‘ToamendtheHealthServicesPlanningProgramRe-establishmentActof1996toexemptfromthecertificateofneedprocessdigital-onlytelehealthplatformsandproviders,federallyqualifiedhealthcenters,outpatientorresidentialbehavioralhealthservices,andprimarycare,dentalcare,andspecialtycareproviders,todefinegrouppracticeandnonpatientcareproject,toremovethe3yearmaximumoncertificateofneedapplicationsforactiveprojects,toincreasethecapitalexpenditurethresholds,andtorequiretheStateHealth
PlanningandDevelopmentAgencytoupdatethecapitalexpenditureandmedicalequipmentspendingthresholdsevery2years,toincreasethenumberofbedsthatmustbeaddedorremovedatahealthcarefacilityinordertotriggeracertificateofneed;toamendtheHealth-CareandCommunityResidenceFacilityHospiceandHomeCareLicensureActof1983torequiretheDepartmentofHealthtocreatearegistrationprocessforentitiesofferingprimary,dental,andspecialtycare,virtualprovidernetworks,virtual
telehealthplatforms,andfederallyqualifiedhealthcenters,andtorequiretheDepartmentofHealthtopostinformationaboutcertificateofneedapplicationsfortheprevious3yearsonitswebsite;toamendtheDistrictofColumbiaHealthOccupationsRevisionActof1985torenametheBoardofIntegrativeHealthcaretotheBoardofAcupuncture,Chiropractic,andNaturopathicPhysicians,todecreasethesizeoftheBoardofAcupuncture,Chiropractic,andNaturopathicPhysiciansfrom9to7members,tocreateapathwayforgraduatesocialworkerstobecomelicensedwithoutpassinganexamination,andtoclarifythatcottagefoodbusinessescansellproductswholesale;andtomakeothertechnicalamendments.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
actmay be citedas the“Certificateof Need ImprovementAmendment Act of 2025”.
Sec.2.The Health ServicesPlanningProgram Re-establishmentAct of 1996,effective
April9,1997(D.C.Law11-191;D.C.OfficialCode§44-401etseq.),isamendedasfollows:(a)Section2(D.C.OfficialCode§44-401)isamendedasfollows:(1)Paragraph (3)isamended as follows:

“(iv)Exceptasprovidedinsubparagraph(B)ofthispararaph,nohealthprofessionalwhoisamemberofthegroupdirectlyorindirectlyreceivescompensationbasedonthevolumeorvalueofreferralsmadebythehealthprofessional;and“(v)Membersofthegrouppersonallyconductnolessthan75percentofthe physician-patientencountersofthe grouppractice.

definitionofa federallyqualifiedhealthcenter,butdoes notreceivefundingundersection330 of
thePublicHealthServiceAct,approved October 11,1996 (110 Stat.3626;42 U.S.C.§ 254b)
(“federallyqualifiedhealthcenterlook-alike”);or
“(v)A healthcarefacilitylicensedor tobe licensedas a
communityresidencefacility,exceptforanintermediatecarefacility,oranAssistedLiving
Residenceas definedby section201(4) of theAssistedLivingResidenceRegulatoryAct of
2000, effectiveJune 24,2000 (D.C.Law 13-127;D.C. OfficialCode § 44-102.01(4)).”.

(a)The Health-Careand Community ResidenceFacilityHospice and Home Care
LicensureAct of 1983,effectiveFebruary24, 1984 (D.C.Law 5-48;D.C. OfficialCode § 44-
501efseq.),isamendedasfollows:

“(3)Notrequireregistrationrenewalmorefrequentlythanevery3years;and
“(4)Notrequitearegistrationorrenewalfeeabove$100peryearofregistration;
provided,thattheDepartmentmayadjustthisfeeperiodicallytoreflectthechangeinthe
ConsumerPriceIndexissuedbytheBureauofLaborStatistics,UnitedStatesDepartmentof
Laborthroughrulemaking.
“(c)A new entitythatmeets therequirementsofsubsection (a)of thissectionshall 1
registerwiththeDepartmentbeforebeginningoperation. |
“(d)Notwithstandingsubsection(a)ofthissection,existingentitiesthatmeetthe |
requirementsofsubsection(a)ofthissectionforregistrationshallhave2yearsfromthe |
effectivedateofthissectiontocompletetheregistrationprocess. |
“(e)Entitiesthatownoroperatemorethanonephysicallocationshallcompletethe

registrationprocessforeachlocationseparately.
