SHARED SERVICES. 23
(a)(1) The Chief Fiscal Officer of the State may create paying accounts 24
on his or her books and on the books of the Treasurer of the State and 25
Auditor of State for the payment of all personal services and operating 26
expenses of the Department of Agriculture. 27
(2) The Chief Fiscal Officer of the State shall direct the transfer 28
of funds and appropriations to the Shared Services Paying Account 29
appropriation section of this act on the books of the Treasurer of State, the 30
Auditor of State, and the Chief Fiscal Officer of the State. 31
(3) The transfer authority provided to the department in 32
subdivision (a)(2) of this section may be used to make transfers only within 33
the department's appropriation act or between other appropriations acts 34
authorized for the department. 35
(4) The provisions of this section shall be in effect from the date 36

SECTION 67. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 3
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 4
FUND TRANSFER. The Deputy Director of the Board of Animal Health, with prior 5
approval of the Arkansas Legislative Council or the Joint Budget Committee, 6
the approval of the Chief Fiscal Officer of the State, and for the 7
reimbursing of documented expenditures designated by law to be made from the 8
transferred special revenue, may transfer funds among the Animal Health 9
Equine Infectious Anemia Control Fund, Animal Health Disease and Pest Control 10
Fund, Animal Health Special Revenue Fund, Animal Health Commission Swine 11
Testing Fund, and the Poultry and Egg Grading Fund or from these funds to the 12
Animal Health Fund Account. The purpose of these transfers shall only be for 13
accurate allocation of incurred costs between the funds. Requests for fund 14
transfer will at least include the total amount to be transferred, to and 15
from which funds, the nature, purpose, and time period of the expenditures 16
being reimbursed, and any other information requested by the Legislative 17
Council or the Joint Budget Committee. 18
Determining the maximum number of employees and the maximum amount of 19
appropriation and general revenue funding for a state agency each fiscal year 20
is the prerogative of the General Assembly. This is usually accomplished by 21
delineating such maximums in the appropriation act(s) for a state agency and 22
the general revenue allocations authorized for each fund and fund account by 23
amendment to the Revenue Stabilization law. Further, the General Assembly 24
has determined that the Arkansas Agriculture Department - Animal Health may 25
operate more efficiently if some flexibility is provided to the Arkansas 26
Agriculture Department - Animal Health authorizing broad powers under this 27
Section. Therefore, it is both necessary and appropriate that the General 28
Assembly maintain oversight by requiring prior approval of the Legislative 29
Council or Joint Budget Committee as provided by this section. The 30
requirement of approval by the Legislative Council or Joint Budget Committee 31
is not a severable part of this section. If the requirement of approval by 32
the Legislative Council or Joint Budget Committee is ruled unconstitutional 33
by a court of competent jurisdiction, this entire section is void. 34
The provisions of this section shall be in effect only from July 1, 2025 35

SECTION 69. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 30
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 31
PROVISION. If the State Forestry Commission determines that temporary 32
firefighters, dispatchers, or pilots are required to meet the demands of a 33
wildfire season, and upon approval of the Chief Fiscal Officer of the State, 34
appropriations may be transferred from either Extra Help or Professional Fees 35
and Services to the proper character code for the employment of such 36

personnel. 1
If the State Forestry Commission determines that the deployment of air 2
tankers for fighting wildfires requires additional Professional Fees and 3
Services, and upon the approval of the Chief Fiscal Officer of the State, 4
excess appropriation in Regular Salaries or Personal Services Matching may be 5
transferred to Professional Fees and Services in the Operations and Forestry 6
- Rural Community Fire Protection - Federal appropriation sections. 7
If the State Forestry Commission determines that the most effective way for 8
it to cooperate in the growing and distribution of forest planting stock is 9
by contracting work with private vendors and/or hiring temporary employees 10
for seasonal work, the Commission is hereby authorized, upon approval by the 11
Chief Fiscal Officer of the State, to transfer the necessary appropriation 12
authorized for Extra Help and Maintenance and General Operation in the 13
Operations and Forestry - Rural Community Fire Protection - Federal 14
appropriation sections. 15
The provisions of this section shall be in effect only from July 1, 2025 16
2026 through June 30, 2026 2027. 17

SECTION 70. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 19
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 20
REFUND TO EXPENDITURE. The Arkansas Forestry Commission is authorized to 21
charge fees to federal agencies and other states to reimburse the Commission 22
for expenditures made on behalf of these governmental units. These fees 23
shall be deposited into the State Forestry Fund in the State Treasury as a 24
refund to expenditure. 25
The provisions of this section shall be in effect only from July 1, 2025 26
2026 through June 30, 2026 2027. 27

SECTION 71. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 29
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CARRY 30
FORWARD. Notwithstanding any law pertaining to the transfer of year-end fund 31
balances or any law to the contrary, any funds up to $500,000 which remain in 32
the Department of Agriculture Fund Account at the end of a fiscal year shall 33
remain in the Department of Agriculture Fund Account and be made available to 34
fund appropriation(s) authorized by law to be made for maintenance and 35
operating costs associated with wildfire suppression, as well as the purchase 36

of fire suppression equipment for the Forestry Division and made payable from 1
the Department of Agriculture Fund Account for the following fiscal year. 2
Any carry forward of unexpended balance of funding up to $500,000 as 3
authorized herein, may be carried forward under the following conditions: 4
(1) Prior to June 30, 2026 2027, the Agency shall by written statement set 5
forth its reason(s) for the need to carry forward said funding to the 6
Department of Finance and Administration Office of Budget; 7
(2) The Department of Finance and Administration Office of Budget shall 8
report to the Arkansas Legislative Council or Joint Budget Committee all 9
amounts carried forward by the September Arkansas Legislative Council or 10
Joint Budget Committee meeting which report shall include the name of the 11
Agency, Board, Commission or Institution and the amount of the funding 12
carried forward, from the first fiscal year to the second fiscal year, the 13
program name or line item, the funding source of that appropriation and a 14
copy of the written request set forth in (1) above: 15
(3) Each Agency, Board, Commission or Institution shall provide a written 16
report to the Arkansas Legislative Council or Joint Budget Committee 17
containing all information set forth in item (2) above, along with a written 18
statement as so the current status of the project, contract, purpose etc. for 19
which the carry forward was originally requested no later than thirty (30) 20
days prior to the time the Agency, Board, Commission or Institution presents 21
its budget request to the Arkansas Legislative Council/Joint Budget 22
Committee; and 23
(4) Thereupon, the Department of Finance and Administration shall include 24
all information obtained in item (3) above in the budget manuals and/or a 25
statement of noncompliance by the Agency, Board, Commission or Institution. 26
The provisions of this section shall be in effect only from July 1, 2025 2026 27
through June 30, 2026 2027. 28

SECTION 72. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 30
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUND 31
TRANSFER. (A)(1) If the Arkansas Department of Agriculture determines 32
additional funding is required to support the purchase of firefighting 33
equipment and forest fire suppression activities, to include the maintenance 34
and operations costs associated with fire suppression, the Department of 35
Agriculture with prior approval of the Chief Fiscal Officer of the State, may 36

transfer the sum of one million one hundred eighty thousand one hundred 1
dollars ($1,180,100) of the amount authorized for transfer by Act 154 of 2
2012, to the State Forestry Fund. 3
(2) The transfer authority provided to the department in subdivision (A)(1) 4
of this section may be used in furtherance of the State Forestry Trust 5
Program. 6
(3) The provisions of this section shall be in effect from the date of 7
passage through June 30, 2026 2027. 8

SECTION 73. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 10
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 11
REALLOCATION OF RESOURCES. The Department of Agriculture provides a wide 12
range of services to all Arkansans. The specific service needs, along with 13
staffing required to meet them, can vary significantly due to factors such as 14
natural disasters, changing federal mandates, and job market variations like 15
wildland firefighters, dispatchers, foresters, engineers, and 16
microbiologists' shortages. These factors make it challenging for the 17
Department to accurately predict the exact needs for positions across its 18
different appropriations throughout any fiscal year. To respond swiftly to 19
changing needs and to utilize resources effectively, the Department of 20
Agriculture is authorized to reallocate resources as necessary. Upon 21
determining that a reallocation is essential for the efficient and effective 22
operation of the department, the Secretary of the Department of Agriculture, 23
with the approval of the Chief Fiscal Officer of the State and Legislative 24
Council or the Joint Budget Committee, if meeting in Legislative Session, may 25
request to transfer positions between existing business areas of the 26
department. Transfer authority shall be limited to no more than 5% of the 27
total authorized department positions in any fiscal year. 28
Determining the maximum number of employees and the maximum amount of 29
appropriation and general revenue funding for a state agency each fiscal year 30
is the prerogative of the General Assembly. This is usually accomplished by 31
delineating such maximums in the appropriation act(s) for a state agency and 32
the general revenue allocations authorized for each fund and fund account by 33
amendment to the Revenue Stabilization law. Further, the General Assembly has 34
determined that the Department of Agriculture may operate more efficiently if 35
some flexibility is provided to the Department of Agriculture authorizing 36

broad powers under the Reallocation of Resources provisions herein. 1
Therefore, it is both necessary and appropriate that the General Assembly 2
maintain oversight by requiring prior approval of the Legislative Council or 3
Joint Budget Committee as provided by this section. The requirement of 4
approval by the Legislative Council or Joint Budget Committee is not a 5
severable part of this section. If the requirement of approval by the 6
Legislative Council or Joint Budget Committee is ruled unconstitutional by a 7
court jurisdiction, this entire section is void. 8
The provisions of this section shall be in effect only from July 1, 9
2025 2026 through June 30, 2026 2027. 10

SECTION 74. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 12
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 13
TRANSFER PROVISION - NRC. At the end of each fiscal year, the Chief Fiscal 14
Officer of the State shall authorize the transfer of obligated water, sewer, 15
and solid waste funds, as provided in the appropriation act for the Natural 16
Resources Commission in the appropriation entitled "Water, Sewer and Solid 17
Waste - State", from the Miscellaneous Agencies Fund Account, to the Water, 18
Sewer and Solid Waste Revolving Fund. 19
The provisions of this section shall be in effect only from July 1, 2025 20
2026 through June 30, 2026 2027. 21

SECTION 75. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 23
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CARRY 24
FORWARD - NRC. At the end of each fiscal year, the Chief Fiscal Officer of 25
the State shall authorize the carry forward of funds to support the amount of 26
obligated grants that are certified by the Natural Resources Commission for 27
Matching Grants in the appropriation entitled "Water Quality Plan 28
Implementation". 29
Any carry forward of unexpended balance of funding as authorized herein, may 30
be carried forward under the following conditions: 31
(1) Prior to June 30, 2026 2027 the Agency shall by written statement set 32
forth its reason(s) for the need to carry forward said funding to the 33
Department of Finance and Administration Office of Budget; 34
(2) The Department of Finance and Administration Office of Budget shall 35
report to the Arkansas Legislative Council all amounts carried forward by the 36

September Arkansas Legislative Council or Joint Budget Committee meeting 1
which report shall include the name of the Agency, Board, Commission or 2
Institution and the amount of the funding carried forward from the first 3

funding source of that appropriation and a copy of the written request set 5
forth in (1) above; 6
(3) Each Agency, Board, Commission or Institution shall provide a written 7
report to the Arkansas Legislative Council or Joint Budget Committee 8
containing all information set forth in item (2) above, along with a written 9
statement as to the current status of the project, contract, purpose etc. for 10
which the carry forward was originally requested no later than thirty (30) 11
days prior to the time the Agency, Board, Commission or Institution presents 12
its budget request to the Arkansas Legislative Council/Joint Budget 13
Committee; and 14
(4) Thereupon, the Department of Finance and Administration shall include 15
all information obtained in item (3) above in the budget manuals and/or a 16
statement of non-compliance by the Agency, Board, Commission or Institution. 17
The provisions of this section shall be in effect only from July 1, 2025 18
2026 through June 30, 2026 2027. 19

SECTION 77. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 19
authorized by this act shall be limited to the appropriation for such agency 20
and funds made available by law for the support of such appropriations; and 21
the restrictions of the State Procurement Law, the General Accounting and 22
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 23
Procedures and Restrictions Act, or their successors, and other fiscal 24
control laws of this State, where applicable, and regulations promulgated by 25
the Department of Finance and Administration, as authorized by law, shall be 26
strictly complied with in disbursement of said funds. 27

SECTION 78. LEGISLATIVE INTENT. It is the intent of the General 29
Assembly that any funds disbursed under the authority of the appropriations 30
contained in this act shall be in compliance with the stated reasons for 31
which this act was adopted, as evidenced by the Agency Requests, Executive 32
Recommendations and Legislative Recommendations contained in the budget 33
manuals prepared by the Department of Finance and Administration, letters, or 34
summarized oral testimony in the official minutes of the Arkansas Legislative 35
Council or Joint Budget Committee which relate to its passage and adoption. 36

SECTION 79. EMERGENCY CLAUSE. It is found and determined by the 2
General Assembly, that the Constitution of the State of Arkansas prohibits 3
the appropriation of funds for more than a one (1) year period; that the 4
effectiveness of this Act on July 1, 2026 is essential to the operation of 5
the agency for which the appropriations in this Act are provided, and that in 6
the event of an extension of the legislative session, the delay in the 7
effective date of this Act beyond July 1, 2026 could work irreparable harm 8
upon the proper administration and provision of essential governmental 9
programs. Therefore, an emergency is hereby declared to exist and this Act 10
being necessary for the immediate preservation of the public peace, health 11
and safety shall be in full force and effect from and after July 1, 2026. 12
