REP. DATHAN of the 142nd Dist., Chairperson of the
Committee on the part of the House, that the substitute bill
ought to pass.
AN ACT AMENDING A PRIOR CONVEYANCE TO CONVEY AN
ADDITIONAL PORTION OF A PARCEL OF STATE LAND TO THE
TOWN OF STRATFORD.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
Section 1. Section 4 of public act 18-154 is amended to read as follows 1
(Effective from passage): 2
(a) (1) Notwithstanding any provision of the general statutes, the 3
Commissioner of Administrative Services shall, on behalf of the 4
Commissioner of Developmental Services, convey to the town of 5
Stratford a parcel of land located in the town of Stratford, at a cost equal 6
to the administrative costs of making such conveyance. Said parcel of 7
land is identified as a portion of Lot 4 in Block 11 on town of Stratford's 8
Assessor's Map 30 -16 and is located at 300 Armory Road . The 9
Department of Developmental Services shall retain a portion of the 10
parcel for administrative offices and parking , until conveyed pursuant 11
to subdivision (2) of this subsection . The Commissioner of 12
Administrative Services, in consultation with the Commissioner of 13
Developmental Services, shall identify the metes and bounds of said 14

parcel, including any necessary easements, after a survey of said parcel 15
has been completed and paid for by the town of Stratford. The 16
Department of Developmental Services, Department of Administrative 17
Services and the town of Stratford shall enter into a written agreement 18
concerning the continuing operation and maintenance of the conveyed 19
parcel and the portion retained by the Department of Developmental 20
Services until a conveyance is made pursuant to subdivision (2) of this 21
subsection. The Commissioner of Administrative Services shall not 22
convey said parcel prior to the execution of such agreement. The 23
conveyance shall be subject to the approval of the State Properties 24
Review Board. 25
(2) The Commissioner of Administrative Services shall, on behalf of 26
the Commissioner of Developmental Services, convey to the town of 27
Stratford the portion of the parcel that was retained by the state under 28
subdivision (1) of this subsection prior to the effective date of this section 29
and any improvements on said parcel, at a cost equal to the 30
administrative costs of making such conveyance. Such conveyance shall 31
be subject to the Department of Developmental Services entering into a 32
written agreement with the town of Stratford for the department to 33
continue to access and use said portion and improvements for 34
administrative offices and parking at no cost. Once said portion is 35
conveyed under this section, the reconstituted parcel shall include both 36
"Proposed Lot to be Retained by State of Connecticut 48,741 S.F. ± 1.12 37
Acres ±" and "Proposed Lot to be Conveyed to the Town of Stratford 38
752,724 S.F. ± 17.280 Acres ±" on a map entitled "Proposed Lot Split of 39
Parcel MBL 30/16 11/4 Land of the State of Connecticut #300 Armory 40
Road Stratford, Connecticut Scale: 1"=40', Date: 2024 -11-22, certified 41
substantially correct by Martin Surveying Associates". Said map is on 42
file in the office of the Town Clerk of Stratford as Map No. 4131. 43
(b) [The] Other than the portion of the parcel and improvements to 44
be continued to be used by the Department of Developmental Services 45
for administrative offices and parking, the town of Stratford shall use 46
said reconstituted parcel of land for municipal and affordable housing 47
purposes. If the town of Stratford: 48

(1) Does not use said parcel for any of said purposes; 49
(2) Does not retain ownership of all of said parcel ; [, other than the 50
portion retained by the Department of Developmental Services;] or 51
(3) Leases all or any portion of said parcel, other than a lease to a 52
nonprofit organization or public housing authority for affordable 53
housing purposes, [or] any agreement for short -term use of the parcel 54
for recreational purposes by the public or the written agreement entered 55
into with the Department of Developmental Services under subdivision 56
(2) of subsection (a) of this section , the parcel and improvements shall 57
revert to the state of Connecticut. 58
(c) The State Properties Review Board shall complete its review of the 59
conveyance of said reconstituted parcel of land and improvements not 60
later than thirty days after it receives a proposed agreement from the 61
Department of Administrative Services pursuant to subdivision (2) of 62
subsection (a) of this section. The land and improvements shall remain 63
under the care and control of the Department of Developmental Services 64
until a conveyance is made in accordance with the provisions of this 65
section. The State Treasurer shall execute and deliver any deed or 66
instrument necessary for a conveyance under this section, which deed 67
or instrument shall include provisions to carry out the purposes of this 68
section. The Commissioner of Administrative Services shall have the 69
sole responsibility for all other incidents of such conveyance. 70
This act shall take effect as follows and shall amend the following
sections:

Explanation
The bill modifies a previous conveyance under section 4 of public act
18-154 in order to convey a specified parcel of land from the Department
of Administrative Services, on behalf of the Department of
Developmental Services (DDS), to the town of Stratford. The land being
conveyed in this bill was separated out from the contiguous property to
remain under state control under the terms of the 2018 conveyance.
The state would lose the asset, but retain access subject to a written
agreement between DDS and the town of Stratford . The town of
Stratford would gain use of an asset and would pay the administrative
costs of the conveyance. The asset would revert to state control if the
recipient does not use the land for specified purposes.
The land conveyance is subject to the review and approval of the State
Properties Review Board.

The conveyance action is one time in nature. Control of the asset
would continue into the future as described above, subject to future
municipal decisions.
