Senate Bill 26-016, enacted in 2026, prohibits a person from
disposing of preproduction plastic materials at a location that does not
have federal interim status, a federal permit granted pursuant to the

The bill removes this prohibition and instead prohibits the disposal
of preproduction plastic materials at a location that is not a solid wastes
disposal site and facility with a certificate of designation.
Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. In Colorado Revised Statutes, repeal as added by2
Senate Bill 26-016 25-15-329.3
SECTION 2. In Colorado Revised Statutes, add 30-20-125 as4
follows:5
30-20-125. Preproduction plastic materials - disposal6
requirements - definition.7
(1) AS USED IN THIS SECTION, UNLESS THE CONTEXT OTHERWISE8
REQUIRES, "PREPRODUCTION PLASTIC MATERIALS" HAS THE MEANING SET9
FORTH IN SECTION 25-8-1102 (3).10
(2) A PERSON SHALL NOT DISPOSE OF PREPRODUCTION PLASTIC11
MATERIALS AT A LOCATION THAT HAS NOT BEEN ISSUED A CERTIFICATE OF12
DESIGNATION PURSUANT TO SECTION 30-20-105.13
SECTION 3. Act subject to petition - effective date. This act14
takes effect August 12, 2027; except that, if a referendum petition is filed15
pursuant to section 1 (3) of article V of the state constitution against this16
act or an item, section, or part of this act within the ninety-day period17
after final adjournment of the general assembly, then the act, item,18
section, or part will not take effect unless approved by the people at the19
general election to be held in November 2026 and, in such case, will take20
effect August 12, 2027.21
