Plain English Breakdown

The official source states private investigators do not currently have arrest authority; the bill removes outdated text referencing this power but does not change current practice for them.

HB153: Rules on Who Can Arrest or Detain People

This law makes it clear that regular people cannot arrest others, removes old rules about private detectives making arrests, and lists who is allowed to detain someone.

What This Bill Does

  • Stops any person without specific legal authority from arresting or detaining another person.
  • Clarifies that 'citizen's arrest' is not allowed in Delaware.
  • Removes two old sections of the law about arrests by private detectives, who currently cannot make arrests.
  • Confirms that peace officers and federal agents can still make arrests under certain rules.

Who It Names or Affects

  • Regular citizens who might try to arrest or hold someone without legal power.
  • Private investigators in Delaware.
  • Merchants, theater owners, and video lottery workers who have limited rights to detain people for specific reasons like shoplifting or illegal recording.

Terms To Know

Statutory authority
Power given by a written law to do something specific, such as making an arrest.
Citizen's arrest
When a regular person tries to catch and hold someone they think broke the law without being police or having legal power.

Limits and Unknowns

  • The exact effective date of this law is not listed in the provided text.
  • This summary does not cover all details about how merchants, theater owners, and video lottery workers can detain people under other specific laws.

HA 1

1 • Gorman

Passed 6/17/25

Plain English: This amendment adds rules that let regular people help police officers make arrests only when asked for help or if the officer is hurt.

  • It changes the law to say private citizens can help with an arrest in two specific situations.
  • A citizen may assist a peace officer if the officer asks them to do so.
  • A citizen may also step in and help if the police officer becomes unable to act because they are hurt or incapacitated.
  • The text does not explain what happens if a private citizen helps without being asked when the officer is still able to work.
  • It does not define exactly how much help a citizen can give or what actions are allowed during that assistance.

Official Summary Text

AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO ARREST AND DETENTION.
This Act prohibits arrest or detention by any person who does not have explicit statutory authority to carry out an arrest or detention. The intent of this provision is to eliminate any doubt that a “citizen’s arrest” is not permitted in Delaware. Peace officers have statutory authority to make arrests, as do federal law enforcement agents and out-of-state police under some circumstances. There is also limited authority to detain a person suspected of shoplifting provided to a merchant, store supervisor, agent or employee of a merchant in § 840 of Title 11; to detain a person suspected of unlawful recording by a motion picture theater owner, supervisor, agent or employee under § 858 of Title 11; and to detain a person suspected of unlawful acts with a video lottery machine by a video lottery agent or any of its officers, employees or agents under § 1474 of Title 11.
This Act also deletes two outdated provisions of Chapter 65 of Title 11 that reference the exercise of arrest by private detectives. At the present time, private investigators do not have authority to make arrests in Delaware.
