Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. In Colorado Revised Statutes, 25.5-1-802, add (4)2
as follows:3
25.5-1-802. Medicaid transportation services - safety and4
oversight - rules.5
(4) (a) A TRANSPORTATION BROKER SHALL CONTRACT WITH AT6
LEAST FIVE TRANSPORTATION PROVIDERS TO PROVIDE TRANSPORTATION7
SERVICES TO MEMBERS. A TRANSPORTATION PROVIDER SHALL:8
(I) H AVE AT LEAST THREE YEARS OF TRANSPORTATION9
EXPERIENCE;10
(II) O PERATE A DISPATCH CENTER WITH DRIVER MONITORING11
CAPABILITIES;12
(III) MAINTAIN A PHYSICAL OFFICE SPACE THAT IS SUITABLE FOR13
PROVIDING TRANSPORTATION SERVICES;14
(IV) MAINTAIN A WEBSITE TO ACCOMMODATE ONLINE BOOKING;15
AND16
(V) I MPLEMENT A DRIVER TRAINING PROGRAM , VEHICLE17
INSPECTIONS, AND A SUBSTANCE USE TESTING PROGRAM FOR DRIVERS.18
(b) A TRANSPORTATION BROKER SHALL:19
(I) HANDLE ALL SCHEDULING, TRANSPORTATION, AND BILLING FOR20
TRANSPORTATION SERVICES PROVIDED BY THE TRANSPORTATION21
PROVIDER;22
(II) M AINTAIN DETAILED RECORDS OF OPERATION AND23
REGISTRATIONS OR CREDENTIALS THE TRANSPORTATION PROVIDER IS24

REQUIRED TO COMPLY WITH AND WORK WITH THE TRANSPORTATION1
PROVIDER AND THE STATE DEPARTMENT TO PROVIDE TRANSPORTATION2
SERVICES;3
(III) CONDUCT THE ANNUAL PERFORMANCE REVIEW;4
(IV) PROMPTLY ADDRESS AND RESOLVE ALL CLIENT COMPLAINTS;5
AND6
(V) M AINTAIN AND UTILIZE A DAILY INSPECTION SHEET FOR7
VEHICLES USED TO PROVIDE TRANSPORTATION SERVICES.8
(c) UPON RECEIPT OF A CLAIM FOR PAYMENT FOR NONEMERGENCY9
MEDICAL TRANSPORTATION TRIPS OF FIFTY -TWO MILES OR MORE , THE10
STATE DEPARTMENT MUST ISSUE PAYMENT TO THE TRANSPORTATION11
PROVIDER THAT PROVIDED THE NONEMERGENCY MEDICAL12
TRANSPORTATION SERVICES WITHIN FOURTEEN CALENDAR DAYS AFTER13
RECEIVING THE CLAIM FOR PAYMENT.14
(d) A TRANSPORTATION BROKER SHALL ANNUALLY CONDUCT A15
PERFORMANCE REVIEW OF EACH TRANSPORTATION PROVIDER THE16
TRANSPORTATION BROKER CONTRACTS WITH TO PROVIDE17
TRANSPORTATION SERVICES TO MEMBERS.18
(e) A MEMBER WHO UTILIZES NONEMERGENCY MEDICAL19
TRANSPORTATION SERVICES MUST BE ABLE TO PREAPPROVE20
NONEMERGENCY MEDICAL TRANSPORTATION AND CHOOSE A PREFERRED21
TRANSPORTATION PROVIDER TO RECEIVE NONEMERGENCY22
TRANSPORTATION SERVICES THROUGH.23
(f) DISPUTES THAT ARISE BETWEEN A TRANSPORTATION PROVIDER24
AND THE TRANSPORTATION BROKER OR MEMBER MAY BE ADJUDICATED BY25
THE STATE DEPARTMENT IN ACCORDANCE WITH SECTION 24-4-105.26
(g) THE STATE DEPARTMENT MAY ADOPT RULES AS NECESSARY TO27

IMPLEMENT THIS SUBSECTION (4).1
SECTION 2. Safety clause. The general assembly finds,2
determines, and declares that this act is necessary for the immediate3
preservation of the public peace, health, or safety or for appropriations for4
the support and maintenance of the departments of the state and state5
institutions.6
