The bill creates the Colorado nuclear workforce development and
education council (council) in the Colorado school of mines to help meet
growing workforce demand in the nuclear energy sector. The bill
establishes a related grant program (grant program) to provide grants to
institutions of higher education for the development or expansion of
nuclear engineering degree or certificate programs or course offerings.

The council shall convene advisory sessions with stakeholders from the
nuclear, educational, and workforce development sectors; implement the
grant program; and contract with one or more third-party entities for
staffing and operational assistance.
The council may seek, accept, and expend gifts, grants, and
donations for council-related purposes. The state treasurer shall credit the
gifts, grants, and donations to the Colorado nuclear workforce
development and education cash fund (cash fund), which is created in the
bill. The general assembly shall not appropriate general fund money to
implement or maintain council operations or grant awards. The council
shall convene and begin awarding grants only after the balance of the
cash fund reaches or exceeds $500,000.
The bill imposes requirements to report to the general assembly
about the council's funding sources, grant program implementation, and
other uses of the grant program money. The bill repeals the council,
effective September 1, 2033, unless the council is extended following a
sunset review.
Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. Legislative declaration. (1) The general assembly2
finds and declares that:3
(a) Nuclear energy is a critical component of Colorado's clean4
energy strategy and economic development, offering consistent, reliable,5
and noncarbon power generation to support grid stability and emissions6
reduction goals;7
(b) A highly skilled workforce is essential for the deployment and8
operation of nuclear technologies. Workforce readiness in engineering,9
radiation safety, and reactor technology is necessary to support Colorado's10
energy transition.11
(c) The Colorado nuclear workforce development and education12
council will harness private investment, federal funding, and strategic13
partnerships to make the state a leader in nuclear energy workforce14
development. Through grants to eligible institutions of higher education15
and related technical assistance, the council w ill expa nd educational16

pathways to careers in the nuclear energy sector.1
(d) The Colorado school of mines' expertise in energy resource2
management, workforce development, and federal grant facilitation3
uniquely positions it to house the Colorado nuclear workforce4
development and education council; and5
(e) By developing and expanding existing state higher education6
infrastructure, including degree and certificate programs and technical7
training, and by leveraging public and private sector collaboration, the8
Colorado nuclear workforce development and education council will help9
Colorado expand workforce readiness in the nuclear energy sector10
without new state appropriations, supporting long-term economic growth11
and clean energy innovation.12

41 of title 23 as follows:14

23-41-302. Colorado nuclear workforce development and12

(1) T HE COLORADO NUCLEAR WORKFORCE DEVELOPMENT AND14
EDUCATION COUNCIL IS CREATED IN THE COLORADO SCHOOL OF MINES.15
THE PURPOSE OF THE COUNCIL IS TO MEET GROWING WORKFORCE DEMAND16
IN THE NUCLEAR ENERGY SECTOR BY:17
(a) P ROVIDING GRANTS THROUGH THE GRANT PROGRAM TO18
ELIGIBLE INSTITUTIONS FOR THE DEVELOPMENT OR EXPANSION OF DEGREE19
PROGRAMS, CERTIFICATE PROGRAMS, INDIVIDUAL COURSES, OR MODULAR20
TRAINING FOCUSED ON NUCLEAR ENERGY; AND21
(b) PROVIDING ELIGIBLE INSTITUTIONS WITH RELATED TECHNICAL22
ASSISTANCE.23
(2) T HE COUNCIL IS ONLY REQUIRED TO IMPLEMENT SECTIONS24
23-41-303, 23-41-304, AND 23-41-305 IF , PURSUANT TO SECTION25

(3) THE COUNCIL ACTIVITIES, INCLUDING PROVIDING TECHNICAL1

ENTITY, THE GRANT PROGRAM , AND ADMINISTRATIVE COSTS MUST BE3
FUNDED ENTIRELY BY GIFTS, GRANTS, AND DONATIONS. GIFTS, GRANTS,4
AND DONATIONS MUST FUND THE COUNCIL 'S WORK THROUGHOUT THE5
COURSE OF THE COUNCIL'S WORK, AND GENERAL FUND MONEY SHALL NOT6
BE APPROPRIATED FOR THE IMPLEMENTATION OF THIS PART 3.7

COMPANY IN THE NUCLEAR OR CLEAN ENERGY SECTOR;22
(B) O NE MEMBER WHO IS A REPRESENTATIVE OF A COAL23
TRANSITION COMMUNITY OR RURAL AREA OF THE STATE; AND24
(C) O NE MEMBER WHO IS A PHYSICIST OR ENGINEER FROM A25
FEDERAL LABORATORY AND WHO HAS AT LEAST FIVE YEARS OF26
EXPERIENCE IN THE NUCLEAR SECTOR; 27

(II) THE PRESIDENT OF THE SENATE, THE MINORITY LEADER OF THE1
SENATE, THE SPEAKER OF THE HOUSE OF REPRESENTATIVES , AND THE2
MINORITY LEADER OF THE HOUSE OF REPRESENTATIVES SHALL EACH3
APPOINT:4
(A) O NE MEMBER WHO IS A REPRESENTATIVE OF A PRIVATE5
COMPANY IN THE NUCLEAR OR CLEAN ENERGY SECTOR; AND6
(B) O NE MEMBER WHO IS A REPRESENTATIVE OF A LABOR7
ORGANIZATION, A REPRESENTATIVE OF A SMALL OR MID-SIZED NUCLEAR8
SUPPLY CHAIN BUSINESS , AN ENVIRONMENTAL SAFETY EXPERT , OR A9
WORKFORCE TRAINING PROFESSIONAL; AND10
(III) THE COLORADO COMMISSION ON HIGHER EDUCATION SHALL11
APPOINT ONE MEMBER WHO IS A MEMBER OF THE COLORADO COMMISSION12
ON HIGHER EDUCATION.13
(b) A MEMBER OF THE COUNCIL MUST BE A COLORADO RESIDENT14
UNLESS THE MEMBER IS APPOINTED PURSUANT TO SUBSECTION (5)(a)(I)(C)15
OF THIS SECTION OR IS A REPRESENTATIVE OF A SMALL OR MID -SIZED16
NUCLEAR SUPPLY CHAIN BUSINESS OR AN ENVIRONMENTAL SAFETY17
EXPERT APPOINTED PURSUANT TO SUBSECTION (5)(a)(II)(B) OF THIS18
SECTION.19
(c) T HE APPOINTING AUTHORITIES SHALL MAKE THE INITIAL20
APPOINTMENTS TO THE COUNCIL AS SOON AS POSSIBLE AFTER THE21
EFFECTIVE DATE OF THIS SECTION BUT NO LATER THAN JANUARY 1, 2027.22
(d) THE TERM OF APPOINTMENT IS FOUR YEARS; EXCEPT THAT THE23
TERM OF EACH MEMBER INITIALLY APPOINTED IS TWO YEARS.24
23-41-303. Colorado nuclear workforce development and25
education council - meetings - duties - authority to contract.26
(1) (a) T HE COUNCIL SHALL ELECT A CHAIR FROM AMONG THE27

COUNCIL'S MEMBERS TO SERVE FOR A TERM NOT TO EXCEED TWO YEARS,1
AS DETERMINED BY THE COUNCIL.2
(b) THE PRESIDENT OF THE COLORADO SCHOOL OF MINES SHALL3
CONVENE THE FIRST MEETING OF THE COUNCIL NO LATER THAN4
FORTY-TWO DAYS AFTER THE EFFECTIVE DATE OF THIS SECTION .5
THEREAFTER, THE COUNCIL SHALL MEET AT LEAST QUARTERLY . THE6
CHAIR MAY CALL ADDITIONAL MEETINGS AS ARE NECESSARY FOR THE7
COUNCIL TO COMPLETE ITS DUTIES.8
(2) MEMBERS OF THE COUNCIL SERVE WITHOUT COMPENSATION9
BUT ARE ENTITLED TO RECEIVE REIMBURSEMENT FOR ACTUAL AND10
NECESSARY EXPENSES INCURRED IN THE PERFORMANCE OF THE MEMBERS'11
DUTIES ON THE COUNCIL.12
(3) W ITH STAFFING AND OPERATI ONAL ASSISTANCE FROM A13
THIRD-PARTY ENTITY, THE COUNCIL SHALL:14
(a) C ONVENE, AT A FREQUENCY TO BE DETERMINED BY THE15
COUNCIL, ADVISORY SESSIONS WITH STAKEHOLDERS FROM THE NUCLEAR,16
EDUCATIONAL, AND ECONOMIC DEVELOPMENT SECTORS TO ASSESS AND17
ADOPT STRATEGIES TO RESPOND TO EVOLVING WORKFORCE DEMANDS AND18
OPPORTUNITIES IN THE NUCLEAR ENERGY SECTOR; AND19
(b) IMPLEMENT THE GRANT PROGRAM, INCLUDING:20
(I) REVIEWING AND APPROVING GRANT PROGRAM GUIDELINES AND21
PROCEDURES TO ENSURE GRANTS ARE AWARDED THROUGH AN OPEN ,22
COMPETITIVE PROCESS USING NATIONAL BEST PRACTICES;23
(II) REVIEWING APPLICATIONS FROM ELIGIBLE INSTITUTIONS;24
(III) S ELECTING GRANT RECIPIENTS AND DETERMINING GRANT25
AWARD AMOUNTS;26
(IV) P ROVIDING ELIGIBLE INSTITUTIONS WITH TECHNICAL27

ASSISTANCE; AND1
(V) EVALUATING THE GRANT PROGRAM.2
(4) THE COUNCIL MAY PROMOTE NUCLEAR ENERGY EDUCATION3
AND RESEARCH ACTIVITIES AMONG ELIGIBLE INSTITUTIONS TO ENHANCE4
THE ELIGIBLE INSTITUTIONS' ABILITY TO ATTRACT FEDERAL AND PRIVATE5
SECTOR FUNDING FOR NUCLEAR ENERGY EDUCATION , TRAINING , AND6
RELATED RESEARCH.7
(5) THE COUNCIL SHALL DEVELOP GUIDELINES AND PROCEDURES8
AS NECESSARY TO IMPLEMENT THIS PART 3.9
(6) T HE COUNCIL SHALL CONTRACT WITH ONE OR MORE10
THIRD-PARTY ENTITIES TO PROVIDE STAFFING AND OPERATIONAL11
ASSISTANCE TO THE COUNCIL OR TO HELP IMPLEMENT OTHER PROVISIONS12
OF THIS PART 3.13
(7) THE COUNCIL MUST USE A REQUEST FOR PROPOSAL PROCESS TO14
DESIGNATE AND CONTRACT WITH A THIRD -PARTY ENTITY FOR THE15
PURPOSES OF THIS PART 3. A THIRD-PARTY ENTITY MAY PROVIDE IN-KIND16
STAFF SUPPORT OR TECHNICAL ASSISTANCE TO ASSIST THE COUNCIL IN17
PERFORMING THE COUNCIL'S DUTIES AND RESPONSIBILITIES. THIRD-PARTY18
ENTITY PERSONNEL ARE NOT EMPLOYEES OF THE COUNCIL OR THE STATE.19
(8) THE COUNCIL MAY USE UP TO TEN PERCENT OF THE MONEY IN20
THE CASH FUND TO PAY DIRECT AND INDIRECT ADMINISTRATIVE COSTS.21
23-41-304. Colorado nuclear workforce development and22
education grant program - created - application - criteria - awards.23
(1) T HE COLORADO NUCLEAR WORKFORCE DEVELOPMENT AND24
EDUCATION GRANT PROGRAM IS CREATED IN THE COLORADO SCHOOL OF25
MINES TO MEET GROWING WORKFORCE DEMAND IN THE NUCLEAR ENERGY26
SECTOR BY PROVIDING GRANTS TO ELIGIBLE INSTITUTIONS FOR THE27

DEVELOPMENT OR EXPANSION OF NUCLEAR ENERGY DEGREE PROGRAMS,1
CERTIFICATE PROGRAMS, INDIVIDUAL COURSES, OR MODULAR TRAINING.2
(2) THE COUNCIL SHALL BEGIN AWARDING GRANTS ONLY AFTER3
THE BALANCE OF THE CASH FUND REACHES OR EXCEEDS FIVE HUNDRED4
THOUSAND DOLLARS. THE COUNCIL SHALL EXPLORE OPPORTUNITIES TO5
LEVERAGE FEDERAL FUNDING , INCLUDING FEDERAL WORKFORCE6
DEVELOPMENT MATCHING GRANTS.7
(3) GRANT RECIPIENTS MAY USE THE MONEY RECEIVED THROUGH8
THE GRANT PROGRAM FOR THE DESIGN OF COURSES OR DEGREE9
PROGRAMS, CERTIFICATE PROGRAMS, OR TRAINING PROGRAMS FOCUSED10
ON NUCLEAR ENERGY ; FOR PERSONNEL ; OR FOR ADMINISTRATIVE OR11
FACILITY EXPENSES NECESSARY TO DEVELOP OR EXPAND NUCLEAR12
ENERGY DEGREE, CERTIFICATE, TRAINING, OR COURSE OFFERINGS.13
(4) THE COUNCIL, WITH ASSISTANCE FROM AND IN COORDINATION14
WITH A THIRD-PARTY ENTITY, SUBJECT TO THE AVAILABILITY OF MONEY15
PURSUANT TO SUBSECTION (2) OF THIS SECTION, SHALL ADMINISTER THE16
GRANT PROGRAM AND SHALL AWARD GRANTS AS PROVIDED IN THIS PART17
3. GRANTS MUST BE PAID OUT OF THE CASH FUND.18
(5) TO RECEIVE A GRANT, AN ELIGIBLE INSTITUTION MUST SUBMIT19
AN APPLICATION TO THE COUNCIL IN ACCORDANCE WITH GUIDELINES AND20
PROCEDURES ESTABLISHED PURSUANT TO SECTION 23-41-303 (5).21
(6) (a) THE COUNCIL SHALL REVIEW THE APPLICATIONS RECEIVED22
PURSUANT TO THIS SECTION . IN SELECTING GRANT RECIPIENTS , THE23
COUNCIL SHALL PRIORITIZE ELIGIBLE INSTITUTIONS THAT CAN PROVIDE A24
TRAINED WORKFORCE EXPEDITIOUSLY. IN ADDITION TO OTHER RELEVANT25
FACTORS, THE COUNCIL SHALL CONSIDER THE FOLLOWING CRITERIA WHEN26
AWARDING GRANTS:27

(I) THE DISTRIBUTION OF NUCLEAR ENERGY DEGREE PROGRAMS,1
CERTIFICATE PROGRAMS, INDIVIDUAL COURSES, AND MODULAR TRAINING2
OPPORTUNITIES OFFERED ACROSS THE STATE;3
(II) T HE NEED FOR A NUCLEAR ENERGY WORKFORCE IN THE4
APPLICANT'S SURROUNDING COMMUNITY OR REGION OF THE STATE; 5
(III) THE PROJECTED STUDENT INTEREST IN THE NUCLEAR ENERGY6
DEGREE PROGRAMS, CERTIFICATE PROGRAMS, INDIVIDUAL COURSES, AND7
MODULAR TRAINING OPPORTUNITIES AT COMPETING INSTITUTIONS; AND8
(IV) THE EXTENT TO WHICH THE APPLICANT'S PROPOSED NUCLEAR9
ENERGY DEGREE PROGRAM , CERTIFICATE PROGRAM , COURSE WORK , OR10
MODULAR TRAINING INCLUDES A FOCUS ON NUCLEAR REGULATION AND11
COVERS THE ENTIRE NUCLEAR FUEL CYCLE.12
(b) TO AWARD A GRANT, AT LEAST A MAJORITY OF THE MEMBERS13
OF THE COUNCIL MUST APPROVE THE GRANT.14
23-41-305. Reporting requirements.15
(1) ON OR BEFORE THE FIRST NOVEMBER 1 AFTER THE EFFECTIVE16
DATE OF THIS SECTION , AND ON OR BEFORE NOVEMBER 1 EACH YEAR17
THEREAFTER UNTIL THE REPEAL OF THIS PART 3, THE COUNCIL SHALL18
SUBMIT A REPORT TO THE COLORADO COMMISSION ON HIGHER19
EDUCATION, THE HOUSE OF REPRESENTATIVES ENERGY AND ENVIRONMENT20
COMMITTEE, THE HOUSE OF REPRESENTATIVES EDUCATION COMMITTEE ,21
THE SENATE TRANSPORTATION AND ENERGY COMMITTEE, AND THE SENATE22
EDUCATION COMMITTEE , OR THEIR SUCCESSOR COMMITTEES . AT A23
MINIMUM, THE REPORT MUST INCLUDE:24
(a) A SUMMARY OF THE GRANT PROGRAM AND ITS25
IMPLEMENTATION AND ANY RELATED TECHNICAL ASSISTANCE PROVIDED26
TO GRANT RECIPIENTS; AND27

(b) A N ACCOUNTING OF THE SOURCE AND AMOUNT OF MONEY1
CREDITED TO THE CASH FUND AND HOW CASH FUND MONEY WAS USED2
PURSUANT TO THIS PART 3, INCLUDING GRANT PROGRAM AWARDS TO3
EXPAND OR SUPPORT NUCLEAR ENERGY DEGREE PROGRAMS, CERTIFICATE4
PROGRAMS , INDIVIDUAL COURSES , AND MODULAR TRAINING5
OPPORTUNITIES IN ORDER TO MEET GROWING WORKFORCE DEMAND IN THE6

23-41-306. Colorado nuclear workforce development and8
education cash fund - created.9
(1) T HE COLORADO NUCLEAR WORKFORCE DEVELOPMENT AND10
EDUCATION CASH FUND IS CREATED IN THE STATE TREASURY . THE CASH11
FUND CONSISTS OF GIFTS , GRANTS , AND DONATIONS CREDITED TO THE12
CASH FUND PURSUANT TO SUBSECTION (2) OF THIS SECTION.13
(2) THE COUNCIL MAY SEEK, ACCEPT, AND EXPEND GIFTS, GRANTS,14
OR DONATIONS FROM PRIVATE OR PUBLIC SOURCES FOR THE PURPOSES OF15
THIS PART 3. THE COUNCIL SHALL TRANSMIT ALL MONEY RECEIVED16
THROUGH GIFTS, GRANTS, OR DONATIONS TO THE STATE TREASURER, WHO17
SHALL CREDIT THE MONEY TO THE CASH FUND.18
(3) T HE STATE TREASURER SHALL CREDIT ALL INTEREST AND19
INCOME DERIVED FROM THE DEPOSIT AND INVESTMENT OF MONEY IN THE20
CASH FUND TO THE CASH FUND.21
(4) MONEY IN THE CASH FUND IS CONTINUOUSLY APPROPRIATED22
TO THE BOARD OF TRUSTEES OF THE COLORADO SCHOOL OF MINES FOR THE23
PURPOSES SPECIFIED IN THIS PART 3.24
(5) THE COUNCIL MAY ACCEPT DONATIONS OF IN-KIND SERVICES25
FOR THE PURPOSES OF THIS PART 3, INCLUDING FOR TECHNICAL26
ASSISTANCE.27

(6) THE GENERAL ASSEMBLY SHALL NOT APPROPRIATE GENERAL1
FUND MONEY FOR THE PURPOSES OF THIS PART 3.2
(7) (a) IF, ON OR BEFORE SEPTEMBER 1, 2027, THE MONEY IN THE3
CASH FUND HAS NEVER REACHED OR EXCEEDED FIVE HUNDRED THOUSAND4
DOLLARS, THE STATE TREASURER SHALL RETURN FROM THE CASH FUND TO5
THE GRANTOR OR DONOR THE AM OUNT OF THE GRANTOR 'S OR DONOR 'S6
GIFTS, GRANTS, OR DONATIONS AND, NOTWITHSTANDING SUBSECTION (2)7

(b) IF ANY MONEY REMAINS IN THE CASH FUND AFTER THE STATE10
TREASURER RETURNS MONEY TO DONORS OR GRANTORS PURSUANT TO11
SUBSECTION (7)(a) OF THIS SECTION , AS APPLICABLE , THE STATE12
TREASURER SHALL, PRIOR TO THE REPEAL OF THE CASH FUND, TRANSFER13
ALL UNEXPENDED AND UNENCUMBERED MONEY IN THE CASH FUND TO THE14
GENERAL FUND.15

(1) SECTIONS 23-41-303, 23-41-304, AND 23-41-305 TAKE EFFECT17
IF THE COUNCIL RECEIVES, ON OR BEFORE SEPTEMBER 1, 2027, AT LEAST18
FIVE HUNDRED THOUSAND DOLLARS OF GIFTS, GRANTS, OR DONATIONS FOR19
THE PURPOSES OF THIS PART 3. THE PRESIDENT OF THE COLORADO SCHOOL20
OF MINES SHALL NOTIFY THE REVISOR OF STATUTES IN WRITING OF THE21
DATE ON WHICH THE CONDITION SPECIFIED IN THIS SUBSECTION (1) HAS22
OCCURRED BY EMAILING THE NOTICE TO23
REVISOROFSTATUTES.GA@COLEG.GOV. SECTIONS 23-41-303, 23-41-304,24
AND 23-41-305 TAKE EFFECT UPON THE DATE IDENTIFIED IN THE NOTICE25
THAT THE COUNCIL HAS RECEIVED AT LEAST FIVE HUNDRED THOUSAND26
DOLLARS OF GIFTS, GRANTS, OR DONATIONS FOR THE PURPOSES OF THIS27

PART 3 OR, IF THE NOTICE DOES NOT SPECIFY THAT DATE, UPON THE DATE1
OF THE NOTICE TO THE REVISOR OF STATUTES.2
(2) T HIS PART 3 AND SECTION 24-34-104 (34)(a)(XIV) ARE3
REPEALED, EFFECTIVE SEPTEMBER 30, 2027; EXCEPT THAT , IF THE4
CONDITION SPECIFIED IN SUBSECTION (1) OF THIS SECTION OCCURS:5
(a) SECTION 24-34-104 (34)(a)(XIV) IS NOT REPEALED PURSUANT6
TO THIS SUBSECTION (2);7
(b) THIS PART 3 IS REPEALED, EFFECTIVE SEPTEMBER 1, 2033; AND8
(c) BEFORE THE REPEAL PURSUANT TO SUBSECTION (2)(b) OF THIS9
SECTION, THIS PART 3 IS SCHEDULED FOR REVIEW IN ACCORDANCE WITH10
SECTION 24-34-104.11
SECTION 3. In Colorado Revised Statutes, 24-34-104, add12
(34)(a)(XIV) as follows:13
24-34-104. General assembly review of regulatory agencies14
and functions for repeal, continuation, or reestablishment - legislative15
declaration - repeal.16
(34) (a) The following agencies, functions, or both, are scheduled17
for repeal on September 1, 2033:18
(XIV) THE COLORADO NUCLEAR WORKFORCE DEVELOPMENT AND19
EDUCATION COUNCIL CREATED IN PART 3 OF ARTICLE 41 OF TITLE 23.20
SECTION 4. Act subject to petition - effective date. This act21
takes effect at 12:01 a.m. on the day following the expiration of the22
ninety-day period after final adjournment of the general assembly (August23
12, 2026, if adjournment sine die is on May 13, 2026); except that, if a24
referendum petition is filed pursuant to section 1 (3) of article V of the25
state constitution against this act or an item, section, or part of this act26
within such period, then the act, item, section, or part will not take effect27

unless approved by the people at the general election to be held in1
November 2026 and, in such case, will take effect on the date of the2
official declaration of the vote thereon by the governor.3
