BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22

SECTION 1. The purpose of this act is to amend the Revenue 24
Stabilization Law and to create funds, and to make transfers to and from 25
funds and fund accounts. 26

SECTION 2. Arkansas Code 19-23-101 is amended to read as follows: 28
19-23-101. Allocations for fiscal year 2026-2027 and thereafter. 29
Commencing with the fiscal year beginning July 1, 2026, and each fiscal year 30
thereafter, the Treasurer of State shall transfer all remaining general 31
revenues available for distribution on the last day of business in July 2026, 32
and on the last day of business in each calendar month thereafter during the 33
fiscal year to the various funds and fund accounts participating in general 34
revenues in the proportions of the maximum allocation as the individual 35
allocation to the fund or fund account bears to the total of the maximum 36

allocation as provided in § 19-23-101 (a) and (b). 1

SECTION 3. Arkansas Code 19-23-102 is amended to read as follows: 3
19-23-102. Maximum allocations of revenues for fiscal year 2026-2027 and 4
thereafter. 5
(a) ALLOCATION A. The Treasurer of State shall first make monthly allocations 6
in the proportions set out in this subsection to the funds and fund accounts 7
listed below until there has been transferred a total of six billion six 8
hundred forty four million four hundred twenty three thousand three hundred 9
forty-eight dollars ($6,644,423,348) or so much thereof as may become 10
available; provided, that the Treasurer of State shall make such monthly 11
allocations in accordance with each fund or fund account's proportionate part 12
of the total of all such allocations set forth in this subsection: 13

SECTION 4. TEMPORARY LANGUAGE. DO NOT CODIFY. FUNDING TRANSFER - 16
MEDICAID SUSTAINABILITY SET-ASIDE. 17
(a) Immediately upon the effective date of this act or as soon as is 18
practical after all transfers from the General Revenue Allotment Reserve Fund 19
enacted by the 95th General Assembly meeting in the 2026 Fiscal Session are 20
transferred, the Chief Fiscal Officer of the State shall transfer on his or 21
her books and those of the Treasurer of State and the Auditor of the State 22
the sum of one hundred million dollars ($100,000,000) from the General 23
Revenue Allotment Reserve Fund to the Medicaid Sustainability Set-Aside in 24
the Restricted Reserve Fund. 25
(b) Funds transferred in subsection (a) of this section shall be in 26
addition to those remaining balances currently available in the Medicaid 27
Sustainability Set-Aside established in Section 3 (a)(2) of Act 1017 of 2025 28
and any other funds made available by the General Assembly. 29
(c) On July 1, 2027 all unobligated funds remaining in the Medicaid 30
Sustainability Set-Aside in the Restricted Reserve Fund shall be transferred 31
to the General Revenue Allotment Reserve Fund. 32

SECTION 5. TEMPORARY LANGUAGE. DO NOT CODIFY. FUNDING TRANSFER - 34
CHILDREN'S EDUCATIONAL FREEDOM ACCOUNT SET-ASIDE. 35
(a) Immediately upon the effective date of this act or as soon as is 36

practical after all transfers from the General Revenue Allotment Reserve Fund 1
enacted by the 95th General Assembly meeting in the 2026 Fiscal Session are 2
transferred, the Chief Fiscal Officer of the State shall transfer on his or 3
her books and those of the Treasurer of State and the Auditor of the State 4
the sum of seventy million dollars ($70,000,000) from the General Revenue 5
Allotment Reserve Fund to the Children's Educational Freedom Account Set-6
Aside in the Restricted Reserve Fund. 7
(b) Funds transferred in subsection (a) of this section shall be in 8
addition to those remaining balances currently available in the Children's 9
Educational Freedom Account Set-Aside established in Section 3 (a)(3) of Act 10
1017 of 2025 and any other funds made available by the General Assembly. 11
(c) On July 1, 2027 all unobligated funds remaining in the Children's 12
Educational Freedom Account Set-Aside in the Restricted Reserve Fund shall be 13
transferred to the General Revenue Allotment Reserve Fund. 14

SECTION 6. TEMPORARY LANGUAGE. DO NOT CODIFY. FUNDING TRANSFER - 16
VARIOUS GENERAL DISCRETIONARY MAJORITY VOTE SET-ASIDE. 17
(a) Immediately upon the effective date of this act or as soon as is 18
practical after all transfers from the General Revenue Allotment Reserve Fund 19
enacted by the 95th General Assembly meeting in the 2026 Fiscal Session are 20
transferred, the Chief Fiscal Officer of the State shall transfer on his or 21
her books and those of the Treasurer of State and the Auditor of the State 22
the sum of forty three million seven hundred thousand dollars ($43,700,000) 23
from the General Revenue Allotment Reserve Fund to the Various General 24
Discretionary Majority Vote Set-Aside in the Restricted Reserve Fund. 25
(b) Funds transferred in subsection (a) of this section shall be in 26
addition to those remaining balances currently available in the Various 27
General Discretionary Majority Vote Set-Aside established in Section 3 (a)(4) 28
of Act 1017 of 2025 and any other funds made available by the General 29
Assembly. 30
(c) On July 1, 2027 all unobligated funds remaining in the Various 31
General Discretionary Majority Vote Set-Aside in the Restricted Reserve Fund 32
shall be transferred to the General Revenue Allotment Reserve Fund. 33

SECTION 7. TEMPORARY LANGUAGE. DO NOT CODIFY. FUNDING TRANSFER - 35
MOTOR VEHICLE SET-ASIDE. 36

(a) Immediately upon the effective date of this act or as soon as is 1
practical after all transfers from the General Revenue Allotment Reserve Fund 2
enacted by the 95th General Assembly meeting in the 2026 Fiscal Session are 3
transferred, the Chief Fiscal Officer of the State shall transfer on his or 4
her books and those of the Treasurer of State and the Auditor of the State 5
the sum of five million dollars ($5,000,000) from the General Revenue 6
Allotment Reserve Fund to the Motor Vehicle Set-Aside in the Restricted 7
Reserve Fund. 8
(b) Funds transferred in subsection (a) of this section shall be in 9
addition to those remaining balances currently available in the Motor Vehicle 10
Set-Aside established in Section 3 (a)(7) of Act 1017 of 2025 and any other 11
funds made available by the General Assembly. 12
(c) On July 1, 2027 all unobligated funds remaining in the Motor 13
Vehicle Set-Aside in the Restricted Reserve Fund shall be transferred to the 14
General Revenue Allotment Reserve Fund. 15

SECTION 8. TEMPORARY LANGUAGE. DO NOT CODIFY. ECONOMIC DEVELOPMENT 17
FUNDING TRANSFER. Immediately upon the effective date of this section and 18
notwithstanding any other provisions of law, the Chief Fiscal Officer of the 19
State may transfer from time to time as funds are determined to be available 20
by the Chief Fiscal Officer of the State, on his or her books and those of 21
the Treasurer of State and the Auditor of the State, a sum not to exceed one 22
hundred fifty million dollars ($150,000,000) from the General Revenue 23
Allotment Reserve Fund to the Economic Development Incentive Quick Action 24
Closing Fund, for the Department of Commerce - Arkansas Economic Development 25
Commission, for economic incentives applicable to an advanced manufacturing, 26
non-data center, facility to be located in West Memphis, Arkansas. Prior to 27
the Chief Fiscal Officer of the State transferring any funds under this 28
section, the Secretary of the Arkansas Department of Commerce shall certify 29
to the Chief Fiscal Officer of the State that the Arkansas Economic 30
Development Commission has entered into a definitive incentive agreement with 31
the Manufacturer that has a positive cost benefit calculation and obligations 32
should the Manufacturer fail to satisfy requirements set forth in the 33
incentive agreement. 34

SECTION 9. TEMPORARY LANGUAGE. DO NOT CODIFY. ECONOMIC DEVELOPMENT 36

FUNDING TRANSFER - PUBLIC HIGHWAY IMPROVEMENTS. Immediately upon the 1
effective date of this section and notwithstanding any other provisions of 2
law, the Chief Fiscal Officer of the State may transfer from time to time as 3
funds are determined to be available by the Chief Fiscal Officer of the 4
State, on his or her books and those of the Treasurer of State and the 5
Auditor of the State, a sum not to exceed one hundred fifty million dollars 6
($150,000,000) from the General Revenue Allotment Reserve Fund to the 7
Economic Development Incentive Quick Action Closing Fund, for the Department 8
of Commerce - Arkansas Economic Development Commission, for public highway 9
and other public road improvements necessary for the construction and 10
operation of the advanced manufacturing facility referenced in Section 8 of 11
this Act. Prior to the Chief Fiscal Officer of the State transferring any 12
funds under this section, the Director of the Arkansas Department of 13
Transportation shall provide the Chief Fiscal Officer of the State an 14
estimate of the funding necessary to complete the public highway and public 15
road improvements after taking into account other funding available for the 16
cost of the improvements, including any federal funding. 17

SECTION 10. DO NOT CODIFY. DUPLICATE ACTS. If HB1100 and SB75 of the 19
2026 Fiscal Session of the 95th General Assembly are both enacted and adopted 20
by the 95th General Assembly in identical form, then the last act passed or 21
latest expression shall supersede the other. 22

SECTION 11. EMERGENCY CLAUSE. It is found and determined by the 24
General Assembly of the State of Arkansas that changes in the state's fiscal 25
laws must take effect at the beginning of the fiscal year; and that it is 26
necessary for this act to become effective on July 1, 2026 to avoid a lapse 27
in critical and essential services that the state government provides to the 28
citizens of this state at the beginning of the next fiscal year; with the 29
exception sections 8 and 9 of this act shall be in full force and effect from 30
and after the date of its passage and approval. Therefore, an emergency is 31
declared to exist, and this act being necessary for the preservation of the 32
public peace, health, and safety shall become effective on July 1, 2026; with 33
the exception sections 8 and 9 of this act shall be in full force and effect 34
from and after the date of its passage and approval. 35
