HOUSE JOINT RESOLUTION NO. 9

EXTENDING THE REPORTING DATE OF THE DRIVING UNDER THE INFLUENCE PREVENTION TASK FORCE

WHEREAS, the Driving Under the Influence Prevention Task Force was established under House Joint Resolution No. 4 as amended by House Amendment No. 1 of the 153

General Assembly to study and report its findings and recommendations on at least the following topics: (1) the rate of persons arrested pursuant to the Driving Under the Influence laws in the Delaware Code, and the rate of convictions of said persons for Driving Under the Influence (2) the causes of failures to convict persons for Driving under the Influence who were arrested for Driving Under the Influence (3) how often the increased penalties for subsequent offenses are imposed (4) if the increased penalties are not being imposed, what sentencing guidelines are being followed (5) identification of necessary changes to Delaware’s laws and regulations that would further deter Driving Under the Influence in Delaware, potentially including, but not limited to, raising the amounts of applicable fines, lengthening jail sentences, and potentially providing for mandatory substance abuse treatment or mandatory counseling for those struggling with addiction that cannot be waived as part of a plea bargain, and (6) identifying detection devices or methods to be utilized by law enforcement to detect intoxication from substances other than alcohol, as well as the associated costs in procuring such devices and training enforcement officers how to utilize them; and

WHEREAS, the Task Force was directed to submit its findings and recommendations report to the General Assembly, Governor, and the Director and the Librarian of the Division of Legislative Services by January 1, 2026; and

WHEREAS, the Task Force has worked diligently on its study, but is not yet prepared to submit its report; and

WHEREAS, the members of the Task Force believe that the Task Force will be able to submit the report by January 1, 2027.

NOW, THEREFORE:

BE IT RESOLVED by the House of Representatives of the 153rd General Assembly of the State of Delaware, the Senate joining therein, that the date by which the findings and recommendations report of the Driving Under the Influence Task Force is due be extended to January 1, 2027.
