Bill Summary

The bill creates the Colorado nuclear workforce development and
education council (council) in the Colorado school of mines to help meet
growing workforce demand in the nuclear energy sector. The bill
establishes a related grant program (grant program) to provide grants to
institutions of higher education for the development or expansion of
nuclear engineering degree or certificate programs or course offerings.

The council shall convene advisory sessions with stakeholders from the
nuclear, educational, and workforce development sectors; implement the
grant program; and contract with one or more third-party entities for
staffing and operational assistance.
The council may seek, accept, and expend gifts, grants, and
donations for council-related purposes. The state treasurer shall credit the
gifts, grants, and donations to the Colorado nuclear workforce
development and education cash fund (cash fund), which is created in the
bill. The general assembly shall not appropriate general fund money to
implement or maintain council operations or grant awards. The council
shall convene and begin awarding grants only after the balance of the
cash fund reaches or exceeds $500,000.
The bill imposes requirements to report to the general assembly
about the council's funding sources, grant program implementation, and
other uses of the grant program money. The bill repeals the council,
effective September 1, 2033, unless the council is extended following a
sunset review.
Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. Legislative declaration. (1) The general assembly2
finds and declares that:3
(a) Nuclear energy is a critical component of Colorado's clean4
energy strategy and economic development, offering consistent, reliable,5
and noncarbon power generation to support grid stability and emissions6
reduction goals;7
(b) A highly skilled workforce is essential for the deployment and8
operation of nuclear technologies. Workforce readiness in engineering,9
radiation safety, and reactor technology is necessary to support Colorado's10
energy transition.11
(c) The Colorado nuclear workforce development and education12
council will harness private investment, federal funding, and strategic13
partnerships to make the state a leader in nuclear energy workforce14
development. Through grants to eligible institutions of higher education15
and related technical assistance, the council w ill expa nd educational16

pathways to careers in the nuclear energy sector.1
(d) The Colorado school of mines' expertise in energy resource2
management, workforce development, and federal grant facilitation3
uniquely positions it to house the Colorado nuclear workforce4
development and education council; and5
(e) By developing and expanding existing state higher education6
infrastructure, including degree and certificate programs and technical7
training, and by leveraging public and private sector collaboration, the8
Colorado nuclear workforce development and education council will help9
Colorado expand workforce readiness in the nuclear energy sector10
without new state appropriations, supporting long-term economic growth11
and clean energy innovation.12
SECTION 2. In Colorado Revised Statutes, add part 3 to article13
41 of title 23 as follows:14

23-41-302. Colorado nuclear workforce development and12
education council - created.13
(1) T HE COLORADO NUCLEAR WORKFORCE DEVELOPMENT AND14
EDUCATION COUNCIL IS CREATED IN THE COLORADO SCHOOL OF MINES.15
THE PURPOSE OF THE COUNCIL IS TO MEET GROWING WORKFORCE DEMAND16
IN THE NUCLEAR ENERGY SECTOR BY:17
(a) P ROVIDING GRANTS THROUGH THE GRANT PROGRAM TO18
ELIGIBLE INSTITUTIONS FOR THE DEVELOPMENT OR EXPANSION OF DEGREE19
PROGRAMS, CERTIFICATE PROGRAMS, INDIVIDUAL COURSES, OR MODULAR20
TRAINING FOCUSED ON NUCLEAR ENERGY; AND21
(b) PROVIDING ELIGIBLE INSTITUTIONS WITH RELATED TECHNICAL22
ASSISTANCE.23
(2) T HE COUNCIL IS ONLY REQUIRED TO IMPLEMENT SECTIONS24
23-41-303, 23-41-304, AND 23-41-305 IF , PURSUANT TO SECTION25

(3) THE COUNCIL ACTIVITIES, INCLUDING PROVIDING TECHNICAL1

ENTITY, THE GRANT PROGRAM , AND ADMINISTRATIVE COSTS MUST BE3
FUNDED ENTIRELY BY GIFTS, GRANTS, AND DONATIONS. GIFTS, GRANTS,4
AND DONATIONS MUST FUND THE COUNCIL 'S WORK THROUGHOUT THE5
COURSE OF THE COUNCIL'S WORK, AND GENERAL FUND MONEY SHALL NOT6
BE APPROPRIATED FOR THE IMPLEMENTATION OF THIS PART 3.7

(I) THE GOVERNOR SHALL APPOINT THE FOLLOWING MEMBERS OF19
THE COUNCIL:20
(A) O NE MEMBER WHO IS A REPRESENTATIVE OF A PRIVATE21
COMPANY IN THE NUCLEAR OR CLEAN ENERGY SECTOR;22
(B) O NE MEMBER WHO IS A REPRESENTATIVE OF A COAL23
TRANSITION COMMUNITY OR RURAL AREA OF THE STATE; AND24
(C) O NE MEMBER WHO IS A PHYSICIST OR ENGINEER FROM A25
FEDERAL LABORATORY AND WHO HAS AT LEAST FIVE YEARS OF26
EXPERIENCE IN THE NUCLEAR SECTOR; AND27

(II) THE PRESIDENT OF THE SENATE, THE MINORITY LEADER OF THE1
SENATE, THE SPEAKER OF THE HOUSE OF REPRESENTATIVES , AND THE2
MINORITY LEADER OF THE HOUSE OF REPRESENTATIVES SHALL EACH3
APPOINT:4
(A) O NE MEMBER WHO IS A REPRESENTATIVE OF A PRIVATE5
COMPANY IN THE NUCLEAR OR CLEAN ENERGY SECTOR; AND6
(B) O NE MEMBER WHO IS A REPRESENTATIVE OF A LABOR7
ORGANIZATION, A REPRESENTATIVE OF A SMALL OR MID-SIZED NUCLEAR8
SUPPLY CHAIN BUSINESS , AN ENVIRONMENTAL SAFETY EXPERT , OR A9
WORKFORCE TRAINING PROFESSIONAL.10
(b) A MEMBER OF THE COUNCIL MUST BE A COLORADO RESIDENT11
UNLESS THE MEMBER IS APPOINTED PURSUANT TO SUBSECTION (5)(a)(I)(C)12
OF THIS SECTION OR IS A REPRESENTATIVE OF A SMALL OR MID -SIZED13
NUCLEAR SUPPLY CHAIN BUSINESS OR AN ENVIRONMENTAL SAFETY14
EXPERT APPOINTED PURSUANT TO SUBSECTION (5)(a)(II)(B) OF THIS15
SECTION.16
(c) T HE APPOINTING AUTHORITIES SHALL MAKE THE INITIAL17
APPOINTMENTS TO THE COUNCIL AS SOON AS POSSIBLE AFTER THE18
EFFECTIVE DATE OF THIS SECTION BUT NO LATER THAN JANUARY 1, 2027.19
(d) THE TERM OF APPOINTMENT IS FOUR YEARS; EXCEPT THAT THE20
TERM OF EACH MEMBER INITIALLY APPOINTED IS TWO YEARS.21
23-41-303. Colorado nuclear workforce development and22
education council - meetings - duties - authority to contract.23
(1) (a) T HE COUNCIL SHALL ELECT A CHAIR FROM AMONG THE24
COUNCIL'S MEMBERS TO SERVE FOR A TERM NOT TO EXCEED TWO YEARS,25
AS DETERMINED BY THE COUNCIL.26
(b) THE PRESIDENT OF THE COLORADO SCHOOL OF MINES SHALL27

CONVENE THE FIRST MEETING OF THE COUNCIL NO LATER THAN1
FORTY-TWO DAYS AFTER THE EFFECTIVE DATE OF THIS SECTION .2
THEREAFTER, THE COUNCIL SHALL MEET AT LEAST QUARTERLY . THE3
CHAIR MAY CALL ADDITIONAL MEETINGS AS ARE NECESSARY FOR THE4
COUNCIL TO COMPLETE ITS DUTIES.5
(2) MEMBERS OF THE COUNCIL SERVE WITHOUT COMPENSATION6
BUT ARE ENTITLED TO RECEIVE REIMBURSEMENT FOR ACTUAL AND7
NECESSARY EXPENSES INCURRED IN THE PERFORMANCE OF THE MEMBERS'8
DUTIES ON THE COUNCIL.9
(3) W ITH STAFFING AND OPERATIONAL ASSISTANCE FROM A10
THIRD-PARTY ENTITY, THE COUNCIL SHALL:11
(a) C ONVENE, AT A FREQUENCY TO BE DETERMINED BY THE12
COUNCIL, ADVISORY SESSIONS WITH STAKEHOLDERS FROM THE NUCLEAR,13
EDUCATIONAL, AND ECONOMIC DEVELOPMENT SECTORS TO ASSESS AND14
ADOPT STRATEGIES TO RESPOND TO EVOLVING WORKFORCE DEMANDS AND15
OPPORTUNITIES IN THE NUCLEAR ENERGY SECTOR; AND16
(b) IMPLEMENT THE GRANT PROGRAM, INCLUDING:17
(I) REVIEWING AND APPROVING GRANT PROGRAM GUIDELINES AND18
PROCEDURES TO ENSURE GRANTS ARE AWARDED THROUGH AN OPEN ,19
COMPETITIVE PROCESS USING NATIONAL BEST PRACTICES;20
(II) REVIEWING APPLICATIONS FROM ELIGIBLE INSTITUTIONS;21
(III) S ELECTING GRANT RECIPIENTS AND DETERMINING GRANT22
AWARD AMOUNTS;23
(IV) P ROVIDING ELIGIBLE INSTITUTIONS WITH TECHNICAL24
ASSISTANCE; AND25
(V) EVALUATING THE GRANT PROGRAM.26
(4) THE COUNCIL MAY PROMOTE NUCLEAR ENERGY EDUCATION27

AND RESEARCH ACTIVITIES AMONG ELIGIBLE INSTITUTIONS TO ENHANCE1
THE ELIGIBLE INSTITUTIONS' ABILITY TO ATTRACT FEDERAL AND PRIVATE2
SECTOR FUNDING FOR NUCLEAR ENERGY EDUCATION , TRAINING , AND3
RELATED RESEARCH.4
(5) THE COUNCIL SHALL DEVELOP GUIDELINES AND PROCEDURES5
AS NECESSARY TO IMPLEMENT THIS PART 3.6
(6) T HE COUNCIL SHALL CONTRACT WITH ONE OR MORE7
THIRD-PARTY ENTITIES TO PROVIDE STAFFING AND OPERATIONAL8
ASSISTANCE TO THE COUNCIL OR TO HELP IMPLEMENT OTHER PROVISIONS9
OF THIS PART 3.10
(7) THE COUNCIL MUST USE A REQUEST FOR PROPOSAL PROCESS TO11
DESIGNATE AND CONTRACT WITH A THIRD -PARTY ENTITY FOR THE12
PURPOSES OF THIS PART 3. A THIRD-PARTY ENTITY MAY PROVIDE IN-KIND13
STAFF SUPPORT OR TECHNICAL ASSISTANCE TO ASSIST THE COUNCIL IN14
PERFORMING THE COUNCIL'S DUTIES AND RESPONSIBILITIES. THIRD-PARTY15
ENTITY PERSONNEL ARE NOT EMPLOYEES OF THE COUNCIL OR THE STATE.16
(8) THE COUNCIL MAY USE UP TO TEN PERCENT OF THE MONEY IN17
THE CASH FUND TO PAY DIRECT AND INDIRECT ADMINISTRATIVE COSTS.18
23-41-304. Colorado nuclear workforce development and19
education grant program - created - application - criteria - awards.20
(1) T HE COLORADO NUCLEAR WORKFORCE DEVELOPMENT AND21
EDUCATION GRANT PROGRAM IS CREATED IN THE COLORADO SCHOOL OF22
MINES TO MEET GROWING WORKFORCE DEMAND IN THE NUCLEAR ENERGY23
SECTOR BY PROVIDING GRANTS TO ELIGIBLE INSTITUTIONS FOR THE24
DEVELOPMENT OR EXPANSION OF NUCLEAR ENERGY DEGREE PROGRAMS,25
CERTIFICATE PROGRAMS, INDIVIDUAL COURSES, OR MODULAR TRAINING.26
(2) THE COUNCIL SHALL BEGIN AWARDING GRANTS ONLY AFTER27

THE BALANCE OF THE CASH FUND REACHES OR EXCEEDS FIVE HUNDRED1
THOUSAND DOLLARS. THE COUNCIL SHALL EXPLORE OPPORTUNITIES TO2
LEVERAGE FEDERAL FUNDING , INCLUDING FEDERAL WORKFORCE3
DEVELOPMENT MATCHING GRANTS.4
(3) GRANT RECIPIENTS MAY USE THE MONEY RECEIVED THROUGH5
THE GRANT PROGRAM FOR THE DE SIGN OF COURSES OR DEGREE6
PROGRAMS, CERTIFICATE PROGRAMS, OR TRAINING PROGRAMS FOCUSED7
ON NUCLEAR ENERGY ; FOR PERSONNEL ; OR FOR ADMINISTRATIVE OR8
FACILITY EXPENSES NECESSARY TO DEVELOP OR EXPAND NUCLEAR9
ENERGY DEGREE, CERTIFICATE, TRAINING, OR COURSE OFFERINGS.10
(4) THE COUNCIL, WITH ASSISTANCE FROM AND IN COORDINATION11
WITH A THIRD-PARTY ENTITY, SUBJECT TO THE AVAILABILITY OF MONEY12
PURSUANT TO SUBSECTION (2) OF THIS SECTION, SHALL ADMINISTER THE13
GRANT PROGRAM AND SHALL AWARD GRANTS AS PROVIDED IN THIS PART14
3. GRANTS MUST BE PAID OUT OF THE CASH FUND.15
(5) TO RECEIVE A GRANT, AN ELIGIBLE INSTITUTION MUST SUBMIT16
AN APPLICATION TO THE COUNCIL IN ACCORDANCE WITH GUIDELINES AND17
PROCEDURES ESTABLISHED PURSUANT TO SECTION 23-41-303 (5).18
(6) (a) THE COUNCIL SHALL REVIEW THE APPLICATIONS RECEIVED19
PURSUANT TO THIS SECTION . IN SELECTING GRANT RECIPIENTS , THE20
COUNCIL SHALL PRIORITIZE ELIGIBLE INSTITUTIONS THAT CAN PROVIDE A21
TRAINED WORKFORCE EXPEDITIOUSLY. IN ADDITION TO OTHER RELEVANT22
FACTORS, THE COUNCIL SHALL CONSIDER THE FOLLOWING CRITERIA WHEN23
AWARDING GRANTS:24
(I) THE DISTRIBUTION OF NUCLEAR ENERGY DEGREE PROGRAMS,25
CERTIFICATE PROGRAMS, INDIVIDUAL COURSES, AND MODULAR TRAINING26
OPPORTUNITIES OFFERED ACROSS THE STATE;27

(II) T HE NEED FOR A NUCLEAR ENERGY WORKFORCE IN THE1
APPLICANT'S SURROUNDING COMMUNITY OR REGION OF THE STATE; AND2
(III) THE PROJECTED STUDENT INTEREST IN THE NUCLEAR ENERGY3
DEGREE PROGRAMS, CERTIFICATE PROGRAMS, INDIVIDUAL COURSES, AND4
MODULAR TRAINING OPPORTUNITIES AT COMPETING INSTITUTIONS.5
(b) TO AWARD A GRANT, AT LEAST A MAJORITY OF THE MEMBERS6
OF THE COUNCIL MUST APPROVE THE GRANT.7
23-41-305. Reporting requirements.8
(1) ON OR BEFORE THE FIRST NOVEMBER 1 AFTER THE EFFECTIVE9
DATE OF THIS SECTION , AND ON OR BEFORE NOVEMBER 1 EACH YEAR10
THEREAFTER UNTIL THE REPEAL OF THIS PART 3, THE COUNCIL SHALL11
SUBMIT A REPORT TO THE HOUSE OF REPRESENTATIVES ENERGY AND12
ENVIRONMENT COMMITTEE, THE HOUSE OF REPRESENTATIVES EDUCATION13
COMMITTEE, THE SENATE TRANSPORTATION AND ENERGY COMMITTEE ,14
AND THE SENATE EDUCATION COMMITTEE , OR THEIR SUCCESSOR15
COMMITTEES. AT A MINIMUM, THE REPORT MUST INCLUDE:16
(a) A SUMMARY OF THE GRANT PROGRAM AND ITS17
IMPLEMENTATION AND ANY RELATED TECHNICAL ASSISTANCE PROVIDED18
TO GRANT RECIPIENTS; AND19
(b) A N ACCOUNTING OF THE SOURCE AND AMOUNT OF MONEY20
CREDITED TO THE CASH FUND AND HOW CASH FUND MONEY WAS USED21
PURSUANT TO THIS PART 3, INCLUDING GRANT PROGRAM AWARDS TO22
EXPAND OR SUPPORT NUCLEAR ENERGY DEGREE PROGRAMS, CERTIFICATE23
PROGRAMS , INDIVIDUAL COURSES , AND MODULAR TRAINING24
OPPORTUNITIES IN ORDER TO MEET GROWING WORKFORCE DEMAND IN THE25
NUCLEAR ENERGY SECTOR.26
23-41-306. Colorado nuclear workforce development and27

(1) T HE COLORADO NUCLEAR WORKFORCE DEVELOPMENT AND2
EDUCATION CASH FUND IS CREATED IN THE STATE TREASURY . THE CASH3
FUND CONSISTS OF GIFTS , GRANTS , AND DONATIONS CREDITED TO THE4
CASH FUND PURSUANT TO SUBSECTION (2) OF THIS SECTION.5
(2) THE COUNCIL MAY SEEK, ACCEPT, AND EXPEND GIFTS, GRANTS,6
OR DONATIONS FROM PRIVATE OR PUBLIC SOURCES FOR THE PURPOSES OF7
THIS PART 3. THE COUNCIL SHALL TRANSMIT ALL MONEY RECEIVED8
THROUGH GIFTS, GRANTS, OR DONATIONS TO THE STATE TREASURER, WHO9
SHALL CREDIT THE MONEY TO THE CASH FUND.10
(3) T HE STATE TREASURER SHALL CREDIT ALL INTEREST AND11
INCOME DERIVED FROM THE DEPOSIT AND INVESTMENT OF MONEY IN THE12
CASH FUND TO THE CASH FUND.13
(4) MONEY IN THE CASH FUND IS CONTINUOUSLY APPROPRIATED14
TO THE BOARD OF TRUSTEES OF THE COLORADO SCHOOL OF MINES FOR THE15
PURPOSES SPECIFIED IN THIS PART 3.16
(5) THE COUNCIL MAY ACCEPT DONATIONS OF IN-KIND SERVICES17
FOR THE PURPOSES OF THIS PART 3, INCLUDING FOR TECHNICAL18
ASSISTANCE.19
(6) THE GENERAL ASSEMBLY SHALL NOT APPROPRIATE GENERAL20
FUND MONEY FOR THE PURPOSES OF THIS PART 3.21
23-41-307. Effective date - repeal of part - review of functions.22
(1) SECTIONS 23-41-303, 23-41-304, AND 23-41-305 TAKE EFFECT23
IF THE COUNCIL RECEIVES AT LEAST FIVE HUNDRED THOUSAND DOLLARS24

SECTION 3. In Colorado Revised Statutes, 24-34-104, add11
(34)(a)(XIV) as follows:12
24-34-104. General assembly review of regulatory agencies13
and functions for repeal, continuation, or reestablishment - legislative14
declaration - repeal.15
(34) (a) The following agencies, functions, or both, are scheduled16
for repeal on September 1, 2033:17
(XIV) THE COLORADO NUCLEAR WORKFORCE DEVELOPMENT AND18
EDUCATION COUNCIL CREATED IN PART 3 OF ARTICLE 41 OF TITLE 23.19
SECTION 4. Act subject to petition - effective date. This act20
takes effect at 12:01 a.m. on the day following the expiration of the21
ninety-day period after final adjournment of the general assembly (August22
12, 2026, if adjour nment sine die is on May 13, 2026); except that, if a23
referendum petition is filed pursuant to section 1 (3) of article V of the24
state constitution against this act or an item, section, or part of this act25
within such period, then the act, item, section, or part will not take effect26
unless approved by the people at the general election to be held in27

November 2026 and, in such case, will take effect on the date of the1
official declaration of the vote thereon by the governor.2
