AN ACT TO AMEND TITLE 19 OF THE DELAWARE CODE RELATING TO WORKPLACE SAFETY PROGRAM.
This Act makes updates to the Delaware workplace safety program to increase the workers’ compensation insurance credit that businesses can access while maintaining overall program stability. Past legislation that adjusted Workplace Safety Program parameters led to the filing of a new Experience Rating Plan by Delaware Compensation Rating Bureau, which inadvertently resulted in lower discounts. Most businesses with lower-than-average claim costs, regardless of size, continue to see reductions in their experience modification factors. The Workplace Safety Program credit and the experience modification factor savings result in a similar savings as before for employers with favorable loss history. However, this was not the intention of prior law. This Act ensures that companies can reach maximum premium savings of 12%.

SENATE BILL NO. 248

AN ACT TO AMEND TITLE 19 OF THE DELAWARE CODE RELATING TO WORKPLACE SAFETY PROGRAM.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 2379, Title 19 of the Delaware Code, by making deletions as shown by strike through and insertions as shown by underlining as follows:

§ 2379. Workplace safety program

(h) Premium size ranges and corresponding credits. –

Safety credits will be granted according to the following formula:

20% x 1.0000 – C

40% x (1.0000 – C)

where “C” is the credibility of the qualified employer based on the uniform experience rating plan for the policy period expiring immediately prior to the application of the safety credit. If the qualified employer was not experience-rated in the policy period expiring immediately prior to the application of the safety credit, “C” will be set

amount as determined by the Insurance Commissioner by regulation. Safety credit packages will be rounded to the nearest whole percent.

Section 2. Effective Date. This Act takes effect for safety credit calculations communicated by the Department of Insurance on or after December 1, 2026.
