BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21

SECTION 1. REGULAR SALARIES - OPERATIONS. There is hereby established 23
for the Department of the Military for the 2026-2027 fiscal year, the 24

SECTION 2. EXTRA HELP. There is hereby authorized, for the Department 16
of the Military for the 2026-2027 fiscal year, the following maximum number 17
of part-time or temporary employees, to be known as "Extra Help", payable 18
from funds appropriated herein for such purposes: one hundred twenty-seven 19
(127) temporary or part-time employees, when needed, at rates of pay not to 20
exceed those provided in the Uniform Classification and Compensation Act, or 21
its successor, or this act for the appropriate classification. 22

SECTION 12. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE 22
ARKANSAS CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 23
GENERALS SALARY. The line item maximums for the State of Arkansas Adjutant 24
General and Deputy Adjutant General are based on the salary grid by the 25
United States Department of Defense. Incumbents in these positions shall be 26
compensated in accordance with the Department of Defense Advisory Service Pay 27
Plan and are not guaranteed placement at the maximum level. The line item 28
maximum salaries may be adjusted on July 1 of each fiscal year to incorporate 29
salary rate changes that have been implemented by the U.S. Department of 30
Defense. 31
The provisions of this section shall be in effect only from July 1, 2025 32
2026 through June 30, 2026 2027. 33

SECTION 13. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 35
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 36

PROMOTIONAL ITEMS. The State Military Department is hereby authorized to 1
transfer appropriation from Operating Expenses to Promotional Items in the 2
General Operations Appropriation and/or Cash Operations Appropriation 3
provided by this Act in an amount not to exceed ten thousand dollars 4
($10,000) each fiscal year, as authorized by the Director of State Resources, 5
and with the approval of the Chief Fiscal Officer of the State. 6
The provisions of this section shall be in effect only from July 1, 2025 7
2026 through June 30, 2026 2027. 8

SECTION 14. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 10
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 11
CARRY FORWARD OF FUNDS. 12
(a) The Chief Fiscal Officer of the State shall cause to be transferred 13
on his or her books and those of the State Treasurer and Auditor of State the 14
balance of funds remaining in the Department of Military Fund Account on June 15
30, 2026 2027 into a sub-fund created within the Department of Military Fund 16
to be used exclusively for construction, maintenance and operating expenses 17
or for future construction projects of the State Military Department. 18
(b) Any carry forward of unexpended balance of funding as authorized 19
herein, may be carried forward under the following conditions: 20
(1) The Office of Budget of the Department of Finance and 21
Administration shall report to the Legislative Council all amounts carried 22
forward by the September meeting of the Legislative Council or the Joint 23
Budget Committee meeting which report shall include the name of the agency, 24
board, commission, or institution and the amount of funding carried forward, 25
the program name or line item and the funding source; and 26
(2) The State Military Department shall provide a written report 27
to the Legislative Council or Joint Budget Committee containing all 28
information set forth in subdivision (b)(1) of this section no later than 29
thirty (30) days prior to the time the Department presents its budget request 30
to the Legislative Council or Joint Budget Committee, or both; and 31
(3) Thereupon, the Department of Finance and Administration shall 32
include all information obtained in subdivision (b)(2) of this section in the 33
budget manuals. 34
The provisions of this section shall be in effect only from July 35
1, 2025 2026 through June 30, 2026 2027. 36

SECTION 15. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 2
authorized by this act shall be limited to the appropriation for such agency 3
and funds made available by law for the support of such appropriations; and 4
the restrictions of the State Procurement Law, the General Accounting and 5
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 6
Procedures and Restrictions Act, or their successors, and other fiscal 7
control laws of this State, where applicable, and regulations promulgated by 8
the Department of Finance and Administration, as authorized by law, shall be 9
strictly complied with in disbursement of said funds. 10

SECTION 16. LEGISLATIVE INTENT. It is the intent of the General 12
Assembly that any funds disbursed under the authority of the appropriations 13
contained in this act shall be in compliance with the stated reasons for 14
which this act was adopted, as evidenced by the Agency Requests, Executive 15
Recommendations and Legislative Recommendations contained in the budget 16
manuals prepared by the Department of Finance and Administration, letters, or 17
summarized oral testimony in the official minutes of the Arkansas Legislative 18
Council or Joint Budget Committee which relate to its passage and adoption. 19

SECTION 17. EMERGENCY CLAUSE. It is found and determined by the 21
General Assembly, that the Constitution of the State of Arkansas prohibits 22
the appropriation of funds for more than a one (1) year period; that the 23
effectiveness of this Act on July 1, 2026 is essential to the operation of 24
the agency for which the appropriations in this Act are provided, and that in 25
the event of an extension of the legislative session, the delay in the 26
effective date of this Act beyond July 1, 2026 could work irreparable harm 27
upon the proper administration and provision of essential governmental 28
programs. Therefore, an emergency is hereby declared to exist and this Act 29
being necessary for the immediate preservation of the public peace, health 30
and safety shall be in full force and effect from and after July 1, 2026. 31
