Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. In Colorado Revised Statutes, add 2-2-328 as2
follows:3
2-2-328. Members of the general assembly prohibited from4
holding multiple elected offices.5
(1) C OMMENCING WITH THE FIRST REGULAR SESSION OF THE6
SEVENTY-SIXTH GENERAL ASSEMBLY , AND DURING EACH REGULAR7
SESSION THEREAFTER, EXCEPT AS PROVIDED IN SUBSECTION (2) OF THIS8
SECTION, A MEMBER OF THE GENERAL ASSEMBLY SHALL NOT HOLD ANY9
OTHER ELECTED OFFICE WHILE SERVING AS A MEMBER OF THE GENERAL 10
ASSEMBLY. THIS SECTION APPLIES TO A MEMBER OF THE GENERAL11
ASSEMBLY UPON TAKING THE OATH OF OFFICE OF THE GENERAL ASSEMBLY12
AS REQUIRED BY SECTION 2 (2) OF ARTICLE V OF THE STATE13
CONSTITUTION.14
(2) THE PROVISIONS OF SUBSECTION (1) OF THIS SECTION DO NOT15
APPLY IF:16
(a) THE MEMBER OF THE GENERAL ASSEMBLY HOLDS A SPECIAL17
DISTRICT ELECTED OFFICE;18
(b) THE MEMBER OF THE GENERAL ASSEMBLY HAS LESS THAN ONE19
YEAR REMAINING IN THEIR TERM IN ANOTHER ELECTED OFFICE AT THE20
TIME THE MEMBER TAKES THE OATH OF OFFICE OF THE GENERAL21
ASSEMBLY AS REQUIRED BY SECTION 2 (2) OF ARTICLE V OF THE STATE22

(c) THE MEMBER OF THE GENERAL ASSEMBLY HAS LESS THAN ONE24

SECTION 2. Safety clause. The general assembly finds,4
determines, and declares that this act is necessary for the immediate5
preservation of the public peace, health, or safety or for appropriations for6
the support and maintenance of the departments of the state and state7
institutions.8
