Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. In Colorado Revised Statutes, 25-44-104, repeal (1)2
as follows:3
25-44-104. Gifts, grants, and donations - uses.4
(1) Beginning in the 2019-20 budget year and each budget year5
thereafter, the general assembly shall annually appropriate at least one6
million dollars to the department for the comprehensive human sexuality7
education grant program.8
SECTION 2. Appropriation - adjustments to 2026 long bill.9
(1) Except as provided in subsection (2) of this section, to implement this10
act, the general fund appropriation made in the annual general11
appropriation act for the 2026-27 state fiscal year to the department of12
public health and environment for use by the prevention services division13
for comprehensive sexual education is decreased by $991,025 and the14
related FTE is decreased by 1.3 FTE.15
(2) Subsection (1) of this section does not require a reduction of16
an appropriation in the annual general appropriation act for the 2026-2717
state fiscal year if:18
(a) The amount of the general fund appropriation made in the19
annual general appropriation act for the 2026-27 state fiscal year to the20
department of public health and environment for use by the prevention21
services division for comprehensive sexual education is less than the22
amount of the adjustment required in subsection (1) of this section; or23
(b) The annual general appropriation act for the 2026-27 state24
fiscal year does not include a general fund appropriation from the25

department of public health and environment for use by the prevention1
services division for comprehensive sexual education.2
SECTION 3. Effective date. This act takes effect July 1, 2026;3
except that section 2 of this act takes effect only if the annual general4
appropriation act for the 2026-27 state fiscal year becomes law, in which5
case section 2 takes effect upon the effective date of this act or of the6
annual general appropriation act for state fiscal year 2026-27, whichever7
is later.8
SECTION 4. Safety clause. The general assembly finds,9
determines, and declares that this act is necessary for the immediate10
preservation of the public peace, health, or safety or for appropriations for11
the support and maintenance of the departments of the state and state12
institutions.13
