FOR OTHER PURPOSES. 36

TO PROHIBIT THE USE OF A COMPUTER MANUFACTURED OR ASSEMBLED BY A COVERED 2
FOREIGN ENTITY IN DIGITAL ASSET MINING; AND TO PROHIBIT THE USE OF SOFTWARE 3
DEVELOPED BY A COVERED FOREIGN ENTITY IN DIGITAL ASSET MINING. 4

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 6

SECTION 1. Arkansas Code § 14-1-603, concerning definitions under the 8
Arkansas Data Centers Act of 2023, is amended to add an additional 9
subdivision to read as follows: 10
(13) "Covered foreign entity" means an individual, foreign 11
government, or a party other than an individual or foreign government: 12
(A) On the Consolidated Screening List or Entity List as 13
designated by the United States Secretary of Commerce; 14
(B) Domiciled in the People's Republic of China or the 15
Russian Federation; 16
(C) Under the influence of or control by the government of 17
the People's Republic of China or the Russian Federation; or 18
(D) That is a subsidiary or affiliate of an individual, 19
government, or party referred to in subdivisions (13)(A)-(C) of this section. 20

SECTION 2. Arkansas Code Title 14, Chapter 1, Subchapter 6, is amended 22
to add an additional section to read as follows: 23
14-1-607. Use of computer manufactured by covered foreign entity or 24
software developed by covered foreign entity prohibited — Penalty. 25
(a) A digital asset mining business or digital asset miner shall not 26
use in the course of digital asset mining or home digital asset mining: 27
(1) A computer that is manufactured or assembled by a covered 28
foreign entity; or 29
(2) Software that is developed by a covered foreign entity. 30
(b) A digital asset mining business or digital asset miner in 31
violation of this section upon conviction is guilty of a: 32
(1) Class A misdemeanor for a first offense; and 33
(2) Class D felony for a second or subsequent offense." 34
