SECTION 22. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 13
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. DOMESTIC 14
VIOLENCE SHELTER GRANTS. The grants authorized in the Domestic Violence 15
Shelter Programs and Grants appropriation section of this act shall be 16
equally distributed to domestic violence shelters as determined by the 17
Arkansas Child Abuse/Rape/Domestic Violence Commission. The Arkansas Child 18
Abuse/Rape/Domestic Violence Commission may adopt rules and regulations to 19

SECTION 23. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 26

SCHOOL LIMITATION. Nothing in this Act shall create an additional medical 28
school in the State of Arkansas, but it recognizes that appropriations, 29
funding and allocations in this Act may be used by the University of Arkansas 30
for Medical Sciences to support satellite campuses or programs outside the 31
City of Little Rock in order to conduct or continue training of its medical, 32
nursing, pharmacy and allied health students, as well as its medical 33
residents. 34
The provisions of this section shall be in effect only from July 1, 2025 35

SECTION 24. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 2
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. ARKANSAS 3
CHILDREN'S HOSPITAL AND TRANSFER AUTHORIZED. Thirty-three and one-third 4
percent (33-1/3%), in each fiscal year, of the amounts made available to fund 5
the appropriation in the Grants to Children's Hospital, Regular Salaries and 6
Operating Expenses for Indigent Care line item of the Operations 7
appropriation section of this Act shall be distributed to the Arkansas 8
Children's Hospital or Arkansas Children's Hospital may request that the 9
University of Arkansas for Medical Sciences transfer such funds each fiscal 10
year from the University of Arkansas Medical Center Fund to the Department of 11
Human Services Grants Fund Account. The transferred funds shall be used to 12
match federal funds used for supplemental Medicaid payments to Arkansas 13
Children's Hospital. 14
The provisions of this section shall be in effect only from July 1, 2025 15
2026 through June 30, 2026 2027. 16

SECTION 25. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 18
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CARRY 19
FORWARD. Any unexpended balance of the general revenue funds provided by this 20
Act which remains at the close of a fiscal year, not to exceed ten percent 21
(10%) of funded appropriations, shall be carried forward and made available 22
for the same purposes for the next fiscal year. 23
Any carry forward of unexpended balance of funding as authorized herein, 24
may be carried forward under the following conditions: 25
(1) Prior to June 30, 2026 2027 the Agency shall by written statement set 26
forth its reason(s) for the need to carry forward said funding to the 27
Department of Finance and Administration Office of Budget; 28
(2) The Department of Finance and Administration Office of Budget shall 29
report to the Arkansas Legislative Council all amounts carried forward by the 30
September Arkansas Legislative Council or Joint Budget Committee meeting 31
which report shall include the name of the Agency, Board, Commission or 32
Institution and the amount of the funding carried forward, the program name 33
or line item, the funding source and a copy of the written request set forth 34
in (1) above; 35
(3) Each Agency, Board, Commission or Institution shall provide a written 36

report to the Arkansas Legislative Council or Joint Budget Committee 1
containing all information set forth in item (2) above, along with a written 2
statement as to the current status of the project, contract, purpose, etc. 3
for which the carry forward was originally requested no later than thirty 4
(30) days prior to the time the Agency, Board, Commission or Institution 5
presents its budget request to the Arkansas Legislative Council/Joint Budget 6
Committee; and 7
(4) Thereupon, the Department of Finance and Administration shall include 8
all information obtained in item (3) above in the budget manuals and/or a 9
statement of non-compliance by the Agency, Board, Commission or Institution. 10
The provisions of this section shall be in effect only from July 1, 2025 11
2026 through June 30, 2026 2027. 12

SECTION 26. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 14
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 15
ESTABLISHMENT OF A "GROWTH POOL". (a) The Arkansas Division of Higher 16
Education shall establish and maintain for the 2025-2026 2026-2027 fiscal 17
year a pool of six hundred (600) non-classified positions. A position 18
established under this section shall not exceed the salary rate of the 19
highest maximum annual salary rate authorized by the General Assembly in the 20
institution's appropriation act. These positions are to be used by the 21
University of Arkansas for Medical Sciences in the event that the personal 22
services needs of the University during the 2025-2026 2026-2027 fiscal year 23
exceed the number of positions allocated to the University by the 24
Legislature. The University shall provide justification to the Arkansas 25
Division of Higher Education for the need to allocate titles from this 26
"growth pool". No titles will be assigned to the pool until such time as 27
specific positions are requested by the University, approved by the 28
University Board or their designee, and approved by the Legislative Council 29
or Joint Budget Committee. 30
(b) Determining the number of personnel to be employed by a state agency 31
is the prerogative of the General Assembly and is usually accomplished by 32
delineating the maximum number of personnel by identifying the job titles and 33
the maximum grade or salary attached to those salaries. The General Assembly 34
has determined that the University of Arkansas for Medical Sciences could be 35
operated more efficiently if some flexibility is given to that institution. 36

That flexibility is being accomplished by providing growth pools in 1
subsection (a) of this section and since the General Assembly has granted the 2
institution broad powers under the growth pool concept, it is both necessary 3
and appropriate that the General Assembly maintain oversight of the 4
utilization of the growth pool by requiring prior approval of the Legislative 5
Council or Joint Budget Committee in the utilization of the growth pool. 6
Therefore, the requirement of approval by the Legislative Council or Joint 7
Budget Committee is not a severable part of this section. If the requirement 8
of approval by the Legislative Council or Joint Budget Committee is ruled 9
unconstitutional by a court of competent jurisdiction, this entire section is 10
void. 11
If the agency requests continuation of a "Growth Pool" position(s) as 12
established herein during the next fiscal year, the position(s) must be 13
requested as a new position(s) in the agency's budget request. 14
The provisions of this section shall be in effect only from July 1, 2025 15
2026 through June 30, 2026 2027. 16

SECTION 27. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 18
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CHILD 19
HEALTH AND FAMILY LIFE INSTITUTE. The Child Health and Family Life Institute 20
shall be administered under the direction of Arkansas Children’s Hospital. 21
Arkansas Children’s Hospital shall enter into a cooperative agreement and/or 22
contract with the University of Arkansas for Medical Sciences-Department of 23
Pediatrics for services required to deliver the programs of the Child Health 24
and Family Life Institute (CHFLI). Utilizing a multidisciplinary 25
collaboration of professionals, CHFLI shall provide a statewide effort to 26
explore, develop and evaluate new and better ways to address medically, 27
socially and economically interrelated health and developmental needs of 28
children with special health care needs and their families. CHFLI priorities 29
shall include, but are not limited to, wellness and prevention, screening and 30
diagnosis, treatment and intervention, training and education and research 31
and evaluation. Arkansas Children’s Hospital and the University of Arkansas 32
for Medical Sciences-Department of Pediatrics shall make annual reports to 33
the Arkansas Legislative Council on all matters of funding, existing programs 34
and services offered through CHFLI. 35
The provisions of this section shall be in effect only from July 1, 2025 36

SECTION 28. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 3
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. PARKING 4
FEES. On July 1 of each year the University of Arkansas for Medical Sciences 5
shall pay from the appropriation provided herein from non-general revenue, 6
the total amount appropriated for War Memorial Parking Services from Fees to 7
War Memorial. 8
The provisions of this section shall be in effect only from July 1, 2025 9
2026 through June 30, 2026 2027. 10

SECTION 29. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 12
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 13
PROVISIONS. Because the Rural Medical Practice Student Loan and Scholarship 14
Program Loans and/or Scholarships and the Community Match Student Loan and 15
Scholarship Program Loans and/or Scholarships have the goal of providing 16
primary care physicians in rural Arkansas, transfers may be made in such 17
amounts as are required between the line items made in the appropriation for 18
"Medical Loans and Scholarships". 19
The provisions of this section shall be in effect only from July 1, 2025 20
2026 through June 30, 2026 2027. 21

SECTION 30. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 23
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CLINICAL 24
EXPANSION AND RESEARCH POOL. (a) In order to address personnel needs emerging 25
from expanding medical research and patient care issues and the necessity of 26
recruiting and retaining qualified medical, research, and related support 27
personnel, the University of Arkansas for Medical Sciences or its successor 28
is authorized for the 2025-2026 2026-2027 fiscal year a pool of seven hundred 29
(700) "Clinical Expansion and Research Pool" positions. These positions are 30
to be used by the University of Arkansas for Medical Sciences in the event 31
that the personal services needs resulting from unanticipated clinical or 32
research programs that are initiated during the 2025-2026 2026-2027 fiscal 33
year require additional positions, either in title, in classification, or in 34
number, that are not authorized or contemplated by the General Assembly in 35
the Regular Salaries - Operations section of this Act. 36

(b) The University of Arkansas for Medical Sciences is authorized to 1
access the "Clinical Expansion and Research Pool" positions authorized in 2
this Section at any time during the fiscal year when it is determined by the 3
Chancellor of the University of Arkansas for Medical Sciences, subject to the 4
review and approval by the Board of Trustees, that the need for additional 5
positions exists. Only medical or research positions shall be established 6
under this provision. The Chancellor of the University of Arkansas for 7
Medical Sciences shall provide a quarterly report detailing the justification 8
of allocation of positions from this "Clinical Expansion and Research Pool" 9
to the Chief Fiscal Officer of the State, to the Arkansas Division of Higher 10
Education, and to the Arkansas Legislative Council or Joint Budget Committee 11
for review. The report shall also include an accounting of the names, titles 12
and salaries of personnel who have been employed in positions established 13
from this pool and the source and duration of funds associated with the 14
positions. 15
(c) If the University of Arkansas for Medical Sciences requests 16
continuation of any "Clinical Expansion and Research Pool" position(s) as 17
established herein during the next fiscal year, the position(s) must be 18
requested as a new position(s) in the agency's budget request. 19
(d) Determining the number of personnel to be employed by a state agency 20
is the prerogative of the General Assembly and is usually accomplished by 21
delineating the maximum number of personnel by identifying job titles and the 22
maximum grade or salary attached to those titles. The General Assembly has 23
determined that the University of Arkansas for Medical Sciences could be 24

of the position pool by requiring review of the Legislative Council or Joint 30
Budget Committee in the utilization of the position pool. Therefore, the 31
requirement of review by the Legislative Council or Joint Budget Committee is 32
not a severable part of this section. If the requirement of review by the 33
Legislative Council or Joint Budget Committee is ruled unconstitutional by a 34
court of competent jurisdiction, this entire section is void. 35
The provisions of this section shall be in effect only from July 1, 2025 36

SECTION 31. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 3
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. ABUSED 4
CHILDREN AND ADOLESCENTS SERVICES PROGRAM FUNDING PROVISION. In the event 5
the amount of general revenue distributed to the University of Arkansas 6
Medical Center Fund for the Department of Pediatrics and the Psychiatric 7
Research Institute each fiscal year is at least equal to the amount 8
distributed during the 2012-13 fiscal year, an amount not less than seven 9
hundred thousand dollars ($700,000) shall be allocated and made available as 10
follows: four hundred fifty thousand dollars ($450,000) each fiscal year 11
shall be made available exclusively to support the purposes and goals to 12
improve screening, monitoring and care for abused children and adolescents 13
through the Child Safety Centers or the University of Arkansas for Medical 14
Sciences as referred by the Child Safety Centers. Maintenance of statewide 15
screening and assessment protocols as well as evidence-based training of 16
mental health professionals are to be considered critical components of the 17
overall goals. For the provision of assessment and therapeutic services, 18
these funds are to be provided to the Child Safety Centers through contracts 19
from the University of Arkansas for Medical Sciences. The contracts will 20
stipulate the terms of the agreement and reporting requirements; an amount 21
not to exceed fifty thousand dollars ($50,000) may be utilized for 22
administrative costs as may be necessary to administer the program or if 23
determined not to be needed for administrative costs may be placed in reserve 24
for future needs of the program. The remaining two hundred thousand dollars 25
($200,000) shall be allocated and made available to the Department of 26
Pediatrics for expenses for medical examinations, consultation, education and 27
training as stipulated in the terms of agreement between the Chancellor of 28
the University of Arkansas for Medical Sciences and the Department of 29
Pediatrics. 30
The provisions of this section shall be in effect only from July 1, 2025 31

SECTION 32. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 34
authorized by this act shall be limited to the appropriation for such agency 35
and funds made available by law for the support of such appropriations; and 36

the restrictions of the State Procurement Law, the General Accounting and 1
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 2
Procedures and Restrictions Act, the Higher Education Expenditure Restriction 3
Act, or their successors, and other fiscal control laws of this State, where 4
applicable, and regulations promulgated by the Department of Finance and 5
Administration, as authorized by law, shall be strictly complied with in 6
disbursement of said funds. 7

SECTION 33. LEGISLATIVE INTENT. It is the intent of the General 9
Assembly that any funds disbursed under the authority of the appropriations 10
contained in this act shall be in compliance with the stated reasons for 11
which this act was adopted, as evidenced by the Agency Requests, Executive 12
Recommendations and Legislative Recommendations contained in the budget 13
manuals prepared by the Department of Finance and Administration, letters, or 14
summarized oral testimony in the official minutes of the Arkansas Legislative 15
Council or Joint Budget Committee which relate to its passage and adoption. 16

SECTION 34. EMERGENCY CLAUSE. It is found and determined by the 18
General Assembly, that the Constitution of the State of Arkansas prohibits 19
the appropriation of funds for more than a one (1) year period; that the 20
effectiveness of this Act on July 1, 2026 is essential to the operation of 21
the agency for which the appropriations in this Act are provided, and that in 22
the event of an extension of the legislative session, the delay in the 23
effective date of this Act beyond July 1, 2026 could work irreparable harm 24
upon the proper administration and provision of essential governmental 25
programs. Therefore, an emergency is hereby declared to exist and this Act 26
being necessary for the immediate preservation of the public peace, health 27
and safety shall be in full force and effect from and after July 1, 2026. 28
