PURCHASE RESTRICTIONS. Expenditures from the Hazardous Substance Remedial 2
Action Trust Fund for the purchase of division laboratory equipment, 3
including maintenance contracts, data processing equipment and mission-4
critical software, including maintenance contracts, as appropriated in the 5
Capital Outlay and Data Processing Purchases line items of the Hazardous 6
Waste Cleanup Program appropriation section, may be funded through interest 7

SECTION 38. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 17
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUND 18
TRANSFER PROVISION. Upon approval of the Chief Fiscal Officer of the State, 19
the Arkansas Division of Environmental Quality may transfer from various 20
department funds to the Division of Environmental Quality Fund Account the 21
sum of $1,500,000 in fiscal year 2025-2026 2026-2027 for the exclusive 22
purpose of supplementing funding for the appropriation provided in the State 23
Operations appropriation section. The funds shall be used for personal 24
services and operating expenses of the Arkansas Division of Environmental 25
Quality - State Operations. Funds which remain in the Division of 26
Environmental Quality Fund Account at the close of the fiscal year shall be 27
carried forward and made available for the same purpose for the following 28
fiscal year. These funds shall be used for the purpose stated above. 29
The amounts transferred shall not be considered as part of any 30
statutory limitation on the use of funds for administration of programs of 31
the Division. 32

POST-CLOSURE CLEAN UP RESTRICTIONS. Any expenditures in excess of $2,000,000 2
per site from the Landfill Post-Closure Trust Fund, as appropriated in the 3
Contractual Services line item of the Landfill Post-Closure Program 4
appropriation section, for corrective action to remedy environmental impacts 5
of closed disposal sites previously operated as a landfill pursuant to state 6
law, shall be subject to review and approval by the Arkansas Pollution 7
Control and Ecology Commission after addressing corrective actions needed to 8
address environmental impacts from permitted landfills closed properly. 9
The provisions of this section shall be in effect only from July 1, 2025 10
2026 through June 30, 2026 2027. 11

SECTION 40. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 13
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. SHARED 14
SERVICES. (a)(1) The Chief Fiscal Officer of the State may create a Shared 15
Services paying accounts on his or her books and on the books of the 16
Treasurer of State and the Auditor of State for the payment of personal 17
services and operating expenses in the Shared Services Paying Account 18
Appropriation by the Department of Energy and Environment. 19
(2) The Chief Fiscal Officer of the State shall direct the transfer 20
of funds and appropriations to the Shared Services Paying Account 21
appropriation section of this act on the books of the Treasurer of State, the 22
Auditor of State, and the Chief Fiscal Officer of the State. 23
(3) The transfer authority provided to the department in 24
subdivision (a)(2) of this section may be used to make transfers only within 25
the department's appropriation act or between other appropriation acts 26
authorized for the department. 27
(4) The provisions of this section shall be in effect from the date of 28
passage through June 30, 2026 2027. 29

SECTION 41. SPECIAL LANGUAGE - CODE AMENDMENT. Arkansas Code § 8-9-31
404(a)(3)(B), concerning limitations on fees charged by tire retailers under 32
the Used Tire Recycling and Accountability Act, is amended to read as 33
follows: 34
(B) Except for the rim removal fees fee imposed under this 35
section, a tire retailer shall not charge any other fee to a person who 36

purchases the service of removal of a tire from a rim and replaces the 1
removed tire with a used tire. 2

SECTION 42. SPECIAL LANGUAGE - CODE AMENDMENT. Arkansas Code § 8-9-4
404(d)(3)(B), concerning limitations on fees charged by commercial generators 5
under the Used Tire Recycling and Accountability Act, is repealed. 6
(B) Except for the commercial generator fees imposed under 7
this section, the commercial generator shall not charge any other fee to the 8
end user. 9

SECTION 43. SPECIAL LANGUAGE - CODE AMENDMENT. Arkansas Code § 8-9-11
404(e), concerning limitations on the imposition of certain fees related to 12
tire removal under the Used Tire Recycling and Accountability Act, is 13
repealed. 14
(e)(1) It is the purpose and intent of this section that only one (1) 15
of the following fees imposed under this section be charged for the 16
transaction of removing a tire from a rim that is related to the sale of a 17
replacement tire: 18
(A) The rim removal fee; or 19
(B) The commercial generator fee. 20
(2) If a person establishes that he or she has paid one (1) of 21
the fees for a tire, the tire retailer or tire generator shall not charge an 22
additional fee for that tire. 23

SECTION 44. SPECIAL LANGUAGE - CODE AMENDMENT. Arkansas Code § 8-9-25
405(a)(1), concerning reimbursement to used tire programs under the Used Tire 26
Recycling and Accountability Act, is amended to read as follows: 27
(1) Reimburse used tire programs for used tire transportation, 28
recycling, and disposal costs at a rate not to exceed two dollars and thirty-29
one cents ($2.31) per used tire processed on and after July 1, 2026; 30
31
SECTION 45. SPECIAL LANGUAGE - CODE AMENDMENT. Arkansas Code § 8-9-32
405(b)(9) and (10), concerning the requirement to establish tire collection 33
centers for reimbursement eligibility of used tire programs under the Used 34
Tire Recycling and Accountability Act, are amended to read as follows: 35
(9)(A) Establish tire collection centers that adequately serve 36

the used tire program area within each county served by the used tire program 1
that accepts tires from tire retailers at no charge if the tire retailer 2
establishes that it: 3
(i) Collects the rim removal fee imposed under § 8-4
9-404(a); and 5
(ii) Complies with the electronic uniform used tire 6
manifest system under § 8-9-407. 7
(B) The tire collection centers under this subdivision 8
(b)(9) may be at any one (1) or more of the following: 9
(i) A solid waste disposal facility; 10
(ii) A tire processing facility; or 11
(iii) A tire retailer; and 12
(10) Establish at least one (1) tire collection center within 13
each county served by the used tire program. 14

SECTION 46. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 16
authorized by this act shall be limited to the appropriation for such agency 17
and funds made available by law for the support of such appropriations; and 18
the restrictions of the State Procurement Law, the General Accounting and 19
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 20
Procedures and Restrictions Act, or their successors, and other fiscal 21
control laws of this State, where applicable, and regulations promulgated by 22
the Department of Finance and Administration, as authorized by law, shall be 23
strictly complied with in disbursement of said funds. 24

SECTION 47. LEGISLATIVE INTENT. It is the intent of the General 26
Assembly that any funds disbursed under the authority of the appropriations 27
contained in this act shall be in compliance with the stated reasons for 28
which this act was adopted, as evidenced by the Agency Requests, Executive 29
Recommendations and Legislative Recommendations contained in the budget 30

SECTION 48. EMERGENCY CLAUSE. It is found and determined by the 35
General Assembly, that the Constitution of the State of Arkansas prohibits 36

the appropriation of funds for more than a one (1) year period; that the 1
effectiveness of this Act on July 1, 2026 is essential to the operation of 2
the agency for which the appropriations in this Act are provided, and that in 3
the event of an extension of the legislative session, the delay in the 4
effective date of this Act beyond July 1, 2026 could work irreparable harm 5
upon the proper administration and provision of essential governmental 6
programs. Therefore, an emergency is hereby declared to exist and this Act 7
being necessary for the immediate preservation of the public peace, health 8
and safety shall be in full force and effect from and after July 1, 2026. 9
