This amendment clarifies that the establishment of any system of registration of firearms, firearms owners and firearm transactions is expressly prohibited. This amendment is consistent with the current prohibition against the establishment of such registration systems currently contained in 24 Del. C. § 904.
Section 6 of the federal Firearms Owners Protection Act of 1986 contains an almost identical prohibition against the establishment of any system of registration of firearms, firearm owners or firearms transactions or dispositions. See 18 USC § 926 (a)(3).
This amendment ensures that Delaware law is consistent with federal law.
Additionally, this amendment deletes language that is duplicative of provisions in House Bill 141 requiring a licensee to maintain certain records relating to acquisitions of and dispositions of firearms.

AMEND Senate Substitute No. 1 for Senate Bill No. 300 by deleting lines 254 through 270 in their entirety.

FURTHER AMEND Senate Substitute No. 1 for Senate Bill No. 300 by inserting after line 427 the following:

§ 953B. Registration Prohibited

Nothing in this Chapter, or any other chapter or section of the Code, authorizes or permits the state, or any agency, department, or instrumentality thereof to establish any system for the registration of firearms, firearms owners, or firearm transactions or dispositions except with respect to persons prohibited from receiving a firearm under Chapter 5 of Title 11.

”

FURTHER AMEND Senate Substitute No. 1 for Senate Bill No. 300 on lines 491 and 493 by deleting the phrase:

“

11 and with respect to the sales or transfers of firearms under §§ 916B and 920B of this Title

” and inserting in lieu thereof the numeral “

”.
