Public Disclosure of Gas Price Impact Estimates

This law requires the State Air Resources Board to provide public estimates of how new or changed regulations might affect retail gasoline prices before those changes are made.

What This Bill Does

  • Requires the State Air Resources Board to consult with the State Energy Resources Conservation and Development Commission before adopting or amending a regulation that imposes costs on gasoline refiners, distributors, or retailers.
  • Before making new rules that cost money for gas companies, the board must share an estimate of how these costs might affect what people pay at the pump.
  • This estimate includes the highest possible price increase if all extra costs are passed on to customers.
  • The information must be available online so everyone can see it.

Official Summary Text

AB 41, as introduced, Macedo.
State Air Resources Board: regulations: impact estimates: retail gasoline prices: public disclosure.
Existing law designates the State Air Resources Board as the state agency responsible for the preparation of the state implementation plan required by the Clean Air Act, and requires the state board to adopt standards, rules, and regulations that are consistent with the state goal of providing a decent home and suitable living environment for every Californian.
This bill would require the state board, in consultation with the State Energy Resources Conservation and Development Commission, before adopting or amending a regulation that imposes costs on gasoline refiners, distributors, or retailers, to make available to the public, including on its internet website, an estimate of the impact on retail gasoline prices due to the proposed new regulation or the existing regulation and the proposed amendments to that regulation. The
bill would require the estimate to include a maximum estimated impact on retail gasoline prices that assumes the maximum possible cost imposed, as specified, and that all costs are passed on to consumers.
