AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO LARGE PUBLIC WORKS CONTRACTS.
This Act requires that the Office of Management and Budget prepare an annual report regarding hiring for state large public works projects with an aggregate cost of $3 million or more. The information in these reports will help identify if Delaware workers, particularly individuals who live near a state public works project, are being hired to work on these projects and for how many hours. This information will also inform the Department of Labor regarding the trades for which trainings should be developed, including details such as if there is a need for training that acclimates aging workers to new technology or to develop youth workforce trainings to prepare future generations to meet employer needs.

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO LARGE PUBLIC WORKS CONTRACTS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 6962, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

Other contracting requirements. —

c. If applicable, the reporting requirements necessary for the Office to prepare the reports required under subsection (e) of this section.

(e)(1) The Office shall prepare an annual report regarding hiring during the previous calendar year for large public works projects under this section with an aggregate cost of $3 million or more. This report must include all of the following information for each employee hired or paid for each project:

a. Race.

b. Gender.

c. Zip code of home address.

d. Year of birth.

e. If known, if the employee is a veteran of the uniformed services of the United States.

f. If known, if the employee has a disability.

g. Hours worked on the project.

h. If the employee is a member of a union.

i. If applicable, the craft trade performed by the employee.

j. If applicable, the craft training program in which the employee is enrolled.

(2) An agency, including a school district or charter school, must provide the Office with the information under paragraph (e)(1) as requested or required by the Office.

(3) The Director must submit the report required under this subsection (e) no later than February 1, to the chair and vice-chair of the Joint Committee on Capital Improvement, the chairs of the House and Senate labor committees, the Controller General, the Director and the Librarian of the Division of Legislative Services, and the Delaware Public Archives.
