Real Estate Fund. 8
Determining the maximum number of employees and the maximum amount of 9
appropriation and general revenue funding for a state agency each fiscal year 10
is the prerogative of the General Assembly. This is usually accomplished by 11
delineating such maximums in the appropriation act(s) for a state agency and 12
the general revenue allocations authorized for each fund and fund account by 13
amendment to the Revenue Stabilization law. Further, the General Assembly 14
has determined that Building Authority Division may operate more efficiently 15
if some flexibility is provided to Building Authority Division authorizing 16
broad powers under this section. Therefore, it is both necessary and 17
appropriate that the General Assembly maintain oversight by requiring prior 18
approval of the Legislative Council or Joint Budget Committee as provided by 19
this section. The requirement of approval by the Legislative Council or 20
Joint Budget Committee is not a severable part of this section. If the 21
requirement of approval by the Legislative Council or Joint Budget Committee 22
is ruled unconstitutional by a court of competent jurisdiction, this entire 23
section is void. 24
The provisions of this section shall be in effect only from July 1, 2025 25
2026 through June 30, 2026 2027. 26

AUTHORITY DIVISION - TRANSFER TO FACILITIES MANAGEMENT CONTINGENCY 4
APPROPRIATION AUTHORITY. (a) In order to provide a more cost effective method 5
to address the emerging infrastructure needs of Arkansas State Government, 6
appropriations and funds transferred to the Facilities Management Contingency 7
Appropriation are to be used in the event that the Building Authority 8
Division executes one or more building contracts or maintenance agreements 9
with State Agencies, and the appropriations or funds otherwise provided for 10
the Building Authority Division are not sufficient to address those needs, 11
and it is more cost effective for Building Authority Division to execute 12
these services. Any State Agency may transfer or deposit funds and 13
appropriations to Building Authority Division - Facilities Management 14
Contingency Appropriation authorized in the Building Maintenance Section of 15
this Act to execute one or more building contracts or maintenance agreements 16
with said State Agencies. Building Authority Division shall provide 17
justification to the Chief Fiscal Officer of the State for the need of such 18
appropriations and funds transfers and seek and receive approval of the Chief 19
Fiscal Officer of the State. Building Authority Division shall then seek and 20
receive the approval of the Arkansas Legislative Council or Joint Budget 21
Committee. The requirement of approval by the Arkansas Legislative Council 22
or Joint Budget Committee is not a severable part of the section. If the 23
requirement of approval by the Arkansas Legislative Council or Joint Budget 24
Committee is ruled unconstitutional by a court of competent jurisdiction, 25
this entire section is void. 26
(b) The Chief Fiscal Officer of the State shall make the necessary 27
adjustments on his or her books and the books of the Auditor of the State for 28
the transfer or deposit of the funds and appropriations from each State 29
Agency to the appropriation authorized in the Building Maintenance Section of 30
this Act and to the various Building Authority Division accounts to be used 31
exclusively by Building Authority Division for the fiscal year. 32

BUILDING AUTHORITY DIVISION - SUSTAINABLE BUILDING DESIGN PROGRAM - TRANSFER. 2
In the event there is not sufficient appropriation and/or funding provided 3
for by the General Assembly for any state agency, board or commission to 4
participate in the Sustainable Building Design Program for renovations of 5
state owned property which exceeds two hundred fifty thousand dollars 6
($250,000), the agency may request a transfer from the Sustainable Building 7
Design Program appropriation authorized in the Sustainable Building Design 8
Program Section of this Act from the Chief Fiscal Officer of the State. The 9
request shall clearly state the amount required and such other information as 10
may be required by the Chief Fiscal Officer of the State necessary to make a 11
decision regarding the request. Upon approval of the Chief Fiscal Officer of 12
the State and prior review by the Arkansas Legislative Council or Joint 13
Budget Committee, the State Auditor shall be notified as of the amount and 14
the purposes for which the appropriation and/or funding is to be transferred 15
and shall be established upon the books of the Department of Finance and 16
Administration and the State Auditor. If desired, the appropriation may be 17
supplemental to those regularly appropriated for like purposes by the General 18
Assembly for that agency. 19
Provided further, that all state agencies, boards or commissions shall 20
have prior approval by the Building Authority Division as authorized for the 21
Sustainable Building Design Program in accordance with established Rules and 22
Regulations. 23
The provisions of this section shall be in effect only from July 1, 2025 24

BUILDING AUTHORITY DIVISION - SUSTAINABLE BUILDING DESIGN PROGRAM - REVOLVING 29
LOAN FUND. The Sustainable Building Design Program Appropriation is intended 30
to provide additional appropriation authority for the Sustainable Building 31
Design Program. Funding for the program may be made available by the Chief 32
Fiscal Officer of the State, in the form of a loan, from a transfer from the 33
Sustainable Building Design Revolving Loan Fund after the required review by 34
the Arkansas Legislative Council or Joint Budget Committee, approval by the 35
Chief Fiscal Officer of the State and approval through rules established and 36

administered by Building Authority Division. Moneys made available for the 1
repayment of a loan shall be deposited to the credit of the Sustainable 2
Building Design Revolving Loan Fund as a “Refund to Expenditure” for the year 3
in which the deposit is made. In the event that the funds for the repayment 4
of a loan are held in depositories other than the State Treasury, the 5
administrative head of the affected state agency shall issue a check drawn 6
against the funds, which shall be deposited in the Sustainable Building 7
Design Revolving Loan Fund. 8
The provisions of this section shall be in effect only from July 1, 2025 9
2026 through June 30, 2026 2027. 10

SECTION 38. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 12
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. BUILDING 13
AUTHORITY DIVISION - FUNDING TRANSFER - CASH FUND ACCOUNT. Building 14
Authority Division is authorized to transfer any unspent funds remaining in 15
any cash fund account established for the management of a state owned 16
facility managed by, but not owned by, Building Authority Division to the 17
Building Authority Maintenance Fund to support the facility’s Maintenance and 18
Operations appropriations. 19
The provisions of this section shall be in effect only from July 1, 2025 20
2026 through June 30, 2026 2027. 21

SECTION 39. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 23
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. OFFICE OF 24
STATE TECHNOLOGY - COMPLIANCE WITH STATE AND FEDERAL REGULATIONS. 25
1. In order to effect compliance with the requirements of state and federal 26
statutory and regulatory provisions, the Director shall adjust billing rates 27
or issue billing adjustments to be federally compliant, notwithstanding the 28
provisions of ACA §25-4-105 and §25-4-119 or funds sufficient to effect 29
compliance shall be provided the Division from General Revenues, Special 30
Revenues or such other fund sources as may become available. These actions 31
shall be subject to the approval of the Chief Fiscal Officer of the State and 32
approval by the Arkansas Legislative Council or Joint Budget Committee. 33
2. The Director shall have authority to transfer funds between the 34
Information Technology Reserve Fund established by ACA §25-4-123 and the 35
Division of Information Systems Revolving Fund established by ACA §25-4-121 36

for cash management purposes. 1
Determining the maximum number of employees and the maximum amount of 2
appropriation and general revenue funding for a state agency each fiscal year 3
is the prerogative of the General Assembly. This is usually accomplished by 4
delineating such maximums in the appropriation act(s) for a state agency and 5
the general revenue allocations authorized for each fund and fund account by 6
amendment to the Revenue Stabilization law. Further, the General Assembly 7
has determined that the Office of State Technology may operate more 8
efficiently if some flexibility is provided to the Office of State Technology 9
authorizing broad powers under this section. Therefore, it is both necessary 10
and appropriate that the General Assembly maintain oversight by requiring 11
prior approval of the Legislative Council or Joint Budget Committee as 12
provided by this section. The requirement of approval by the Legislative 13
Council or Joint Budget Committee is not a severable part of this section. 14
If the requirement of approval by the Legislative Council or Joint Budget 15
Committee is ruled unconstitutional by a court of competent jurisdiction, 16
this entire section is void. 17
The provisions of this section shall be in effect only from July 1, 2025 18
2026 through June 30, 2026 2027. 19

SECTION 40. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 21
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 22
PROVISION - LINE ITEMS - OFFICE OF STATE TECHNOLOGY - OPERATIONS. After 23
receiving approval from the Chief Fiscal Officer of the State and prior 24
review by the Arkansas Legislative Council or Joint Budget Committee, the 25
Secretary of the Department of Transformation and Shared Services is 26
authorized to transfer appropriation between the line items authorized herein 27
for the Office of State Technology - Operations to best utilize resources to 28
respond to the needs of the Division's customers. 29
The provisions of this section shall be in effect only from July 1, 2025 30
2026 through June 30, 2026 2027. 31

SECTION 41. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 33

GEOGRAPHIC INFORMATION SYSTEMS OFFICE - TRANSFER OF CARRY FORWARD. Any 35
unexpended balance of funds remaining on June 30 of each fiscal year in the 36

Miscellaneous Agencies Fund Account for the Arkansas Geographic Information 1
System's Office, shall be transferred to the Geographic Information Systems 2
Fund to be used for operating and maintaining the Arkansas Spatial Data 3
Infrastructure, creating, updating, maintaining and disseminating framework 4
spatial data as defined by Arkansas Code §15-21-502. 5
(1) Prior to June 30, 2026 2027 the Agency shall by written statement set 6
forth its reason(s) for the need to carry forward said funding to the 7
Department of Finance and Administration Office of Budget; 8
(2) The Department of Finance and Administration Office of Budget shall 9
report to the Arkansas Legislative Council all amounts carried forward by the 10
September Arkansas Legislative Council or Joint Budget Committee meeting 11
which report shall include the name of the Agency, Board, Commission or 12
Institution and the amount of the funding carried forward, the program name 13
or line item, the funding source of the appropriation and a copy of the 14
written request set forth in (1) above; 15
(3) Each Agency, Board, Commission or Institution shall provide a written 16
report to the Arkansas Legislative Council or Joint Budget Committee 17
containing all information set forth in item (2) above, along with a written 18
statement as to the current status of the project, contract, purpose, etc. 19
for which the carry forward was originally requested no later than thirty 20
(30) days prior to the time the Agency, Board, Commission or Institution 21
presents its budget request to the Arkansas Legislative Council or Joint 22
Budget Committee; and 23
(4) Thereupon, the Department of Finance and Administration shall include 24
all information obtained in item (3) above in the biennial budget manuals 25
and/or a statement of non-compliance by the Agency, Board, Commission or 26
Institution. 27
The provisions of this section shall be in effect only from July 1, 28
2025 2026 through June 30, 2026 2027. 29

SECTION 42. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 31
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 32
CENTRALIZED SERVICES. (a) The Department of Shared Administrative Services 33
may enter into contracts with a state agency or governmental entity as 34
necessary for the centralization of governmental services. 35
(b) The department may establish fair and reasonable rates or fee 36

schedules to be assessed to a state agency or governmental entity receiving 1
services for the purpose of recovering allowable costs associated with 2
providing the services. 3
(c) The rate or fee schedule under subsection (b) of this section shall 4
apply uniformly to all state agencies or governmental entities receiving 5
substantially similar services. 6
(d) The authority provided in this section is limited to the: 7
(1) Office of State Procurement; 8
(2) Office of Personnel Management; and 9
(3) Fleet Management Program within the Department of Shared 10
Administrative Services. 11
(e) The entities in subdivisions (d)(1)-(3) of this section may 12
establish estimated billing rates to be developed for a period of time to 13
coincide with the state budgeting process. 14
(f) The department may adjust billing as necessary to ensure compliance 15
with applicable: 16
(1) State laws; 17
(2) Federal laws; and 18
(3) State rules and federal regulations. 19
(g) Billing adjustments under subsection (f) of this section are 20
subject to the approval of the Chief Fiscal Officer of the State. 21
(h) The provisions of this section shall be in effect only from July 1, 22
2026 through June 30, 2027. 23

SECTION 43. SPECIAL LANGUAGE - CODE AMENDMENT. Arkansas Code § 25-36-25
104(c) and (d), concerning data recording and tracking under the Arkansas 26
Economic Opportunity Expansion Act, are amended to read as follows: 27
(c)(1) Each state agency shall include in its budget report to the 28
Joint Budget Committee a list of all contracts in amounts exceeding fifty 29
thousand dollars ($50,000) awarded to minority-owned businesses. 30
(2) The vice president or vice chancellor for finance of each state 31
college and university shall include in his or her budget report to the Joint 32
Budget Committee a listing of all contracts in amounts exceeding fifty 33
thousand ($50,000) awarded to minority-owned businesses. 34
(d) The director shall promulgate rules necessary for the implementation of 35
this chapter. 36

SECTION 44. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code § 19-61-2
801(6)(A), concerning the definitions used regarding intergovernmental 3
relations under the Arkansas Procurement Law, is amended to read as follows: 4
(6)(A) “Public school Local government construction services” 5
means services procured by a municipality, public school district, or open-6
enrollment public charter school under a contract with a corresponding 7
cooperative purchasing verification letter providing for the making of 8
repairs, alterations, erection, or other permanent improvements to a public 9
building, property, or structure that do not exceed a total aggregate amount 10
of one million dollars ($1,000,000) for a public procurement unit in a fiscal 11
year. 12

SECTION 45. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code § 19-61-14
802(a)(1), concerning cooperative purchasing under the Arkansas Procurement 15
Law, is amended to read as follows: 16
(a)(1) A public procurement unit may participate in, sponsor, conduct, 17
or administer a cooperative purchasing agreement for the acquisition of 18
public school local government construction services, commodities, or other 19
services in accordance with an agreement entered into between the 20
participants. 21

SECTION 46. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code § 19-61-23
802(a)(2)(A), concerning cooperative purchasing under the Arkansas 24
Procurement Law, is amended to read as follows: 25
(2)(A) A cooperative purchasing agreement is limited to public 26
school local government construction services, commodities, and other 27
services for which the public procurement unit may realize savings or 28
material economic value, or both. 29

SECTION 47. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code § 19-61-31
802(b)(2), concerning cooperative purchasing under the Arkansas Procurement 32
Law, is amended to read as follows: 33
(2) The reports required under this subsection shall be 34
submitted by October 1 in the format required by the Legislative Council and 35
shall include the following: 36

(A) The name of the contractor; 1
(B) The name of the procuring agency; 2
(C) The contact information for the contractor and 3
procuring agency; 4
(D) The total cost of the contract, including all 5
available extensions; 6
(E) A description of the public school local government 7
construction services, goods, or other services procured; and 8
(F) Any other information requested by the Legislative 9
Council or the Joint Budget Committee. 10

SECTION 48. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code § 19-61-12
802(d), concerning cooperative purchasing under the Arkansas Procurement Law, 13
is amended to read as follows: 14
(d) If a public procurement unit needs to procure public school local 15
government construction services in excess of the amount provided in § 19-61-16
801(6), the public procurement unit may submit a request for a waiver to the 17
Executive Subcommittee of the Legislative Council. 18

SECTION 49. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 20
authorized by this act shall be limited to the appropriation for such agency 21
and funds made available by law for the support of such appropriations; and 22
the restrictions of the State Procurement Law, the General Accounting and 23
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 24
Procedures and Restrictions Act, or their successors, and other fiscal 25
control laws of this State, where applicable, and regulations promulgated by 26
the Department of Finance and Administration, as authorized by law, shall be 27
strictly complied with in disbursement of said funds. 28

SECTION 50. LEGISLATIVE INTENT. It is the intent of the General 30
Assembly that any funds disbursed under the authority of the appropriations 31
contained in this act shall be in compliance with the stated reasons for 32
which this act was adopted, as evidenced by the Agency Requests, Executive 33
Recommendations and Legislative Recommendations contained in the budget 34
manuals prepared by the Department of Finance and Administration, letters, or 35
summarized oral testimony in the official minutes of the Arkansas Legislative 36

Council or Joint Budget Committee which relate to its passage and adoption. 1

SECTION 51. EMERGENCY CLAUSE. It is found and determined by the 3
General Assembly, that the Constitution of the State of Arkansas prohibits 4
the appropriation of funds for more than a one (1) year period; that the 5
effectiveness of this Act on July 1, 2026 is essential to the operation of 6
the agency for which the appropriations in this Act are provided, and that in 7
the event of an extension of the legislative session, the delay in the 8
effective date of this Act beyond July 1, 2026 could work irreparable harm 9
upon the proper administration and provision of essential governmental 10
programs. Therefore, an emergency is hereby declared to exist and this Act 11
being necessary for the immediate preservation of the public peace, health 12
and safety shall be in full force and effect from and after July 1, 2026. 13
