funding distributed, and 1
remaining balance. A final report shall be filed six months after the last 2

delineating such maximums in the appropriation act(s). Further, the General 6
Assembly has determined that a state agency, constitutional office, or 7
institution may operate more efficiently if some flexibility is provided to 8
the state agency, constitutional office, or institution authorizing broad 9
powers under this section. Therefore, it is both necessary and appropriate 10
that the General Assembly maintain oversight by requiring prior approval of 11

appropriation is not provided by the General Assembly, any state agency, 22
constitutional office, or institution may request a transfer of 23
appropriation, as provided in the C.A.R.E.S. Appropriation Section of this 24
Act, from the Chief Fiscal Officer of the State, stating clearly the amount 25
requested, purpose and any additional information requested by the Chief 26
Fiscal Officer of the State. 27
(ii) After reviewing a request, the Chief Fiscal Officer of the State may deny, 28
modify or approve the request based on the estimated amount of appropriation 29
needed and currently available, purpose, estimated funding available and 30
preferred spending priority. Upon approval or modification of a request by the 31
Chief Fiscal Officer of the State and after meeting the requirements of 32
subsection (iii) herein, the Department of Finance and Administration shall 33
establish the transfer of appropriation on the books of the Department of 34
Finance and Administration and the State Auditor, in compliance with the 35
applicable classifications of appropriations as enumerated in Arkansas Code 19-36

such maximums in the appropriation act(s). Further, the General Assembly has 8
determined that a state agency, constitutional office, or institution may 9
operate more efficiently if some flexibility is provided to the state agency, 10
constitutional office, or institution authorizing broad powers under this 11
section. Therefore, it is both necessary and appropriate that the General 12
Assembly maintain oversight by requiring prior approval of the Legislative 13
Council or Joint Budget Committee as provided by this section. The requirement 14
of approval by the Legislative Council or Joint Budget Committee is not a 15
severable part of this section. If the requirement or approval by the 16
Legislative Council or Joint Budget Committee is ruled unconstitutional by a 17
court of competent jurisdiction, this entire section is void. 18
The provisions of this section shall be in effect from the date of passage 19
through June 30, 2026 2027. 20

SECTION 43. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 22
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 23
CLASSIFICATION AND USE OF APPROPRIATIONS. The appropriations authorized in 24
the Marketing and Redistribution Section, hereof which are transferred to the 25
various agencies, as authorized in the Transfer Provision - Marketing and 26
Redistribution Section hereof, are to be used for the maintenance and general 27
operation of the benefiting agency and shall only be expended under the 28
provisions cited in Arkansas Code § 19-4-513, the same being the General 29
Accounting and Budgetary Procedures Law of Arkansas. Provided, however, no 30
appropriation authorized herein shall be expended for Conference and Travel 31
Expenses or Professional Fees and Services. 32
The provisions of this section shall be in effect only from July 1, 2025 33
2026 through June 30, 2026 2027. 34

PROVISION - MARKETING AND REDISTRIBUTION. The Department of Finance and 2
Administration shall, upon transfer to the agencies or institutions fund or 3
fund account of the proceeds derived from disposal of property by the 4
Marketing and Redistribution division for the benefit of various agencies, 5
transfer appropriation, as provided in the Marketing and Redistribution 6
Section, hereof in such amount as funds are deposited into the Property Sales 7
Holding Fund and transferred therefrom for the benefit of such agencies. 8
The provisions of this section shall be in effect only from July 1, 2025 9
2026 through June 30, 2026 2027. 10

SECTION 45. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 12
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 13
RESTRICTIONS - MISCELLANEOUS TRANSFERS. Nothing in this Act is to be 14
construed as an authority to transfer a like amount of current general 15
revenues to fund appropriations provided for in the Miscellaneous Transfers 16
Section of this Act. 17
The provisions of this section shall be in effect only from July 1, 2025 18

SECTION 46. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 21
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 22
RESTRICTIONS - TRANSFER PROVISIONS. The Department of Finance and 23
Administration shall transfer appropriation as provided in the Refund to 24
Expenditures line item of the Miscellaneous Transfers Section, hereof in such 25
amounts as funds are deposited into the State Treasury or financial 26
institutions for proceeds received from insurance policies for casualty 27
losses, overpayment of obligations, overpayment of salaries, over-allocation 28
of federal assistance, maturity or redemption of investments, and subrogation 29
payments received for workers' compensation claims paid, for the benefit of 30
various state agencies. Provided, however, that the Chief Fiscal Officer of 31
the State is hereby authorized to promulgate such rules, regulations, 32
procedures, and guidelines as he or she may deem necessary and proper in 33
order to carry out the provisions of this Act. 34
The provisions of this section shall be in effect only from July 1, 2025 35
2026 through June 30, 2026 2027. 36

SECTION 47. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 2
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 3
PROCEDURES - PERSONAL SERVICES OVERTIME. In the event that there is not 4
sufficient appropriation provided for by the General Assembly for overtime 5
compensation pursuant to Arkansas Code § 19-4-1612 and related personal 6
services matching for any state agency for the period ending June 30, 2026 7
2027, said agency shall request a transfer from appropriations provided for 8
Overtime in the Miscellaneous Transfers Section, herein, from the Chief 9
Fiscal Officer of the State, stating clearly the amount required. Upon 10
approval of the Chief Fiscal Officer of the State, and after seeking prior 11
review by the Arkansas Legislative Council or Joint Budget Committee, the 12
State Auditor shall be notified as to the amount and the purposes for which 13
said appropriation is to be made. The appropriation shall be established 14
upon the books of the Department of Finance and Administration and the State 15
Auditor. Provided, further, that if desired, said appropriation shall be 16
supplemental to those regularly appropriated for such purposes by the General 17

CLASSIFICATION AND USE OF APPROPRIATIONS - REFUND TO EXPENDITURES. The 24

Transfers Section, hereof which are transferred to the various agencies as 26
authorized by the RESTRICTIONS - MISCELLANEOUS TRANSFERS and the RESTRICTIONS 27
- TRANSFER POSITIONS Sections hereof are to be used for the same purposes and 28
shall be expended under the same provisions as cited in Arkansas Code §§ 19-29
4-501 through 19-4-516, the same being the General Accounting and Budgetary 30
Procedures Law of Arkansas, or its successor. 31

PROCEDURES - CASH FUNDS. In the event that the appropriation is not provided 1
by the General Assembly for Cash Fund expenditures for any state agency, 2
pursuant to Arkansas Code § 19-4-801 et seq., said agency shall request a 3
transfer of appropriation from the Chief Fiscal Officer of the State, stating 4
clearly the amount required. Upon approval of the Chief Fiscal Officer of 5
the State, and after seeking prior review by the Arkansas Legislative Council 6
or Joint Budget Committee, said cash fund appropriations shall be established 7
upon the books of the Department of Finance and Administration, provided 8
further, that upon request of the state agency and with the approval of the 9
Chief Fiscal Officer of the State, the requested appropriations may be 10
established upon the books of the Department of Finance and Administration in 11
compliance with the applicable classifications of appropriations as 12
enumerated in Arkansas Code §§ 19-4-511 through 19-4-516. 13
The provisions of this section shall be in effect only from July 1, 2025 14

SECTION 50. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 17

MISCELLANEOUS FEDERAL PROGRAMS. The appropriations provided in the Various 19
State Agencies - Cash Section herein shall not be used to establish spending 20
authority for new or unanticipated Federal Funds or Programs as defined by 21
the provisions of the Miscellaneous Federal Grant Programs Act, Arkansas Code 22
§ 19-7-301 et seq., and the provisions of the General Accounting and 23
Budgetary Procedures Act, Arkansas Code § 19-4-101 et seq., or its successor. 24
Funds subject to the above mentioned acts shall be deposited in the State 25
Treasury. 26
The provisions of this section shall be in effect only from July 1, 2025 27

SECTION 51. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 30

SECTION 52. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 5
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 6
PROCEDURES - PERSONAL SERVICES. In the event that the Chief Fiscal Officer 7
of the State determines that the General Assembly has not provided sufficient 8
appropriation for the payment of Personal Services for any office of an 9
elected Constitutional Officer, including the Bureau of Legislative Research, 10
Division of Legislative Audit or the Judicial Department, any state agency, 11
office, board, commission, institution or institution of higher education due 12
to the enactment of this Act or any other Act approved by the General 13
Assembly which raises the compensation level or required benefit matching 14
costs of state employees, the agency, office, board, commission, institution 15
of higher education or other institution may request a transfer from the 16
appropriation provided herein from the Chief Fiscal Officer of the State. 17
Such request shall clearly state the amount required, the fund or fund 18
account from which the employees are currently being paid, and such other 19
information as may be required by the Chief Fiscal Officer of the State that 20
he or she deems necessary to make a decision regarding the request. Upon the 21
approval of the Chief Fiscal Officer of the State, and upon review by the 22
Performance Evaluation and Expenditure Review Subcommittee of the Arkansas 23
Legislative Council or Joint Budget Committee or upon processing the request 24
for elected Constitutional Officers and their employees by the Chief Fiscal 25
Officer of the State, the State Auditor shall be notified as to the amount 26
and the purposes for which said appropriation is to be made. In the event 27
that appropriation for the payment of Personal Services is not sufficient for 28
the last payroll of the fiscal year, the Chief Fiscal Officer of the State 29
may approve any transfers on an emergency basis and provide a report to the 30
Performance Evaluation and Expenditure Review Subcommittee of the Arkansas 31
Legislative Council or Joint Budget Committee. The appropriation shall then 32
be added to the proper account on the books of the Department of Finance and 33
Administration and the State Auditor payable from the fund or fund account 34
from which the employees of the state agency, office, board, commission, 35
institution of higher education or other institution are authorized to be 36

SECTION 53. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 5

TRANSFER - PERFORMANCE FUND. Funding of compensation increases provided by 7
the General Assembly in the fiscal year ending June 30, 2026 2027, and 8
funding for the appropriation transfers authorized by the TRANSFER PROCEDURES 9
- PERSONAL SERVICES Section of this Act for those state agencies, offices, 10
boards, commissions, institutions and state institutions of higher education 11
which are supported in whole or in part from general revenues shall, if 12
required, be provided for by a transfer from the Performance Fund to the 13
proper fund or fund account and in such amounts as may be determined by the 14
Chief Fiscal Officer of the State and upon review by the Performance 15
Evaluation and Expenditure Review Subcommittee of the Arkansas Legislative 16
Council or Joint Budget Committee. The state agencies, offices, boards, 17
commissions, institutions and state institutions of higher education shall, 18
in addition to the funds provided in this section for Personal Services from 19
the Performance Fund, make available any funding generated from its salary 20
savings for such purposes as provided for herein, from the funds or fund 21
accounts as prescribed by law. 22
The provisions of this section shall be in effect only from July 1, 2025 23
2026 through June 30, 2026 2027. 24

SECTION 54. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 26

DEFENDER. The appropriation provided in the Public Defender Reimbursement 28
line item of the Miscellaneous Grants and Expenses Section herein shall be 29
expended only for the purpose of reimbursing the Public Defender of Pulaski 30
County to provide defense for the mentally ill. 31

ASSOCIATION. A lump sum monthly installment of at least one-twelfth (1/12) 1
of the annual allocation provided for in the Arkansas Sheriffs' Association 2
Section of this Act, or so much thereof as may be made available, shall be 3
provided to the Arkansas Sheriffs' Association to be used exclusively for the 4
establishment and operation of crime prevention and alcohol and drug abuse 5
programs and for a grant to the Arkansas Sheriffs' Association to study ways 6
to improve the administration of sheriffs' offices and developing and 7
improving education programs designed for sheriffs' offices in Arkansas. 8
The provisions of this section shall be in effect only from July 1, 2025 9
2026 through June 30, 2026 2027. 10

SECTION 56. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 12
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 13
DISTRIBUTION OF ADMINISTRATION OF JUSTICE FUNDS. In the event that the fund 14
balance in the Administration of Justice Fund is inadequate to fund the 15
monthly allocation to State Agencies, the funds will be distributed as 16
follows: 17
(a) The available revenue and remaining State Administration of Justice 18
Fund balance shall be distributed first to fully fund the monthly allocations 19
found in the ALLOCATION RESTRICTIONS Section of this Act for: 20
(1) the Administrative Office of the Courts to fund the State Central 21
Services Fund for Trial Court Administrators, 22
(2) the District Judges Association for the District Court Coordinator, 23
and 24
(3) Administrative Office of the Courts to fund State Central Services 25
Fund for Court Reporters. 26
(b) The total funds remaining in the State Administration of Justice Fund 27
after the monthly distribution is made under subdivision (a) of this section 28
shall be distributed to the remaining state programs and state agencies 29
listed in the ALLOCATION RESTRICTIONS Section of this Act but not listed in 30
subdivision (a) of this section shall be funded in the percentage of the 31
total funds available in the Administration of Justice Fund; that is if less 32
than 100% of the total monthly allocation is available for distribution, 33
monthly allocations for the remaining agencies will be funded at an equal 34
percentage consistent with the remaining available funds, provided that any 35
of the allocations listed in the ALLOCATION RESTRICTIONS Section that have 36

been fully pledged prior to January 1, 2001 to the repayment of a bond issue 1
or bond issues shall not be reduced below the amount listed in the ALLOCATION 2

transfer on his or her books and those of the State Treasurer and the Auditor 9
of the State a sum not to exceed one million dollars ($1,000,000) or so much 10
thereof as is available from fund balances that exceed seven million dollars 11
($7,000,000) as determined by the Chief Fiscal Officer of the State, from the 12
State Administration of Justice Fund to the Crime Victims Reparations 13
Revolving Fund to provide funds for personal services, operating expenses and 14

FORCE 2000 DISTRIBUTION. After the amount to be made available to a 22

transferred from the Work Force 2000 Development Fund to the State Treasury 26
fund or fund account from which the technical college, technical institute, 27

PROCEDURES - PERSONAL SERVICES STIPENDS. If there is not sufficient 30
appropriation, from funds deposited in the State Treasury or Cash Accounts of 31
an agency, for personal services, or personal services matching for any state 32
agency for the period ending June 30, 2026 2027, for State agencies that 33
process payroll through the Arkansas Administrative Statewide Information 34
System for federal and state tax reporting as necessary to comply with the 35
payment of stipends under United States Internal Revenue Code (IRC), 2001-36

Code-Vol, Sec 3401 and Treasury Regulations §31.3401(c)-1(a) and §1.1402(c)-1
2(b), and others which govern the reporting of income and payment of 2
withholding and matching taxes for personal services, the agency shall 3
request a transfer from appropriation provided for Personal Services and 4
Personal Services Matching in the appropriation for Various State Agencies - 5
U.S. IRC and Treasury Regulations herein, from the Chief Fiscal Officer of 6
the State, stating clearly the amounts required for each item. Upon approval 7
of the Chief Fiscal Officer of the State, the State Auditor shall be notified 8
as to the amount and the purposes for which the appropriation is to be made 9
and such appropriation as needed shall be established upon the books of the 10
Department of Finance and Administration and the State Auditor. Provided, 11
however, that in the event the total amount of transfer requested in any 12
fiscal year exceeds Ten Thousand Dollars ($10,000), the Chief Fiscal Officer 13
of the State shall seek prior review by the Arkansas Legislative Council or 14
Joint Budget Committee before the transfer shall be made. 15
The provisions of this section shall be in effect only from July 1, 2025 16

SECTION 64. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 19
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. POSITION 20
ESTABLISHMENT. The Chief Fiscal Officer of the State shall have the authority 21
to establish such positions as necessary for State agencies to process 22
payroll through the Arkansas Administrative Statewide Information System for 23
federal and state tax reporting purposes as necessary to comply with the 24
United States Internal Revenue Code (IRC), 2001-Code-Vol, Sec 3401 and 25
Treasury Regulations §31.3401(c)-1(a) and §1.1402(c)-2(b), and others which 26
govern the reporting of income and payment of withholding and matching taxes 27
for personal services. The positions established shall not be considered as 28
part of the total number of authorized positions for an agency and shall only 29
be considered as placeholders for payments to individuals who are board or 30
commission members or elected officials of the State that do not otherwise 31
receive salaries or wages as defined in Arkansas Code § 19-4-512 for their 32
personal services. Further, none of the positions established under this 33
section shall imply eligibility for state retirement or state health 34
insurance benefits. The establishment of such positions shall not exceed 250 35
positions in any fiscal year. 36

SECTION 65. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 4
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 5
AUTHORIZED - ARKANSAS CHILDREN'S HOSPITAL. The Arkansas Children's Hospital 6
may request the Chief Fiscal Officer of the State to transfer funds made 7
available for the following by this Act sums not to exceed $1,000,000 for the 8
Arkansas Children's Hospital Burn Center, $700,000 for the Children's 9
Hospital Payments, $600,000 for the Reproductive Health Monitoring, and 10
$233,600 for the Intensive Care Nursery each fiscal year from the 11
Miscellaneous Agencies Fund Account to the Department of Human Services 12
Grants Fund Account. The transferred funds shall be used to match federal 13
funds used for supplemental Medicaid payments to Arkansas Children's 14
Hospital. 15
The Arkansas Children's Hospital may also request the Chief Fiscal Officer 16
of the State to transfer the sum not to exceed $1,000,000 each fiscal year 17
from the Miscellaneous Agencies Fund Account from funds made available by 18
this Act for the Intensive Care Nursery to the Department of Human Services 19
Grants Fund Account. The transferred funds shall be used to match federal 20
Medicaid funds for cost-based reimbursement for helicopter patient transport. 21
The provisions of this section shall be in effect only from July 1, 2025 22
2026 through June 30, 2026 2027. 23

SECTION 66. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 25
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 26
INNOVATION AND PROJECT DEVELOPMENT FUND TRANSFERS. The Department of Shared 27
Administrative Services - Office of State Technology is a cost recovery 28
agency subject to the requirements of the United States Office of Management 29
and Budget Circular A-87 Cost Principles for State, Local and Indian Tribal 30
Government (A-87) and Cost Principles for Developing Cost Allocation Plans 31
and Indirect Cost Rates for Agreements with the Federal Government 32
Implementation Guide for the Office of Management and Budget Circular A-87 33
(ASMBC-10). To comply with these federal rules, it is necessary to establish 34
an Innovation and Project Development appropriation and general revenue fund 35
account within the Department of Finance and Administration - Disbursing 36

Officer for the Department of Shared Administrative Services - Office of 1
State Technology. This fund shall be used for state enterprise innovation 2
projects that would enhance the technology operations of the State that 3
cannot be cost allocated to federal programs. The Department of Shared 4
Administrative Services - Office of State Technology will maintain 5
documentation for projects billed for these purposes. Fund transfers may be 6
made from the General Revenue Fund Account, upon the approval of the Chief 7
Fiscal Officer of the State and prior review of the Arkansas Legislative 8
Council or Joint Budget Committee, to reimburse the Department of Shared 9
Administrative Services - Office of State Technology for the amounts billed. 10
The provisions of this section shall be in effect only from July 1, 2025 11
2026 through June 30, 2026 2027. 12

SECTION 67. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 14
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 15
PROCEDURES – PERSONAL SERVICES EXTRA HELP. In the event that there is not 16
sufficient appropriation provided for by the General Assembly for payment of 17
personal services related to Extra Help for any state agency for the period 18
ending June 30, 2026 2027, said agency may request a transfer from 19
appropriations provided for Personal Services Extra Help in the Miscellaneous 20
Transfers Section herein, from the Chief Fiscal Officer of the State, stating 21
clearly the amount required. Upon approval of the Chief Fiscal Officer of 22
the State, and after seeking prior review by the Arkansas Legislative Council 23
or Joint Budget Committee, the State Auditor shall be notified as to the 24
amount and the purposes for which said appropriation is to be made. The 25
appropriation shall then be established upon the books of the Department of 26
Finance and Administration and the State Auditor. Provided further, that if 27
desired, said appropriation shall be supplemental to those regularly 28
appropriated for such purposes by the General Assembly for the agency. 29
The provisions of this section shall be in effect only from July 1, 2025 30

SECTION 68. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 33
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 34
INTRASTATE METRO PLANNING GRANTS. As referenced in Section 9 of Act 637 of 35
1995, the authorized funding for Intrastate Metro Planning Grants that are 36

evenly distributed among planning and development districts under the 1
Miscellaneous Grants and Expenses Section of this Act shall include the West 2
Central Arkansas Economic Development District. 3
The provisions of this section shall be in effect only from July 1, 2025 4

SECTION 69. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 7
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUND 8
USAGE AUTHORIZED. The Arkansas Children’s Hospital President and C.E.O. may 9
request the Department of Human Services-Division of Medical Services to 10
retain in the Department of Human Services Grant Fund account an amount not 11
to exceed $1,000,000 for funds made available by the act to be used to match 12
federal funds used for supplemental Medicaid payments to Arkansas Children’s 13
Hospital. 14
The provisions of this section shall be in effect only from July 1, 2025 15
2026 through June 30, 2026 2027. 16

SECTION 70. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 18
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 19
PROCEDURES - MEDICAL MARIJUANA IMPLEMENTATION AND REGULATION. In the event 20
that sufficient appropriation is not provided by the General Assembly for 21
expenditures resulting from the implementation and regulation of the Arkansas 22
Medical Marijuana Amendment of 2016 for any state agency, pursuant to 23
Arkansas Code § 19-4-701 et seq., said agency shall request a transfer of 24
appropriation from the Chief Fiscal Officer of the State, stating clearly the 25
amount required. Upon approval of the Chief Fiscal Officer of the State said 26
appropriations shall be established upon the books of the Department of 27
Finance and Administration in compliance with the applicable classifications 28
of appropriations as enumerated in Arkansas Code §§ 19-4-511 through 19-4-29
516. 30
The provisions of this section shall be in effect only from July 1, 2025 31
2026 through June 30, 2026 2027. 32

SECTION 71. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 34
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUND 35
TRANSFER AUTHORITY. From time to time, the Chief Fiscal Officer of the State 36

may transfer from his or her books and those of the Treasurer of State and 1
the Auditor of State from the Medical Marijuana Implementation and Operations 2
Fund to various state agencies' funds the amounts necessary to fund the 3
expenses for the implementation, administration, and/or enforcement of the 4
Arkansas Medical Marijuana Amendment of 2016. 5
The provisions of this section shall be in effect only from July 1, 2025 6
2026 through June 30, 2026 2027. 7

SECTION 72. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 9
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. BLANKET 10
BOND PROGRAM. The Secretary of the Department of Finance and Administration 11
is authorized to transfer Appropriation between the Blanket Surety Bond 12
Program appropriations authorized for State Employees (Appropriation 2DM), 13
County Employees (Appropriation 2DN), Municipal Employees (Appropriation 2DP) 14
and Public School Employees (Appropriation 2DQ). 15
The provisions of this section shall be in effect only from July 1, 2025 16
2026 through June 30, 2026 2027. 17

SECTION 73. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 19
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 20
PROCEDURES - VARIOUS TEMPORARY APPROPRIATION FOR STATE AGENCIES AND 21
INSTITUTIONS. (i) In the event that sufficient appropriation is not provided 22
by the General Assembly for any state agency or institution, an agency or 23
institution may request a transfer of appropriation, as provided in the 24
Various Temporary Appropriation for State Agencies and Institutions 25
Appropriation Section of this Act, from the Chief Fiscal Officer of the 26
State, stating clearly the amount requested, purpose and any additional 27
information requested by the Chief Fiscal Officer of the State. 28
(ii) After reviewing a request the Chief Fiscal Officer of the State may 29
deny, modify or approve the agencies or institutions request based on the 30
estimated amount of appropriation needed and currently available, purpose, 31
estimated funding available and preferred spending priority. Upon approval 32
or modification of a request by the Chief Fiscal Officer of the State and 33
after meeting the requirements of subsection (iii) herein, the Department of 34
Finance and Administration shall establish the transfer of appropriation on 35
the books of the Department of Finance and Administration and the State 36

Auditor, in compliance with the applicable classifications of appropriations 1
as enumerated in Arkansas Code 19-4-511 through 19-4-516. 2
(iii) Any request approved as authorized in subsection (ii) herein, 3
including requests that establish a new commitment item or new appropriation 4
shall require prior approval by the Arkansas Legislative Council or if 5
meeting in Regular or Fiscal Session the Joint Budget Committee. 6
(iv) Any appropriation approved as authorized in this Section shall not be 7
carried forward to the next fiscal year and shall be identified as a change 8
level increase by the state agency or institution, if requested. 9
(v) Determining the maximum amount of appropriation for a state agency or 10
institution each fiscal year is the prerogative of the General Assembly. 11
This is usually accomplished by delineating such maximums in the 12
appropriation act(s) for a state agency or institution. Further, the General 13
Assembly has determined that a state agency or institution may operate more 14
efficiently if some flexibility is provided to the state agency or 15
institution authorizing broad powers under this section. Therefore, it is 16
both necessary and appropriate that the General Assembly maintain oversight 17
by requiring prior approval of the Legislative Council or Joint Budget 18
Committee as provided by this section. The requirement of approval by the 19
Legislative Council or Joint Budget Committee is not a severable part of this 20
section. If the requirement or approval by the Legislative Council or Joint 21
Budget Committee is ruled unconstitutional by a court of competent 22
jurisdiction, this entire section is void. 23
The provisions of this section shall be in effect only from July 1, 2025 24
2026 through June 30, 2026 2027. 25

SECTION 74. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 27
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 28
REDISTRIBUTION OF DRIVER'S LICENSE REINSTATEMENT AND INSTALLMENT FEES. 29
(a) Notwithstanding any other provision of law to the contrary, the 30
Department of Finance and Administration shall transfer and disburse general 31
revenue funds each fiscal year to the following: 32
Maximum Allocation 33
(1) Arkansas Public Employees' Retirement System – 34
State Police Retirement Fund; $1,545,068 35
(2) Administrative Office of the Courts – 36

(b) The funds and fund accounts in subsection (a) of this section shall be 5
disbursed monthly in accordance with each fund or fund account’s 6
proportionate share of the total of all such allocations. 7
(c) The provisions of this section shall be in effect only from July 1, 8
2026 through June 30, 2027. 9

SECTION 75. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code § 27-22-11
209(d), concerning the motor vehicle registration reinstatement fee collected 12
by the Department of Finance and Administration after registration is 13
suspended for operating a motor vehicle without insurance coverage, is 14
amended to read as follows: 15
(d) The reinstatement fee collected by the department shall be 16
distributed under § 27-16-808 deposited into the State Treasury, and the 17
Treasurer of State shall credit these proceeds as general revenue to the 18
various funds in the respective amounts to each to be used for the purposes 19
provided in the Revenue Stabilization Law, § 19-20-101 et seq. 20

SECTION 76. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 22
authorized by this act shall be limited to the appropriation for such agency 23
and funds made available by law for the support of such appropriations; and 24
the restrictions of the State Procurement Law, the General Accounting and 25
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 26
Procedures and Restrictions Act, or their successors, and other fiscal 27
control laws of this State, where applicable, and regulations promulgated by 28
the Department of Finance and Administration, as authorized by law, shall be 29
strictly complied with in disbursement of said funds. 30

SECTION 77. LEGISLATIVE INTENT. It is the intent of the General 32
Assembly that any funds disbursed under the authority of the appropriations 33
contained in this act shall be in compliance with the stated reasons for 34
which this act was adopted, as evidenced by the Agency Requests, Executive 35
Recommendations and Legislative Recommendations contained in the budget 36

manuals prepared by the Department of Finance and Administration, letters, or 1
summarized oral testimony in the official minutes of the Arkansas Legislative 2
Council or Joint Budget Committee which relate to its passage and adoption. 3

SECTION 78. EMERGENCY CLAUSE. It is found and determined by the 5
General Assembly, that the Constitution of the State of Arkansas prohibits 6
the appropriation of funds for more than a one (1) year period; that the 7
effectiveness of this Act on July 1, 2026 is essential to the operation of 8
the agency for which the appropriations in this Act are provided, and that in 9
the event of an extension of the legislative session, the delay in the 10
effective date of this Act beyond July 1, 2026 could work irreparable harm 11
upon the proper administration and provision of essential governmental 12
programs. Therefore, an emergency is hereby declared to exist and this Act 13
being necessary for the immediate preservation of the public peace, health 14
and safety shall be in full force and effect from and after July 1, 2026. 15
