Sec. 102.Tangledtitledisclosure.
(a)No laterthan180daysaftertheeffectivedateofthissubtitle,theDepartmentshall,in
consultationwiththeSuperiorCourtofthe Districtof Columbia and legalserviceproviders,
createandmakepubliclyavailableatangledtitleinformationsheetdetailingthestepsnecessary,afterthedeathofa realpropertyowner,tolegallytransfertherealpropertytoadecedent'sheirs
orlegatees.The informationsheetalsoshallincludeinformationon legalserviceproviderswho
offerlow-costorno-costrepresentationinestateadministrationcases.
(b)(1)No laterthan5 days afterthefinaldispositionof thedeceased,or atthetime of
providingtosurvivorsofthedeceasedanydeathcertificateordeathcertificatesorderedbythe
funeralservicesestablishmentfrom theDepartment of Health,whichever occursfirst,a funeral
serviceestablishmentshallprovidethetangledtitleinformationsheetmade availableby the
Departmenttosurvivorsof thedeceased.
(2)Afuneral serviceestablishmentthatfailstoprovidea tangledtitleinformation
sheetpursuanttoparagraph(1)ofthissubsectionmaybesubjecttoacivilpenaltynottoexceed
$100 foreach offense.

“§18-1003.Custodianofwillupondeathoftestator.“(a)Uponnotificationofthetestator’sdeath,theRegisterofWillsshall:
“(1)Unsealthewill;“(2)DeliverthewilltotheProbateCourtforfilinginaccordancewith§18-110.“(b)IfthetestatorwasnotadomiciliaryoftheDistrictofColumbiaatthetimeofdeath,

SUBTITLE C. SINGLE FAMILY HOME REHABILITATION PROGRAM.
Sec. 121.Definitions.
For purposesof thissubtitle,theterm:
(3)“Areamedianincome”meanstheareamedianincomeoftheWashington
MetropolitanStatisticalAreaassetforthintheperiodiccalculationprovidedbytheU.S.
DepartmentofHousingandUrbanDevelopment.
(2)“Department”meanstheDepartmentofHousingandCommunity
Development.
(3)“Eligiblehomeowner”meansanownerorownerswho:
(A)Ownsasingle-familyresidentialproperty;
(B)Has a householdincomethatis80%of area medianincomeorless;
(C)Hasresidedinthesingle-familyresidentialpropertyasaprimary
residenceforatleast3 years;
(D)Iscurrentonallmortgagepaymentsforthelast3months;
(E)IscurrentonallDistrictandfederaltaxes;provided,thatanowner
who has notdefaultedon a realpropertytaxpayment planenteredintopursuanttoD.C. Official
Code § 47-811.05and remainscurrenton realpropertytaxesthatcome due shallbe considered
currentonDistrictrealpropertytaxesforpurposesofdeterminingeligibilityunderthis
paragraph;and
(F)Possessescurrenthomeownersinsurance.
(4)“Single-familyresidentialproperty”shallhavethesamemeaningassetforth
inD.C.OfficialCode§47803(6).
Sec.122.Single-familyhomerehabilitationprogram.
(a)TheDepartmentmayoffersingle-familyhomerehabilitationgrantstoeligible
homeowners topay for:

(1)Accessibilitymodificationstoadjustphysicalbarrierswithinthepropertyfor
personswithlimitedmobilityorotherphysicalimpairment;
(2)Repairsto,orreplacementof,theroof;
(3)Renovationstocorrectcodeviolations,includinglead-basedpainthazard
reductionandreplacingorrepairingdrywallordamagedflooring;
(4)Energy-relatedimprovements;
(5)Repairstothefoundationortoaddressothersignificantstructuraldamage;or
(6)Repairsto,orreplacementof,electrical,plumbing,orheatingandcooling
systems.
(b)(1)TheDepartmentshallworkwithqualifyingapplicantstodevelopascopeofwork,
selecta licensedand certifiedcontractor,and manage theconstruction.
(2)AnypaymentstocontractorsshallbemadebytheDepartmentonbehalfof
eligiblehomeowners.
(c)TheMayor,pursuanttoTitleIoftheDistrictofColumbiaAdministrativeProcedure
Act,approvedOctober21,1968(82Stat.1204;D.C.OfficialCode§2-501efseq.),shallissue
tulestoimplement theprovisionsof this section.
SUBTITLE D. REAL PROPERTY TAX PAYMENT PLANS.
Sec.131.Title47of the Districtof Columbia OfficialCode isamended as follows:
(a)Chapter8 isamended asfollows:
(1)Thetableofcontentsisamendedbyaddinganewsectiondesignationtoread
as follows:
“47-811.05.Realpropertytaxpaymentplans.”.
(2)Anew section47-811.05isaddedtoreadasfollows:
“§47-811.05,Realpropertytaxpaymentplans.
“(a)Forpurposesofthissection,theterm:
“(1)“Eligiblehomeowner” means an ownerorownerswho receivesthe
homesteaddeductionpursuantto§47-850and:
“(A)Candemonstratehardship;
“(B)Has a householdadjustedgrossincome thatislessthan$125,000,
increasedannually,beginningOctober 1,2025, by thesenioror disabledcost-of-living
adjustment;provided,thatiftheadjustmentdoesnotresultinamultipleof$50,theadjustment
shallbe rounded tothenextlowestmultipleof $50;
“(C)Hasbeendeterminedtohaveapermanentandtotaldisabilitybythe
SocialSecurityAdministration,isreceivingSupplementalSecurityIncomeorSocialSecurity
DisabilityInsurance,isreceivingdisabilityannuitiespursuanttotheRailroadRetirementAct of
1974,approvedOctober16,1974(88Stat.1305;45U.S.C.§231etseq.),orisreceivingfederal
orDistrictofColumbiagovernmentdisabilitypayments;or
“(D)Is65yearsofageorolder.
“(2)“Taxliabilities”meansbothrealpropertytaxesthataredelinquentandreal

propertytaxesthatarecurrentlydue butnot yetdelinquent.The term “taxliabilities”does not
include:
“(A)BusinessImprovementDistrict(“BID”)taxes;
“(B)TaxIncrementFinancing(“TIF”)payments;
“(C)Payments In Lieu of Taxes (“PILOTS”);
“(D) SoutheastWater and Sewer (“SEWS”) assessments;
“(E)SpecialEnergyAssessmentassessments;or
“(F)Amountscertifiedbyexternalagenciespursuantto§47-1340.
“(b)Realpropertytaxpaymentplanswitheligiblehomeownersareauthorizedforall
amountsdueasrealpropertytaxliabilitiessubjecttothefollowingtermsandconditions:
“(1)Eligibilityforapaymentplanshallbebasedonthecriteriasetforthinthe
definitionof“eligiblehomeowner”insubsection(a)(1)ofthissection;
“(2)Paymentplansmaybecomputedona12-month,18-month,or24-month
basis,andtaxliabilitiesaretobepaidinequalinstallmentsovertheperiodagreedtoinwriting
bytheeligiblehomeownerpursuanttothetermsofthepaymentplan;
“(3)No downpaymentshallberequired;
“(4)PaymentsmaybemadebydirectACH debitfromtheeligiblehomeowner’s
bank accountto theDistrictor by check or money orderpayableto the“DC Treasurer”,and,if
thereareinsufficientfundsforthedebitor check,theeligiblehomeowner shallalsobe liablefor
afeeimposedbytheDistrictforthedishonoredpayment;
“(5)An eligiblehomeownercannothavemorethanonepaymentplanactiveata
time;
©) An eligiblehomeownercannotapplyforapaymentplanforperiodscovered
underapaymentplanthatheorshepreviouslydefaultedon;
“(7)Ifthereisareclassificationofa property,ahomesteadorsenior/disabled
audit,ofthegrantingofa taxreliefapplicationduringthetermofa paymentplan,theexisting
paymentplanshallterminate,andtheeligiblehomeownercanreapplyforthesameperiods
coveredbytheterminatedplan;“(8)Propertywillnotbesoldatataxsaleduringthetimeapaymentplanis
active;
“(9)Whileenrolledinapaymentplan,aneligiblehomeownershallremain
currenton realpropertytaxesthatcome due;
“(10)The Officeof Tax and Revenue may declarean eligiblehomeowner in
materialbreachofa paymentplanifheorshefailstomaketherequiredpayments;provided,that
amaterialbreachmaynotbedeclaredearlierthanthe65thdayfromtheagreeduponduedate
fora missed payment and the45th day from themailingof a noticeof riskofmaterialbreach;
“(11)An eligiblehomeowner who has been declaredinmaterialbreachofa
paymentplanmayhavehisorherpaymentplanreinstatedifheorshepaysalumpsumequaltotwicetheregularmonthlypaymentdue,togetherwiththemissedpaymentsaswellasany
paymentscurrentlydue;and

“(12)TheOfficeofTaxandRevenuemaydeclareaneligiblehomeownerin
defaultifhe or she has failedtocurea materialbreachwithin45 daysof the datetheeligible
homeowner isdeclaredto be inmaterialbreach,and,ifan eligiblehomeowner isdeclaredin
defaultofapaymentplan,suchplanshallbevoid.
“(c)Requestsforrealpropertytaxpaymentplanstobeenteredintopursuanttothis
sectionshallbemadeonlineatMyTax.DC.gov.TheOfficeofTaxandRevenueshallprovideapaymentplanagreementconfirmationtotheeligiblehomeowner.Theagreementshallcontain
thefollowinginformation:
“(1)Themonthlypaymentamount;
“(2)Thepast-duedate;
“(3)Thelengthoftheplan,includingthenumberofpayments;
“(4)Thetotalamountagreedtobedueundertheplan;
(5)A statementofthedelinquenttaxperiodscoveredbytheplanaswellasan
itemizedstatementoftheamountsdueforeachperiodspecifyingtheamountdueforprincipal,
interest,penalties,and any otherchargesor fees;
(6)A statementthattheeligiblehomeownerisrequiredtoremaincurrentonreal
propertytaxesduringthelengthoftheagreement,aswellasanexplanationofhowcurrent
paymentsshouldbetenderedinordertoavoidmisapplicationofpaymentstodelinquenttaxes;
“(7)A briefexplanationofhowpaymentswillbeappliedtothedelinquency;
“(8)Abriefexplanationoftheconsequencesofbreachanddefaultonthepayment
plan;and
“(9)A statementthatpayments aretobe remittedtotheDistrictelectronicallyby
directdebitor by check or money orderpayabletothe“DC Treasurer”,thatpayments made
electronicallywillbewithdrawnfromtheeligiblehomeowner’saccountonthemonthlypayment
duedate,andthat,ifthereareinsufficientfundsforthedebit,theeligiblehomeowner alsoshall
be liablefora feeimposed by theDistrictforthedishonoredpayment.
“(d)(1)Ifaneligiblehomeownerfailstomakearequiredpaymentwithin20daysof an
agreed-uponpaymentduedate,theOfficeofTaxandRevenueshallsendanoticeofriskof
materialbreachtotheeligiblehomeowner. The noticeshallincludea statementthattheeligible
homeowner isatriskofmaterialbreach,theentireamount requiredtocurethemissed payment
‘orpaymentsaswellasanypaymentscurrentlydue,andabriefdescriptionoftheconsequences
ofa materialbreach,
“(2)Ifaneligiblehomeownerisdeclaredtobeinmaterialbreachofa payment
plan,theOfficeof Tax and Revenue shallsend a noticeof materialbreachtotheeligible
homeowner thatincludesa clearstatementthathe or she has been declaredinmaterialbreach,
thedateon which thematerialbreachwas declared,theentireamount requiredtocurethe
missed payment or payments as wellas any payments currentlydue and lump sum payments that
mayberequired,andaclearstatementthatfailuretomaketherequiredpaymentwillresultin
default.”.

“AccordingtotheMayor’staxroll,youownormayhaveaninterestintherealpropertylisted
above.Noticeisgiventhatunlessyoupaytheamountstatedaboveorfallwithinoneofthe
limitedexemptionsfromthetaxsale,theOfficeofTaxandRevenuemaysellthisrealproperty
attaxsale.
“Ifthepropertyissoldattaxsale,thepurchasermayhavetherighttofilealawsuittoforeclose
on theproperty.You must actnow toavoidadditionalcostsand significantexpenses,aswellas
potentiallossof titletotheproperty.
“Paymenttothe“DCTreasurer”maybemadeonlineatMyTax.DC.govormailed(withpayment
couponfromtaxbill)totheOfficeofTaxandRevenue,DC GovernmentRealPropertyTaxes,
P.O,Box 718095,Philadelphia,PA 19171-8095 (pleasewriteyour square,suffix,and lot
numbersonthecheck).Youshouldkeepacopyofyourproofofpaymentincasethereisalater
disputeaboutthepayment.

shallpublishnoticeof the hardshipexemption intheDistrictof Columbia Register.The notice
shallcontainthenameoftheowner,theaddressoftheproperty,andthetaxyearinwhichthe
exemptionapplies.“(d)The totalcumulativetime forexemptionsgrantedunder subsection(b)of thissection
toanypropertyshallnotexceed5taxyearsinany12-yearperiod.

oranagreed-onthirdpartyforanamountagreedtobyallpartiestothereceivershipasbeingthe
property’sfairmarketvalue.“(k)Followingcourtratificationofa salemade pursuantto subsection(i)of thissection,
thereceivershallsigna deed conveyingtitletothebuyer,freeand clearofallliens,judgments
and otherencumbrances.On courtratificationofthe sale,any securedinterestofa lienor

requirementsunder section12;or
(2)A violationofthepropertymaintenancecode(12GDCMR § 101Getseq.)
remainsunabatedforatleast30 days aftertheissuanceof a finalorderby theOfficeof
AdministrativeHearings.
