Amending Land Transfer to Somers

This law changes a previous land transfer agreement so that the Town of Somers pays only administrative costs, must use the land for public safety, and includes corrected property details.

What This Bill Does

  • Changes the cost of the land transfer from fair market value to just the administrative costs of making the conveyance.
  • Requires a deed restriction that limits the Town of Somers' use of the land specifically to public safety purposes.
  • Updates the legal description of the property boundaries by correcting technical errors in a previous law, including specific measurements and directions.

Who It Names or Affects

  • The Town of Somers
  • The Commissioner of Administrative Services
  • The Commissioner of Correction
  • The State Properties Review Board

Terms To Know

Conveyance
The legal act of transferring ownership of property from one party to another.
Easement
A right for someone other than the owner, in this case the Commissioner of Correction, to use a specific part of the land as a fire department staging area.
Revert
To return ownership of property back to the state if certain rules are broken or conditions are not met.

Limits and Unknowns

  • The law does not specify the exact dollar amount for administrative costs.
  • Ownership returns to the state if Somers stops using the land for public safety, sells any part of it, or leases all or any portion of it.
