Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. In Colorado Revised Statutes, 24-31-101, amend2
(1)(v) and (1)(w); and add (1)(x) as follows:3
24-31-101. Powers and duties of attorney general - notice to4
revisor of statutes - repeal.5
(1) The attorney general:6
(v) May expend money, manage staff, and perform other7
administrative functions essential for the operation of a district attorney's8
office when appointed by executive order of the governor; and9
(w) May conduct jail assessments in collaboration with the jail10
standards advisory committee, created pursuant to section 30-10-530,11
pursuant to section 24-31-118; AND12
(x) (I) SHALL SUBMIT TO THE PEACE OFFICERS STANDARDS AND13

TRAINING BOARD A PROPOSAL BY DECEMBER 31, 2030, TO UPDATE1
CURRENT BASIC, RESERVE, AND REFRESHER LAW ENFORCEMENT TRAINING2
ACADEMY PROGRAMS AND IMPROVE THE PEACE OFFICER PERFORMANCE OF3
FUTURE ACADEMY GRADUATES. IF THE P.O.S.T. BOARD DOES NOT ACCEPT4
THE PROPOSAL, THE ATTORNEY GENERAL SHALL SUBMIT A NEW PROPOSAL5
WITHIN ONE YEAR AFTER THE DATE THE P.O.S.T. BOARD DID NOT ACCEPT6
THE PROPOSAL.7
(II) THIS SUBSECTION (1)(x) IS REPEALED IF:8
(A) T HE PEACE OFFICERS STANDARDS AND TRAINING BOARD9
APPROVES A COMPREHENSIVE UPDATE TO LAW ENFORCEMENT TRAINING10
ACADEMY PROGRAMS; AND11
(B) THE CHAIR OF THE PEACE OFFICERS STANDARDS AND TRAINING12
BOARD NOTIFIES THE REVISOR OF STATUTES IN WRITING OF THE DATE13
WHEN THE CONDITIONS SPECIFIED IN THIS SUBSECTION (1)(x)(II) HAVE14
OCCURRED BY EMAILING THE NOTICE TO15
REVISOROFSTATUTES.GA@COLEG.GOV.16
(III) THIS SUBSECTION (1)(x) IS REPEALED, EFFECTIVE UPON THE17
DATE IDENTIFIED IN THE NOTICE DESCRIBED IN SUBSECTION (1)(x)(II) OF18
THIS SECTION OR, IF THE NOTICE DOES NOT SPECIFY A DATE , UPON THE19
DATE OF THE NOTICE TO THE REVISOR OF STATUTES.20
SECTION 2. In Colorado Revised Statutes, 24-31-302, amend21
(3)(a); and add (3)(e) as follows:22
24-31-302. Creation of board - members.23
(3) (a) The P.O.S.T. board consists of twenty-four TWENTY-EIGHT24
members. The chair of the P.O.S.T. board is the attorney general OR THE25
ATTORNEY GENERAL'S DESIGNEE, and the board shall annually elect from26
its members a vice-chair. THE CHAIR AND VICE-CHAIR MAY SOLICIT27

ADDITIONAL EXPERTISE AND PARTICIPATION FROM NONVOTING PERSONS1
AS MAY FURTHER THE DUTIES OF THE P.O.S.T. BOARD. The other members2
shall be ARE:3
(I) The special agent in charge of the Denver division of the4
federal bureau of investigation;5
(II) The executive director of the department of public safety or6
the executive director's designee;7
(III) The following members appointed by the governor for terms8
of three years:9
(A) One local government representative;10
(B) Six FIVE active chiefs of police from municipalities of this11
state or state institutions of higher education OF WHICH ONE MUST BE12
FROM AN URBAN MUNICIPALITY , ONE MUST BE FROM A SUBURBAN13
MUNICIPALITY, ONE MUST BE FROM A COLLEGE OR UNIVERSITY POLICE14
DEPARTMENT, AND ONE MUST BE FROM A RURAL MUNICIPALITY , AFTER15
THE GOVERNOR CONSULTS WITH A STATEWIDE ORGANIZATION16
REPRESENTING CHIEFS OF POLICE;17
(C) Six FIVE active sheriffs from counties of this state OF WHICH18
ONE MUST BE FROM AN URBAN COUNTY, ONE MUST BE FROM A SUBURBAN19
COUNTY, AND ONE MUST BE FROM A RURAL COUNTY , AFTER THE20
GOVERNOR CONSULTS WITH A STATEWIDE ORGANIZATION REPRESENTING21
SHERIFFS;22
(D) Three SIX active peace officers with a rank of sergeant or23
below, and AFTER THE GOVERNOR CONSULTS WITH A STATEWIDE24
ORGANIZATION REPRESENTING LINE-LEVEL PEACE OFFICERS;25
(E) O NE REPRESENTATIVE OF A STATEWIDE ORGANIZATION26
REPRESENTING PEACE OFFICERS WITH A RANK OF SERGEANT OR BELOW;27

(F) T WO ACTIVE P.O.S.T.-CERTIFIED PEACE OFFICERS WITH A1
NONEXECUTIVE RANK FROM STATE LAW ENFORCEMENT AGENCIES;2
(E) (G) Five THREE non-law-enforcement members. The3
non-law-enforcement members shall complete a citizens' law enforcement4
academy prior to appointment or within one year after appointment.5
(H) O NE TRAINING ACADEMY DIRECTOR REPRESENTING A6
COMMUNITY-COLLEGE-OPERATED PEACE OFFICER TRAINING ACADEMY;7
(I) O NE TRAINING ACADEMY DIRECTOR REPRESENTING A8
LAW-ENFORCEMENT-OPERATED PEACE OFFICER TRAINING ACADEMY; AND9
(J) ONE EXECUTIVE FROM AN ORGANIZATION REPRESENTING10
RESERVE PEACE OFFICERS.11
(e) A PERSON WHO HAS HAD THEIR P.O.S.T. CERTIFICATION12
REVOKED SHALL NOT BE APPOINTED TO SERVE ON THE P.O.S.T. BOARD.13
SECTION 3. In Colorado Revised Statutes, 24-31-303, add (7)14
as follows:15
24-31-303. Duties - powers of the P.O.S.T. board - instructors16
- definition.17
(7) IN CARRYING OUT ITS DUTIES PURSUANT TO SUBSECTION (1) OF18
THIS SECTION, THE P.O.S.T. BOARD SHALL NOT APPROVE AS A SKILLS19
INSTRUCTOR A PERSON WHOSE PEACE OFFICER CERTIFICATION HAS BEEN20
REVOKED BY THE P.O.S.T. BOARD AND SHALL NOT APPROVE A TRAINING21
ACADEMY IF AN INSTRUCTOR OF THE TRAINING ACADEMY IS A PERSON22
WHOSE PEACE OFFICER CERTIFICATION HAS BEEN REVOKED BY THE23
P.O.S.T. BOARD.24
SECTION 4. In Colorado Revised Statutes, 24-31-305, amend25
(1)(a) introductory portion, (1)(a)(III), and (1)(a)(IV); and add (1)(a)(V)26
as follows:27

(1) (a) Basic peace officer certification requirements shall MUST3
include:4
(III) Passage of examinations administered by the P.O.S.T. board;5
and6
(IV) Current first aid and cardiopulmonary resuscitation7
certificates or their equivalents; AND8
(V) THAT THE CERTIFIED PEACE OFFICER IS AT LEAST TWENTY-ONE9
YEARS OLD OR OLDER.10
SECTION 5. In Colorado Revised Statutes, add 24-31-322 as11
follows:12
24-31-322. Authority to receive training or grants.13
A TRAINING ACADEMY FULL-TIME INSTRUCTOR IS ELIGIBLE TO14
ATTEND P.O.S.T. CERTIFICATION CLASSES THAT ARE FUNDED OR HOSTED15
USING GRANT FUNDING, BUT ARE NOT ELIGIBLE TO RECEIVE INDIVIDUAL16
GRANT FUNDING FROM THE P.O.S.T. BOARD. THIS SECTION DOES NOT17
PROHIBIT A TRAINING ACADEMY FULL-TIME INSTRUCTOR FROM RECEIVING18
INDIVIDUAL GRANT FUNDING FROM AN ENTITY THAT IS NOT THE P.O.S.T.19
BOARD.20
SECTION 6. Act subject to petition - effective date. This act21
takes effect at 12:01 a.m. on the day following the expiration of the22
ninety-day period after final adjournment of the general assembly (August23
12, 2026, if adjournment sine die is on May 13, 2026); except that, if a24
referendum petition is filed pursuant to section 1 (3) of article V of the25
state constitution against this act or an item, section, or part of this act26
within such period, then the act, item, section, or part will not take effect27

unless approved by the people at the general election to be held in1
November 2026 and, in such case, will take effect on the date of the2
official declaration of the vote thereon by the governor.3
