AN ACT RELATING TO THE TERRITORIAL LIMITS OF THE TOWN OF CHESWOLD.
This Act removes from the Town of Cheswold certain parcels of real property within the Nobles Pond development that are currently within the territorial limits of the Town of Cheswold.

This Act requires a greater than majority vote for passage because § 1 of Article IX of the Delaware Constitution requires the affirmative vote of two-thirds of the members elected to each house of the General Assembly to amend a municipal charter, whether directly, by amendment to a specific municipality’s charter, or indirectly, by a general law.

AN ACT RELATING TO THE TERRITORIAL LIMITS OF THE TOWN OF CHESWOLD.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1. Notwithstanding the Charter of the Town of Cheswold or the requirements in the Charter, the ordinances or agreements of the Town of Cheswold, § 105 of Title 22 of the Delaware Code, or any other law of this State to the contrary, the following parcels of real property, which were annexed by the Town of Cheswold on November 2, 2015, are removed from the territorial limits of the Town of Cheswold:

Section 2. On and after the effective date of this Act, the parcels of real property listed under Section 1 of this Act are subject to, and governed by, the laws applicable to other unincorporated areas of Kent County.
