To requireinstitutionsof highereducationintheDistricttoretainatleast2 confidentialresource
advisors,torequireamnestyprotectionsforstudentcodeofconductviolationsunder
certaincircumstances,torequireinstitutionsmake reasonableeffortstorequireevery
undergraduatestudenttocompletesexualmisconducttrainingsthatconform with
minimum criteria,torequireinstitutionpersonnelinvolvedinan institution’ssexual
misconductinvestigativeanddisciplinaryprocessestoreceiveannualtraininginhandling
sexualmisconductcomplaintsandintheoperationsoftheinstitution'sdisciplinary
process,torequireconfidentialresourceadvisors,TitleIX coordinators,and institution
publicsafetypersonneltobeeducatedintrauma-informedresponses,toestablish
minimum criteriaforinstitutions’sexualmisconductpolicies,torequireinstitutionsto
prepareand submittotheHigher EducationLicensureCommission and publishon their
websitesa reportwithdataaboutconfidentialresourceadvisorand TitleIX office
outcomes attheinstitution,and toestablishpenaltiesforinstitutionsthatdo notcomply
withthisact;andtomakeconformingamendments.
BEITENACTEDBYTHECOUNCILOFTHEDISTRICTOFCOLUMBIA,Thatthisactmaybecitedasthe“InstitutionofHigherEducationSexualMisconductReportingandResourceAccessibilityActof2025”.
Sec.2.Definitions.
Forthepurposesofthisact,theterm:
(1)“Assistedparty”meansastudentat,oranemployeeof,aninstitutionwho
seekstheservicesofa confidentialresourceadvisor.
(2)“Confidentialcommunication” means oralorwritteninformationexchanged
between a confidentialresourceadvisorand an assistedpartywhiletheconfidentialresource
advisorisperformingthedutiesrequiredor authorizedunderthisact.
(3)“Confidentialresourceadvisor”means an individualwhom an institutionhas
designatedtoprovideemergency and ongoing supporttoan assistedpartypursuanttosection3

andwho isnotempowered toinstitutecorrectivemeasuresonbehalfof theinstitutionin
responsetoareportofsexualmisconduct.
(4)“Employee”meansanindividualemployedbyaninstitution.
(5)“Institution”meansanentityorpersonincorporated,chartered,orestablished
intheDistrict,includingbyCouncilorcongressionalact,thatofferspostsecondaryorgraduate
degrees,andthatoperates,keeps,ormaintainsafacilityintheDistrict.
(6)“Student”means an individualwho isenrolledatan institutionatthetimeof
allegedsexualmisconduct.
(7)“Sexualmisconduct”shallhave thesame meaning as sex-basedharassment,as
thatterm isdefinedin34 C.F.R.§ 106.2;
(8)“Sexualmisconductresourceprovider”meansa:
(A) Domestic violencecounselor,as thatterm isdefinedinD.C. Official
Code§14-310(a)(2);
(B)Human traffickingcounselor,asthattermisdefinedinD.C.Official
Code§14-311(a)(2);or
(C) Sexualassaultcounselor,as thatterm isdefinedinD.C. OfficialCode
§23-1907(10).
(9)“Supportivemeasures”shallhavethesamemeaningasprovidedin34CF.R.
§106.2.
(10)“TitleIX”meansTitleIXoftheEducationAmendmentsof1972,approved
June23,1972(86Stat.373;20U.S.C.§1681efseq.).
(11)“TitleIXCoordinator”meanstheemployeedesignatedbyaninstitutionto
performthefunctionsrequiredby34C.F.R.§106.8(a).
(12)“Trauma-informedresponse”meansaresponsetoareportofsexual
misconductinvolvinganunderstandingofthecomplexitiesofsexualmisconductthrough
trainingcenteredontheneurobiologicalimpactoftrauma,theinfluenceofmythsandstereotypes
surroundingthecausesandimpactsoftrauma,perpetrationmethodologypertainingtosexual
misconduct,and methods toconductinvestigationsof sexualmisconduct.
Sec.3.Confidentialresourceadvisorroleandresponsibilities.(a)(1)Eachinstitutionshallemployorcontractforatleast2confidentialresourceadvisorstoserveasconfidentialresourcesforstudentsandemployeesseekingresourcespertainingtosexualmisconduct.
(2)Aninstitutionshallnotifyallstudentsandemployees,inwriting,oftheidentities,contactinformationfor,andavailabilityofitsconfidentialresourceadvisors.(b)Confidentialresourceadvisorsshallprovideallinstitutionstudentsandemployeeswithresourcesrelatedtosexualmisconductinwrittenorelectronicformat,whichmayincludewebsitelinks,pamphlets,handouts,andinformationpackets.Aninstitutionmayauthorizeits

TitleIXCoordinatortoapprovetheresourcestobeprovidedbyconfidentialresourceproviders
beforedisseminationtoensureaccuracyandinstitutionalconsistency.
(c)Confidentialresourceadvisorsmay provideresourcesand informationtoassisted
partiesinadditiontothoseprovidedpursuanttosubsection(b)ofthissection,including:
(1)Optionsforreportingsexualmisconducttotheinstitution’spublicsafety
personnel,Districtorfederallawenforcement,ortheinstitution’sTitleIX Coordinator,andthe
processesrequiredformaking a complainttoeach entity;
(2)Informationpertainingtofreeandlow-costlegalandsexualmisconduct
responseservicesavailablethroughlocallegalservicesproviders,sexualmisconductresource
providers,andtheDistrict’sCrimeVictimCompensationProgram:
(3)Informationpertainingto securingprotectionor no contactorders,restraining
orders,or similarlawfulordersissuedby a criminalor civilcourt;
(4)Informationpertainingtotheassistedparty’srightsand theinstitution’s
responsibilitiesregardingprotectionorders,nocontactorders,andanyotherlawfulordersissued
bytheinstitutionorbyacourtoflaw;
(5)TheinvestigativeprocessesofDistrictandfederallawenforcementagencies
andlegalprocessesofDistrictjudicialbodiespertainingtosexualmisconduct;
(6)Medical and healthservicesavailablethroughtheinstitutionand atfacilities
thatareunaffiliatedwiththeinstitution,includingfreemedicalforensicexams availablethrough
localsexualassaultnurseexaminerprograms;
(7)Counselingandmentalhealthservicesavailablethroughtheinstitutionand
availablethroughlocalprovidersoutsidetheinstitution;
(8)For studentsconsideringchangesintheirenrollmentstatussuch thatthe
housingarrangements,healthcare,orinsurancecoverageavailablethroughtheinstitutionwould
‘bedisruptedorterminated,rentassistanceresources,healthcareresources,andinsurance
resourcesavailableoutsidetheinstitution;
(9)Theformalandinformalresolutionprocessespertainingtosexualmisconduct,
availableattheinstitutionand availableoutsidetheinstitutionthroughsexualmisconduct
resourceproviders;
(10)A descriptionofthesupportivemeasuresavailableattheinstitution,
includingthroughtheinstitution’sTitleIX officeand disabilitiesservicesoffice;
(11)InformationabouttheTitleIX Coordinator’sroleinprovidingstudentswith
supportivemeasuresandinassistingstudentswithmaintainingacademicprogress,suchas
withdrawingfromortakinganincompletegradeinaclass;and
(12)Forstudentsconsideringchangesintheirenrollmentstatus,referralstoloan
counselingservicespertainingtoloandeferment,loandefault,forbearance,orotherstudentloan
orgrantprograms.
(d)Confidentialresourceadvisorsshallinformassistedpartiesof limitationsinproviding
privacyorconfidentiality,includinginformingtheassistedpartythatinformationsharedwiththe

confidentialresourceadvisorcouldbedisclosedinlimitedcircumstances,includinginresponsetoa courtorderor subpoena.
(e)Theconfidentialresourceadvisormayprovideguidancetotheassistedparty
regardinghowtoaccesssupportivemeasuresandindecidingthetypeofsupportivemeasuresto
request.
(®)Within3monthsafterbeingdesignatedasaconfidentialresourceadvisor,in
coordinationwiththeinstitution'sTitleIXCoordinator,aconfidentialresourceadvisorshall
establishandmaintainregularcommunicationwiththefederallydesignatedstatesexualassault
coalitionfortheDistrictandthefederallyrecognizedstatewidecoalitionofdomesticviolenceprogramsfortheDistrict.
(g)A confidentialresourceadvisormay,ifappropriateandifdirectedbytheassisted
party,supporttheassistedpartyincontactingtheinstitution’spublicsafetypersonnelorlocalor
federallawenforcementtomakeareportofsexualmisconduct.
(h)A confidentialresourceadvisormayattendanadministrativeorinstitution-based
adjudicationproceedingastheadvisorfortheassistedparty.
(i)(1)Notwithstandingsection2ofAnActToprovideforthemandatoryreportingby
physiciansandinstitutionsintheDistrictofColumbiaofcertainphysicalabuseofchildren,
approvedNovember6,1966(80Stat.1354;D.C.OfficialCode§4-1321.02),whenan
individualisactingintheindividual’scapacityasa confidentialresourceadvisor,an assisted
party’scommunicationswiththeconfidentialresourceadvisorrelatingtoanincidentofsexual
misconductshallbeconfidential,maynotbedisclosedtotheinstitutionorlawenforcement
authorities,andshallbeprivilegedagainstdisclosureinanylegaloradministrativeproceedingunless:
(A)Disclosureofinformationisnecessaryfortheinstitutiontocomply
withsection485(f)oftheHigherEducationActof1965,approvedOctober17,1986(104Stat.
1454;20U.S.C§1092(f);
(B)A partyadmitstocommittingwhattheconfidentialresourceadvisor
reasonablybelievestobeacrimeofviolence,asthetermisdefinedinD.C.OfficialCode§23-
1331(4),oradangerouscrime,asthetermisdefinedinD.C.OfficialCode§23-1331(3);
(©)Theconfidentialresourceadvisordeemsdisclosurenecessaryto
protecttheassistedpartyoranotherindividualfromasubstantialriskofimminentandserious
injury;
(D)Thepartytheconfidentialresourceadvisorassistedprovidedwritten
consentfortheconfidentialresourceadvisortodiscloseinformationtheconfidentialresource
advisorreceivedfromtheparty;or
(E)DisclosureisotherwiserequiredbyaDistrictorfederalstatuteorbya
courtoflaw.
(2)Totheextentthedisclosureofinformationcoveredinparagraph(1)ofthis
subsectionwouldnotbepermittedundertheFamilyEducationalRightsandPrivacyActof

1974,approvedAugust21,1974(88Stat.571;20U.S.C.§ 1232gefseq.),anditsimplementing
regulations(34C.F.RPart99),theexceptionstoconfidentialityinparagraph(1)ofthis
subsectionshallnotapply.
(1) Ifaconfidentialresourceadvisorisrequiredbystatuteorbyacourtoflawto
disclosea confidentialcommunication,theconfidentialresourceadvisorshallinformthestudent
or employee who made theconfidentialcommunicationofthe requirementtodiscloseatleast7
calendardaysinadvanceofdisclosure,unlessprohibitedbylaw,acourtorder,orsubpoenafrom
disclosingtherequirementtodiscloseinformation.
(2)Ifthe assistedpartynotifiestheconfidentialresourceproviderthatthe
individualhas fileda motion fora protectiveorderor a motion toquash priortothedate
disclosureisdue,theconfidentialresourceprovidershallnotdisclosetherequiredinformation
untilthereisa rulingby thecourton such motion and shallonlymake thedisclosureas
determinedbythecourt,
(1) An institutionmaycontractwithavictimadvocacyorganizationtoprovide
confidentialresourceadvisorsas requiredunder thissection.
(2)An institutionthatenrollsfewerthan1,000residentialstudentsmay partner
with anotherinstitutionor sexualmisconductresourceproviderintheDistrictto providethe
servicesrequiredunder thissection.
(3)An institutionshallensurethatanycontractenteredintounderthissubsection
shallresultina confidentialresourceadvisorbeingavailablewithina reasonabledistancefrom
theinstitutionorby electronicmeans.
(1)Noticetoa confidentialresourceadvisorof an allegedactof sexualmisconductor a
confidentialresourceadvisor’sperformanceof a serviceunderthissectionshallnotbe
consideredactualor constructivenoticeof an allegationofsexualmisconducttotheinstitutionat
whichaconfidentialresourceadvisorisemployedorprovidescontractedservices.
(m) The MetropolitanPoliceDepartmentor theinstitutionshallnotdiscipline,penalize,
or otherwiseretaliateagainsta confidentialresourceadvisorforlawfulactionstakeninthe
courseof representingtheinterestsofthe assistedparty.
(n)The servicesprovidedtoassistedpartiesby a confidentialresourceadvisorshallbe
freeofcharge.
Sec.4.Confidentialresourceadvisorqualificationsandtraining.(@A confidentialresourceadvisor:(1)Shall:
(A)HaveundergonetrainingthatconformswiththerequirementsofD.C.OfficialCode§23-1907(10)(B);(B)Beappointedbasedontheindividual’professionalexperienceandtrainingtoprovidesupporttostudentsandemployees;(C)Completeyearlytrainingsin:

(i)Sexualmisconductawarenessandprevention:
(ii)TitleIXpoliciespertainingtosexualmisconduct;
(iii)Trauma-informedresponses;
(iv)Districtlawspertainingtosexualmisconductsurvivorrights
andresources;and
(v)Ifemployedbyaninstitution,theinstitution’spoliciespertainingtostudentconduct,sexualmisconduct,andsexualrelationships;
(2)Shallnot:
(A) Providementalhealthor behavioralhealthcounselingservicesor
therapytotheassistedpartywhileprovidingconfidentialadvisorservices;
(B)Provideservicestopartiesinvolvedinthesameallegationofsexual
misconduct;
(C)Attheinstitutionthathasdesignatedtheindividualasaconfidential
resourceadvisorbe:
(i)Anundergraduatestudent,exceptforafacultyorstaffmember
enrolledinoneundergraduatecoursefora term;or
Gi)A full-timegraduateordoctoralstudent;
(D) Be theTitle[X Coordinator;
(E) Be an authorizedadministratorofdisciplinaryprocesseson behalfof
theinstitution;
(F)Beamemberoftheinstitution'spublicsafetypersonnel;or
(G) Have employment responsibilitiesthatmay createa conflictof interest
betweenthedutiesofa confidentialresourceadvisorandtheemployee'sotherjob
responsibilities,includingemploymentbytheinstitutionas:
(i)Generalcounsel;
(ii)A religiousorspiritualauthority;
(iii)Directorofathletics;
(iv)Deanofstudents;or
(v)An employeewhoservesonastudentoremployeeconduct
judicialorheatingboatdortowhomanappealmightbemade;and
(3)Maybeasocialworker,psychologist,psychotherapist,professionalclinical
counselor,psychiatrist,or mentalhealthcounselorlicensedintheDistrict;provided,thatifa
confidentialresourceadvisorisactivelyservingtheassistedpartyasamentalorbehavioral
healthcounselorortherapistatthetimetheassistedpartyseeksconfidentialresourceadvisor
services,theconfidentialresourceadvisorcannotservetheassistedpartyinbothcapacities,
Sec.5.Amnestyprotections.(a)A studentorawitnesstoanincidentofsexualmisconductwhoreportsanincidentofsexnalmisconducttoaninstitutionortolocalorfederallawenforcementshallnotbesubjecttoa

disciplinaryproceedingorsanctionforaviolationoftheinstitution'spoliciesgoverningstudents
orthestudentcodeofconductforvoluntaryuseorpossessionofillegaldrugsoralcoholorfor
consensualsexualactivitythatoccurredimmediatelypreceding,during,orimmediately
followingtheincidentof sexualmisconductunlesstheinstitutiondeterminesthatthereportwas
notmade ingood faithor thattheviolationputatimmediateriskthehealthand safetyof other
individuals.
(b)Notwithstandinganinstitution’spoliciesgoverningstudentsorastudentcodeof
conduct,aninstitutionshallnottakedisciplinaryactionagainstanystudentforconsensualsexual
activityrelatedtoan incidentorallegationofsexualmisconductorforotherconsensualsexual
activityrevealedduringaninvestigationofa reportofsexualmisconduct,
(c)Thissectionshallnotapplytoaninstitutioniftheapplicationwouldbeinconsistent
witha sincerelyheldreligiousbeliefof theinstitution.
Sec.6.Sexualmisconductawarenessandpreventiontrainings.
(a)Aninstitutionthatprovidesundergraduateeducationshallmakereasonableeffortsto
requireeveryundergraduatestudenttocomplete2sexualmisconductprimarypreventionand
awarenesstrainingsthataretrauma-informedand gender-inclusive,one of which shalloccur
beforethebeginningofthe2ndyearofa student’sundergraduateeducation,andthe2ndbefore
thebeginningofthe4thyearofa student'sundergraduateeducation;providedthataninstitution
willbe deemed tohave compliedwith thissectionifa studentenrolledina 2-yeardegree
programreceivesonetrainingbeforethebeginningofthestudent’s2ndyear.Thetrainingshall
include:
(1)Anexplanationofconsentinreferencetosexualactivityandsexual
relationships;
(2)Examplesofphysicalandmentalincapacitation,suchaswhenanindividualis
asleep,unresponsive,unconscious,vomiting,unabletowalkunassistedordressorundress
withoutassistance,incoherentlycommunicating,ordisplayingalackofawareness;
(3)Therolethatdrugsandalcoholplayinanindividual'sabilitytoconsent;(4)Informationinwritingabout:
(A)Theimportanceofpreservingevidencetodocumentsexual
misconduct;
(B) Procedurestoreportan incidentofsexualmisconduct,including
confidentialand anonymous disclosure,and a statementthattheinstitution’sabilitytorespondto
confidentialor anonymous disclosuremay be limited;and
(C)Informationontheinstitution'sproceduresforresolvingsexual
misconductcomplaints,includinginformalresolutionoptions,and therangeof sanctionsthe
institutionmayimposeonstudentsandemployeesfoundresponsibleforsexualmisconduct;
(5)The name andcontactinformationoftheinstitution’sconfidentialresource
advisorsandthelimitationsoftheconfidentialityofthisrole;

(6Safeandpositivestrategiesforbystanderinterventionthatmaybecarriedoutbyanindividualtopreventharmorreduceriskofsexualmisconduct;(7)Theinstitution’sresponsibilitiesregardingordersofprotection,nocontactorders,restrainingorders,orsimilarordersissuedbyacriminalorcivilcourt;(8)Opportunitiesforongoingsexualmisconductpreventionandsexual
misconductawarenesstrainingandprogramming;and(9)A listofoff-campussexualmisconductresourceproviders,updatedannually
bytheinstitutioninconsultationwiththeDistrict’sfederallydesignatedstatesexualassaultcoalitionandfederallyrecognizedstatewidecoalitionofdomesticviolenceprograms.(b)Institutionsshallensurethatsexualmisconductpreventionmaterialssuchashandouts,posters,websitelinks,andinformationpacketsareprominentlydisplayedandreadilyavailabletostudentsandstaffinallinstitutionbuildingswherestudentsarepermitted,including
indormitories,academicbuildings,officebuildings,libraries,athleticfacilities,laboratories,studentcenters,anddininghalls.
Sec.7.Trainingforindividualsinvolvedinsexualmisconductresponseprocesses.
(a)An individualwhoparticipatesintheimplementationofaninstitution'ssexual
misconductinvestigativeanddisciplinaryprocessesshallreceiveannualtraininginhandling
sexualmisconductcomplaintsandintheoperationsoftheinstitution'sdisciplinaryprocess,
which shallinclude:
(1)Informationaboutworking withand interviewingindividualsinvolvedinan
allegationofsexualmisconduct;
(2)Informationabouttypesof conductthatconstitutesexualmisconduct;
(3)Informationaboutconsentandtheroledrugsandalcoholmayplayinan
individual'sabilitytoconsent;
(4)Theeffectsoftrauma,includingneurobiologicalandphysicalmanifestations
oftraumainan individual;
(5)How toavoidmakingassumptionsaboutculpabilitybasedonprotected
categoriesand socialidentities;and
(6)Techniquestocommunicate sensitivelyand compassionatelywith individuals
involvedinan allegationof sexualmisconduct.
(b)An institutionshallensurethatitsconfidentialresourceadvisor,TitleIX office
personnel,andpublicsafetypersonnelemployedorcontractedbytheinstitutionareeducatedin
trauma-informedresponses.
Sec.8.Minimum criteriaforinstitutionalsexualmisconductpolicies.
(a)An institutionshallensurethattheinstitution’ssexualmisconductpolicyincludes:
(1)Informationon where victimsof sexual misconductcan receiveimmediate
emergencyassistancefollowinganincidentofsexualmisconduct,whichshallinclude:

(A)Thename,location,andcontactinformationofmedicalfacilities
where an individualmay requestthata medicalforensicexam be administeredbya trained
sexualassaultforensichealthcareprovider:
(B)Descriptionsandcontactinformationforsexualmisconductresource
providersandadescriptionoftheservicesprovidedbysuchproviders;
(C)Thetelephonenumberandwebsiteforanationalandlocal24-hour
sexualmisconductresponsehotline;and
(D)Informationonanyprogramsthatmayprovidefinancialassistanceto
a studentwith thecostof emergency medicalassistanceorrelatedtravel;and
(2)InformationregardingthelegalandinstitutionalobligationsoftheTitleIX
CoordinatorandemployeesoftheTitleIXoffice;and
(3)Descriptionsoftherolesandresponsibilitiesandcontactinformationforthe
institution'sconfidentialresourceadvisorsand TitleTX Coordinator.
(b)Each institutionshalldistributetheinformationrequiredunder subsection(a)ofthis
sectionby electronicorpostalmailtostudentsandemployeesoftheinstitutionorshallmaintain

Sec.9.Datareportingrequirements.(a)BeginningonJune30,2029,andevery3rdcalendaryearthereafter,institutionsshallprepareandsubmittotheHigherEducationLicensureCommissionandpublishontheinstitution’swebsiteareportwithdataaboutconfidentialresourceadvisorandTitleIXoffice
outcomesfortheprevious3calendaryears.Thereportshallnotincludepersonalidentifyinginformationofstudentsorstaffwhoaccessedtheinstitution’ssexualmisconductresourcesoranyinformationthatbyitselforincombinationwithotherpubliclyavailableinformationcould
identifyaparticularperson.Demographicdatamaybeaggregated,andanycountsordatapointswithfewerthan10reportsshallbesuppressed.Thereportshallinclude:
(1)Fortheinstitution’sTitleIXoffice:(A)Sexualmisconductreportstotheinstitution’sTitleIXofficebyacademictermforeachacademicyear,brokendownbydatingviolence,domesticviolence,
stalking,sexualassault,andsexualharassment;(B)Sexualmisconductcomplaintstotheinstitution'sTitleIXofficebyacademictermforeachacademicyear,brokendownbydatingviolence,domesticviolence,stalking,sexualassault,andsexualharassment;(C)Thelocationofa reportedincidentofsexualmisconduct;(D)Thecomplainant'sstatusasastudentoremployeeoftheinstitution;(E)Thesourceofa report,suchasadesignatedreporteroracomplainant;

(B) The numberoftimes confidentialcommunicationswere disclosed
pursuanttosection3(j),andthereasonfordisclosure;
(C)Alist ofthe trainingsthattheinstitution’sconfidentialresource
advisorsunderwenteachyear,asrequiredbysection4(a)andsection7;

approvedMarch15, 2022 (136 Stat.959;20 U.S.C.§ 11611-6),institutionsin the Districtshall

submittheresultsoftheonlinesurveyforcampussafetytotheHigherEducationLicensureCommissionandpublishtheresultsontheinstitution’swebsite.

Sec.10.Enforcement.
Upondetermination,afterreasonablenoticeandopportunityforahearing,thataninstitutionhasmateriallyviolatedorfailedtocarryoutanyprovisionofthisact,theHigherEducationLicensureCommissionmayimposeacivilfineuponaninstitutionforeachviolationnottoexceed$59,000,oronepercentofaninstitution’sannualoperatingbudget,whicheverislower.RevenuesgeneratedfromcollectingcivilpenaltyfinesshallbedirectedtotheOfficeofVictimsServicesandJusticeGrantstoallocatetosexualmisconductresourceproviders.

(a)ThisactshallapplyasofJune30,2026.

oftheDistrictofColumbiaon thedateofinclusionofitsfiscaleffecton theUniversityofthe
Districtof Columbia inan approved budgetand financialplanor as of June 30,2026,whichever
islater.
(2)The ChiefFinancialOfficershallcertifythedateoftheinclusionofthefiscal
effectinanapprovedbudgetandfinancialplan,andprovidenoticetotheBudgetDirectorofthe
